The candidate later went on to explain that sex between a man and a woman is “special,” and even birth control is “not OK.”

“We’ll repeal Obamacare and get rid any idea that you have to have abortion coverage or contraceptive coverage,” he said. “One of the things that I will talk about that no president has talked about before is I think the dangers of contraception in this country, the sexual liberty idea and many in the Christian faith have said, you know contraception is OK. It’s not OK because it’s a license to do things in a sexual realm that is counter to how things are supposed to be.”

Phill Klein, the virulently anti-abortion former Kansas Attorney General, has been under investigation by the Kansas bar for leaking confidential medical records in order to harass abortion providers and abortion recipients.

Well, the disciplinary board has now recommended that his license to practice law be permanently suspended:

A Kansas disciplinary panel said Thursday that former Kansas Attorney General Phill Kline should be indefinitely suspended from practicing law in the state because of the “dishonest and selfish” way he pursued abortion clinics.

The recommendation of the attorney disciplinary board culminates a turbulent six-year period in which Kline — as attorney general and later Johnson County district attorney — presided over investigations of the late George Tiller’s abortion clinic in Wichita and Planned Parenthood in Overland Park.

I’m not sure if this is a disbarment, or just one step short of this.

In any case, I wouldn’t worry about Mr. Kline. I’m sure that the VWRC will find him something remunerative to him, because, unlike Democrats, the wingers take care of their own.

Maddow notes that Jerry Fallwell’s phony school has already given him a professorship.

Kansas just passed a series of regulations that closed down the 3 abortion clinics in the state.

Following the adoption of the regulations, which included things like the size of janitors closets (!), the clinics had about a week to comply:

After deliberating about an hour, U.S District Judge Carlos Murguia issued an order late this afternoon blocking new Kansas licensing regulations for abortion clinics.

The temporary restraining order was sought by two Kansas City area abortion clinics that had been denied licenses under rules that took effect today. It will be in effect until a later court decision on the issue.

They contend that the licensing process was an organized and deliberate attempt by Gov. Sam Brownback’s administration to shut down abortion clinics in Kansas.

Brownback, a staunch abortion opponent, signed the new licensing requirements into law along with three other new abortion restrictions approved by the Legislature this year.

Providers said the state didn’t send out the rules until after the close of business June 17, less than two weeks before the new licensing was scheduled to start. They said they didn’t receive the new regulations until the following Monday, June 20.

The compressed licensing process, coupled with the strict requirements, made it impossible to meet the law, they argued in their legal filings.

Six days after Aid for Women applied for a license, the state said it wouldn’t grant one based on its application alone, the clinic’s complaint said. At no point, the clinic contends, did regulators discuss why they denied the license or what corrective measures might be undertaken.

The clinic argued that the Kansas Department of Health and Environment had no factual basis for the denial because it hadn’t even inspected the clinic.

One of the things that the above article does not mention, and Rachel Maddow does, (at about 5:30 in the video) is that, in addition to banning abortion clinics, the new regulations allow Kansas authorities do have access to people’s medical records without a warrant.

So they take the records, and they will use those records to harass the patients.

We really need to understand that those who would criminalize abortion folks with a minor political difference whose feelings we should try to accommodate.

These are people who offer open and enthusiastic support to assassination and other forms of terrorism, and if we are to use material support statutes against Islamists, we should use them against them as well.

What a Pathetic Excuse for an Advocacy Group

I was watching Maddow, and she had Terry O’Neill, the President of NOW on to discuss the spate of anti-abortion laws coming out of the wingnut legislatures, and O’Neill basically said that she would not challenge these laws, despite their being illegal under existing precedent, because they are afraid that the currents supreme court will simply overrule Roe V. Wade.

So, because victory is not certain, she, and her organization, will win a court challenge, they have decided not to fight for abortion rights at all.

Conceding defeat is not an alternative to losing.  If you never contest the issue, you lose.

In conceding the battle in this way, not only do you allow states to criminalize abortions, but you prevent any meaningful political dialogue from anyone but the women hating nut jobs.

They are conceding defeat in the face of a possible defeat, and anyone who sends them money is an idiot.

The man who pursued William Jefferson Clinton’s penis from Arkansas to the District of Columbia, Richard Mellon Scaife, has lambasted Republicans on their attempts to completely defund family planning:

The Republican-led U.S. House of Representatives — urged on by conservatives opposed to abortion — has voted to defund Planned Parenthood. On this issue, Republicans and conservatives are dead wrong.

My grandmother was a friend and a supporter of Margaret Sanger, one of America’s earliest, most effective advocates of birth control.

I met Sanger several times before her death in 1966 and was impressed by her intellect and her commitment to many issues, not the least of which was enabling every woman to be “the absolute mistress of her own body,” as she put it.

I didn’t agree with everything the formidable Mrs. Sanger espoused. Yet I respected her dedication to making health-care and birth-control services available to all Americans, especially to those with low incomes, no insurance and no other recourse to medical services.

When you have gotten too combative for rabid right wing Pit Bull for Dick Scaife, you have seriously gone off the rails.

The Obama administration has finally repealed the Bush Administration’s “Conscience Rule,” which allowed healthcare providers to refuse to provide service on moral grounds:

The decision guts one of President George W. Bush’s most controversial legacies: a rule that was widely interpreted as shielding workers who refuse to participate in a range of medical services, such as providing birth control pills, caring for gay men with AIDS and performing in-vitro fertilization for lesbians or single women.

Friday’s move was seen as an important step in countering that trend, which in recent years had led pharmacists to refuse to fill prescriptions for the emergency contraceptive Plan B, doctors in California to reject a lesbian’s request for infertility treatment, and an ambulance driver in Chicago to turn away a woman who needed transportation for an abortion.

Bush implemented this toward the end of his term, and it took Obama 2 years to repeal it?

Well, it appears that they wanted to split the difference yet again:

Soon after Obama assumed office, administration officials said they agreed the regulation was too broad and announced plans to rescind it. But officials indicated that instead of simply invalidating the rule, they would seek to replace it with a compromise. The announcement triggered more than 300,000 comments, which officials have spent months reviewing. The Federal Register notice announcing the decision cites concerns raised by both sides in the comments but concludes that most of the provisions were unnecessary and potentially problematic.

The rule will retain a provision that empowers the HHS Office of Civil Rights to investigate any complaints by workers who believe their rights under existing federal law were being violated. The office is currently investigating a complaint from a nurse who claims she was forced to perform an abortion in New York.

I think that crap like this comes from the top, and I think that Barack Obama is personally opposed to a woman’s right to choose, but finds the politics unavoidable, so feet are dragged, until the absolute minimum is begrudgingly done.

Very weak tea, and the absolute minimum that Obama could do without engendering a backlash from the base.

Republicans in South Dakata are pushing a law to legalize the murder of abortion providers:

A law under consideration in South Dakota would expand the definition of “justifiable homicide” to include killings that are intended to prevent harm to a fetus—a move that could make it legal to kill doctors who perform abortions. The Republican-backed legislation, House Bill 1171, has passed out of committee on a nine-to-three party-line vote, and is expected to face a floor vote in the state’s GOP-dominated House of Representatives soon.

Jeebus.

I don’t mean to state the obvious, but it’s pretty clear that there no middle ground here to negotiate. You would sooner get meaningful consensus from Osama bin Laden.

EU Court Rules that Irish Abortion Law Violates Human Rights Standards

I would argue that this is a another example of how Ireland is a 3rd world nation masquerading as a modern one by virtue of geography, but that critique would apply to the US as well:

Ireland’s constitutional ban on abortion violates the rights of pregnant women to receive proper medical care in life-threatening cases, the European Court of Human Rights ruled Thursday in a judgment that harshly criticized Ireland’s long inaction on the issue.

The judgment from the Strasbourg, France-based court will put Ireland under pressure to draft a law extending limited abortion rights to women whose pregnancies represent a potentially fatal threat to their own health.

A right to receive proper medical care?

Well, that doesn’t exist here either.

Stem Cell Funding Injunction Rescinded

I’m kind of surprised that the court did not tell Judge Lamberth to stop smoking pot.

But they have now permanently lifted the injunction against funding the research:

An appeals court has permanently lifted an injunction imposed by a federal judge, thereby allowing federally funded embryonic stem-cell research to continue while the Obama administration appeals the judge’s original ruling against use of public funds in such research.

Considering the Obama administration’s generally weak support for reproductive rights, I would have figured that they would have slow walked this, but I was wrong.

Well, Obama Mans Up On Somethng

I have always felt that Obama has been profoundly ambivalent on the matter of abortion rights, so I figured that their response to a judge’s injunction against funding embryonic stem cell research would be to wring their hands, bleat a bit, and suggest that “Congress” do something.

I appear to have been too cynical, because the DoJ has announced that it will appeal this ruling:

The Obama administration said Tuesday that it would appeal a court ruling challenging the legality of President Obama’s rules governing human embryonic stem cell research, as the head of the National Institutes of Health said the decision would most likely force the cancellation of dozens of experiments in diseases ranging from diabetes to Parkinson’s.

I am truly shocked. My sense was that Obama would go the way he tried to on “Don’t Ask Don’t Tell”, and punt to Congress.

Court Injunction Against Federal Embryonic Stem Cell Research

This seems to be a rather strange ruling to me.

Federal Judge Royce Lamberth ruled that the plaintiffs had standing because someone else might get grants if studies using embryonic stem cells could get funding, which seems top be a big of a whiskey tango foxtrot moment to me.

The Dickey-Wicker amendment prohibits the NIH from funding the destruction of embryos, and not all research post this act, which makes appear to me that this ruling is rather a bit of overreach by the judge as well.

I Hate to Wake Up Sober in Nebraska*

I must have missed the story earlier, but a Federal Judge has stayed a Nebraska law that requires a psychological evaluation before getting an abortion:

A new law that requires all women to be prescreened for possible mental issues prior to obtaining an abortion has been blocked by U.S. District Court Judge Laurie Smith Camp. The law, which was scheduled to go into effect on July 15th, was challenged by Planned Parenthood of the Heartland, who argued that the law was so vague that it would be impossible to correctly adhere to it.

As I’ve said before, notwithstanding the fact that abortion first emerged as a proxy issue about race and segregated private academies, this issue has taken a life on of its own, and we are beyond any compromise on this issue.

There is No Room for Compromise on Abortion

The same folks who bought you the draconian restrictions on abortion in Barack Obama’s healthcare bill are now lobbying to ban federal coverage for all forms of birth control.

Let’s be clear here, this is not about meaningful policy. They just want to punish women for having sex:

Polls suggest the majority of Americans would support such a policy. But the Daily Beast has learned that many conservative activists, who spent most of their energies during the health-care reform fight battling to win abortion restrictions and abstinence-education funding, are just waking up to the possibility that the new health care law could require employers and insurance companies to offer contraceptives, along with other commonly prescribed medications, without charging any co-pay. Now the Heritage Foundation and the National Abstinence Education Association say that, like the U.S. Conference of Catholic Bishops, they oppose implementation of the new provisions.

This why there is no meaningful space for discussion for these people.

They use terrorism against doctors, they are working to make birth control unavailable at pharmacies, and now they are trying to exclude birth control from prescription coverage.

Enough is enough. These people are not the opposition, they are the enemy.

Terrorist Gets Life in Prison

Scott Roeder has been sentenced to life in prison for the assassination of doctor George Tiller:

Scott Roeder, the antiabortion extremist who murdered George Tiller, one of a handful of American physicians who performed late-term abortions, was sentenced to life in prison in a Wichita, Kan., courtroom Thursday and will not be eligible for parole for more than 50 years.

Here is hoping that he has a truly awful time in prison.

He will be 102 before he is eligible for parole.

Nuck Fow and Nuck FARAL

Executives at NARAL and Now have said that they are incensed over the Obama executive order restricting abortion:

The president of the National Organization for Women said her group is “incensed” about the impasse-breaking deal between President Obama and a group of anti-abortion Catholic Democrats that seems likely to allow historic health-care reform legislation to pass the House later Sunday night, saying the planned presidential executive order “breaks faith with women.”

NARAL Pro-Choice America shared NOW’s objections. “On a day when Americans are expected to see passage of legislation that will make health care more affordable for more than 30 million citizens, it is deeply disappointing that Bart Stupak and other anti-choice politicians would demand the restatement of the Hyde amendment, a discriminatory law that blocks low-income women from receiving full reproductive-health care,” NARAL President Nancy Keenan said in a statement.

You know, it was clear during the primaries that Barack Obama’s commitment to reproductive rights was tepid at best based on his record in the Illinois State Senate, and senior executives at Planned Parenthood, NARAL, and NOW ignored this, and never pressed him on his record.

Of course, once he was the nominee, tepid and ineffectual support was better than that reproductive rights horror-show that is the Republican party.

That being said, being thrown under the bus was predictable, and whining now is just lame.

Are There Republican Moles in the Lay-Staff of the US Conference of Catholic Bishops?

I was listening to NPR this morning, and they were talking about the position of the US Conference of Catholic Bishops regarding healthcare reform and abortion.

Any time that anyone talks about their position, this morning, it was a law professor, the consensus is that the position of the Bishops is coming from somewhere in the Twilight Zone: There is simply no basis in realities of law, precedent, legislation, or the manner in which regulation is derived from statute to suggest the Senate language will allow for federal funding of abortion.

This raises an obvious question: Why does the professional staff of the Conference hold a position at such extreme odds with every lawyer, and almost every other Catholic organization out there, most recently the Catholic Health Association and 59,000 nuns?

The only answer that I can come up with is that the professional staff working in their offices have been captured by partisan Republican operatives.

Either there are Republican operatives working and generating legal and legislative opinions, or the staff has been browbeaten by the loud right wing lay activists, most notably Bill Donohue and his Catholic League, and so the staff is taking its talking points from Republican operatives.

In either case, it is clear that the staff is NOT providing competent or good faith advice.

Perhaps a look at the senior lay staff at the organization, and their backgrounds might be warranted by some news gathering organization. (I sent an earlier version of my theory to Josh Marshall, if you know of any other investigative organizations, please forward this to them.)

Note that I am not suggesting that the Bishops themselves are operating as partisan political operatives, simply that their staff may be operating as such.

The state lege has just passed a bill which provides criminal penalties for miscarriages:

A bill passed by the Utah House and Senate this week and waiting for the governor’s signature, will make it a crime for a woman to have a miscarriage, and make induced abortion a crime in some instances.

The bill passed by legislators amends Utah’s criminal statute to allow the state to charge a woman with criminal homicide for inducing a miscarriage or obtaining an illegal abortion. The basis for the law was a recent case in which a 17-year-old girl, who was seven months pregnant, paid a man $150 to beat her in an attempt to cause a miscarriage. Although the girl gave birth to a baby later given up for adoption, she was initially charged with attempted murder. However the charges were dropped because, at the time, under Utah state law a woman could not be prosecuted for attempting to arrange an abortion, lawful or unlawful.

The bill passed by the Utah legislature would change that. While the bill does not affect legally obtained abortions, it criminalizes any actions taken by women to induce a miscarriage or abortion outside of a doctor’s care, with penalties including up to life in prison.

“What is really radical and different about this statute is that all of the other states’ feticide laws are directed to third party attackers,” Paltrow explained. “[Other states’ feticide laws] were passed in response to a pregnant woman who has been beaten up by a husband or boyfriend. Utah’s law is directed to the woman herself and that’s what makes it different and dangerous.”

In addition to criminalizing an intentional attempt to induce a miscarriage or abortion, the bill also creates a standard that could make women legally responsible for miscarriages caused by “reckless” behavior.

Using the legal standard of “reckless behavior” all a district attorney needs to show is that a woman behaved in a manner that is thought to cause miscarriage, even if she didn’t intend to lose the pregnancy. Drink too much alcohol and have a miscarriage? Under the new law such actions could be cause for prosecution.

If the politicians of Utah hate women this much, maybe they should stop breeding.

Have I Mentioned that I Love Alan Grayson*

He lays into Pat Robertson’s comment on Haiti and the devil, and further notes that the religious right, and particularly Pat Robertson’s supporters have achieved none of their goals, specifically a constitutional amendment against gay marriage, and a ban of abortion, and he asks, “What about your own pact with the Devil? How’s that worked out for you?” (3:07)

I don’t think that everyone should be like Alan Grayson, but I think that it’s essential that the Democrats have a few of these sorts of firebrands to describe the wrong that the Republicans do in stark and moralistic terms.

*In a 110% purely heterosexual kind of way, of course, as the General would say.
