Tease

People are crowing about the arrest of Trump Organization CFO Allen Weisselberg for tax fraud.

A lot of people think that this is the beginning of the end for Trump, but that it just wishful thinking.  It is not even the end of the beginning.

I’ve seen this scenario too many times before.  The bad guys walk:

New York prosecutors on Thursday unveiled a 15-count indictment charging the Trump Organization and its finance chief, Allen Weisselberg, with a wide-ranging conspiracy to avoid paying taxes, launching the first criminal case resulting from a multiyear investigation into former President Donald Trump’s business affairs.

In a Manhattan courtroom, prosecutors described a 15-year-long tax-fraud scheme involving off-the-books payments to employees at the Trump Organization. Executives took perks such as car leases and Manhattan apartments without the company or the recipient paying taxes, prosecutors said.

“There’s no clearer example of a company that should be held to account,” said prosecutor Carey Dunne in court. “It’s not about politics.” He said the investigation was ongoing.

Mr. Weisselberg, appearing in handcuffs, pleaded not guilty. He was released pending trial, though he was required to surrender his passport after prosecutors said he was a flight risk. His lawyers said he would fight the charges.

The top charge for Mr. Weisselberg—grand larceny in the second degree—is a felony that, upon conviction, carries a maximum sentence of 15 years in prison. Mr. Weisselberg was charged with 15 counts. In addition to grand larceny, prosecutors charged him with scheme to defraud, conspiracy, four counts of criminal tax fraud and other crimes.

The Trump Organization, through its attorneys, also pleaded not guilty. The company was charged with 10 counts, including scheme to defraud, conspiracy and four counts of criminal tax fraud.

The charges could ratchet up the pressure on Mr. Weisselberg to turn on Mr. Trump, who wasn’t charged Thursday. Mr. Weisselberg has so far declined to cooperate, but some defendants change course when faced with the possibility of prison time, former prosecutors said.

He’s not going to flip.

Prosecutors would need to show three things to charge Mr. Trump: knowledge, intent and participation, said Daniel Horwitz, chairman of the white-collar defense and investigation practice at McLaughlin & Stern.

And they will not get that if Weisselberg does not flip.

A case solely focused on fringe benefits is unusual, former prosecutors said. Charging an individual or company for failure to pay taxes on employee benefits alone is rare, though such charges are used as part of larger cases.

Which is one reason why I think that we will not see anything reaching Trump.  The case, at least until the DA adds charges, is not going to put Trump in jail.

In a possible bid to escalate pressure on Mr. Weisselberg and other executives to cooperate, the indictment mentions—though doesn’t name—Mr. Weisselberg’s son, who paid $1,000 a month on one Trump Organization-owned apartment for seven years and then paid no rent on another Trump-owned apartment in 2018. The rental payments weren’t reported as income to tax authorities, prosecutors said. The Wall Street Journal has reported that his son, Barry Weisselberg, lived in Trump-owned apartments. A lawyer for Barry Weisselberg didn’t respond to a request for comment

This case is not a nothing-burger, but the chance that it will place Donald Trump appear to be quite small, though it does appear to be a threat to the Trump organization, as it is likely to make lenders skittish about extending additional credit.

It appears that Donald Trump shut down his blog, because not enough people were clicking in to his musings.

Former president Donald Trump’s blog, celebrated by advisers as a “beacon of freedom” that would keep him relevant in an online world he once dominated, is dead. It was 29 days old.

Upset by reports from The Washington Post and other outlets highlighting its measly readership and concerns that it could detract from a social media platform he wants to launch later this year, Trump ordered his team Tuesday to put the blog out of its misery, advisers said.

On its last day, the site received just 1,500 shares or comments on Facebook and Twitter — a staggering drop for someone whose every tweet once garnered hundreds of thousands of reactions.

It should surprise no one that delicate snow-flake Donald Trump threw a tantrum about not being treated like a king.

Manhattan DA District Attorney Cyrus R. Vance Jr. has convened a criminal grand jury to investigate the Trump Organization.

I am not going to get my hopes up, if prominent Republicans went to jail for crimes, Karl Rove would be sharing a cell with Dick Cheney:

Manhattan’s district attorney has convened the grand jury that is expected to decide whether to indict former president Donald Trump, other executives at his company or the business itself, should prosecutors present the panel with criminal charges, according to two people familiar with the development.

The move indicates that District Attorney Cyrus R. Vance Jr.’s investigation of the former president and his business has reached an advanced stage after more than two years. It suggests, too, that Vance thinks he has found evidence of a crime — if not by Trump, by someone potentially close to him or by his company.

I so want to see Trump in the dock.

The FBI just raided Rudolph Giuliani’s apartment in connection with his unregistered lobbying for the Ukraine.

Federal investigators on Wednesday seized cellphones and computers from Rudolph W. Giuliani, the former mayor of New York City who became President Donald J. Trump’s personal lawyer, stepping up a criminal investigation into Mr. Giuliani’s dealings in Ukraine, three people with knowledge of the investigation said.

F.B.I. agents executed search warrants around 6 a.m. at Mr. Giuliani’s apartment on Madison Avenue and his Park Avenue office in Manhattan, carting away the electronic devices, Mr. Giuliani confirmed in a statement.

The execution of search warrants is an extraordinary action for prosecutors to take against a lawyer, let alone a lawyer for a former president. The move marked a major development in the long-running investigation into Mr. Giuliani, which examines some of the same people and conduct that were at the center of Mr. Trump’s first impeachment trial.

The investigative actions on Wednesday were expansive, with agents also serving a grand jury subpoena on Mr. Giuliani’s executive assistant, two people with knowledge of the matter said.

One of the warrants for Mr. Giuliani’s devices indicated that the federal investigators were searching for communications between him and several Ukrainian officials, including the former president, Petro Poroshenko, and two former prosecutors who had helped Mr. Giuliani collect information about the Bidens in Ukraine, one of the people said.

F.B.I. agents also executed a search warrant on Wednesday morning at the Washington-area home of Victoria Toensing, a lawyer close to Mr. Giuliani who had dealings with several Ukrainians involved in the hunt for information on the Bidens, according to people with knowledge of that warrant. The warrant was for her cellphone.

The federal authorities have largely focused on whether Mr. Giuliani illegally lobbied the Trump administration in 2019 on behalf of Ukrainian officials and oligarchs, who were helping Mr. Giuliani’s dirt-digging campaign. At the time, Mr. Biden was a leading contender for the Democratic presidential nomination.

The United States attorney’s office in Manhattan and the F.B.I. had sought for months to secure Justice Department approval to request search warrants for Mr. Giuliani’s phones and electronic devices.

And William Barr almost certainly corruptly intervened to quash those subpoenas while he was still Attorney General

Even more than Giuliani, Barr needs to face consequences for his actions, because the Attorney General of the United States of America needs to meet a higher standard.

The culture of impunity in Washington, DC needs to end.

 

The Grift is Strong in These Ones

It turns out that the Trump family tradition of exploiting charities for personal gains even extends to rescue dogs. 

In this case, it’s Eric’s wife Lara, who has diverted millions of dollars to the Trump organization from Big Dog Ranch Rewsuc Rescue.

It’s pretty cold to steal from rescue dogs.

On the bright side, it probably means that her campaign for US Senate is dead before it even started:

A dog rescue charity that has links to Lara Trump, the former president’s daughter-in-law, has spent almost $2m at Trump properties in the last seven years, according to US media reports.

While other companies and groups have distanced themselves from the Trumps since the 6 January attack on the capital, the Florida-based Big Dog Ranch Rescue is expected to spend another $225,000 at Donald Trump’s Mar-a-Lago country club for an event this weekend, according to a permit filed with the town of Palm Beach, which was reported by HuffPost.

HuffPost reported that Internal Revenue Service (IRS) filings show that the charity has spent as much as $1,883,160 on fundraising costs for events at Mar-a-Lago and a nearby Trump golf course since 2014. Lara Trump, who is married to Eric Trump, has been a chairwoman for charity events since 2018.

Donald Trump’s Trump Foundation, which was dissolved in 2019, and Eric Trump’s Eric Trump Foundation are known to have used money from donors for events and other expenses at Trump properties. Donald Trump admitted in court documents that he used charity money to buy a portrait of himself.

They really are a repulsive lot, aren’t they?

Actuall, I can put my finger on it, I made a similar observation some years back when a group of Christofascists decided to lay hands on the Wall Street Bull in an attempt to drive the “Devil” out of the financial markets.

Spoiler: It did not work.

I am not one to call for divine intervention, I feel that the problems of this world are created humans, and must be solved by them, but maybe they should have a word with Korach, face to face.

Without comment, the Supreme Court has rejected Donald Trump’s bid to conceal his tax returns from the Manhattan prosecutor:

The Supreme Court on Monday rejected former president Donald Trump’s last-chance effort to keep his private financial records from the Manhattan district attorney, ending a long and drawn-out legal battle.

After a four-month delay, the court denied Trump’s motion in a one-sentence order with no recorded dissents.

District Attorney Cyrus R. Vance Jr. has won every stage of the legal fight — including the first round at the Supreme Court — but has yet to receive the records he says are necessary for a grand jury investigation into whether the president’s companies violated state law.

Vance responded to the court decision with a three-word tweet: “The work continues.”

Vance’s inquiry is one of two known criminal investigations involving the former president. The other, led by the district attorney in Fulton County, Georgia, focuses on Trump’s controversial coversations with state officials amid his failed effort to overturn that state’s election result.

Trump has waged an extraordinary battle to keep private his tax records, which every other modern president has released as an expected part of seeking the presidency. The court’s action does not mean Trump’s tax records are to become public — Vance has said they will be protected by grand jury secrecy rules — but is likely to accelerate an investigation that might be Trump’s biggest legal threat.

Forensic accounting experts from FTI Consulting are expected to assist prosecutors in assessing whether the Trump Organization manipulated property values for tax breaks, or to obtain favorable loan rates, The Washington Post previously reported.

The investigation is fairly developed, but the tax returns are an integral part of the picture. The Supreme Court order — allowing Vance to execute the subpoena — could mean a lot of work is ahead for investigators as the records are voluminous, spanning eight years.

The current fight is a follow-up to a July decision by the high court that the president is not immune from a criminal investigation while he holds office.

Vance is seeking eight years of the former president’s tax returns and related documents as part of what was initially an investigation into alleged hush-money payments made ahead of the 2016 election to two women who said they had affairs with Trump years before — claims Trump denies. Investigators have indicated they want to determine whether efforts were made to conceal the payments on tax documents by labeling them as legal expenses.

I’m expecting the investigations to reveal that Trump is basically broke, despite the millions that he managed to extract from the government and government supplicants.

I will love to see him broken like a yearling horse, and I know that he’s going to whine about conspiracies, but, “That’s what I thought you’d say, you dumb f%$#ing horse.*

Yeah, This Might Work Better Than a Congressional Commission

The N.A.A.C.P. and Representative Representative Bennie Thompson (D-MS) are suing Donald Trump and Rudolph Giuliani under the Ku Klux Klan Act of 1871.

This might get some action, and it will definitely have the defendants compelled to testify under oath about what they knew, when they knew it, and what they did:

The N.A.A.C.P. on Tuesday morning filed a federal lawsuit against former President Donald J. Trump and his personal lawyer Rudolph W. Giuliani, claiming that they violated a 19th century statute when they tried to prevent the certification of the election on Jan. 6.

The civil rights organization brought the suit on behalf of Representative Bennie Thompson, Democrat of Mississippi. Other Democrats in Congress — including Representatives Hank Johnson of Georgia and Bonnie Watson Coleman of New Jersey — are expected to join as plaintiffs in the coming weeks, according to the N.A.A.C.P.

The lawsuit contends that Mr. Trump and Mr. Giuliani violated the Ku Klux Klan Act, an 1871 statute that includes protections against violent conspiracies that interfered with Congress’s constitutional duties; the suit also names the Proud Boys, the far-right nationalist group, and the Oath Keepers militia group. The legal action accuses Mr. Trump, Mr. Giuliani and the two groups of conspiring to incite a violent riot at the Capitol, with the goal of preventing Congress from certifying the election.

Mr. Thompson is seeking compensatory and punitive damages in the lawsuit filed in Federal District Court in Washington. The suit does not include a specific financial amount.

Mr. Thompson, 72, claims he was put at an increased health risk by later being required to shelter in place in a cramped area that did not allow for social distancing. The lawsuit notes that Mr. Thompson shared confined space with two members of Congress who tested positive for the coronavirus shortly after the attack at the Capitol.

Derrick Johnson, president of the N.A.A.C.P., said the decision to seek compensatory and punitive damages was rooted in a history of tools that have worked to fight back against white supremacy.

“The Southern Poverty Law Center filed a lawsuit against the Ku Klux Klan that bankrupted a chapter,” he said, referring to a 2008 judgment against a Kentucky-based Klan outfit that ordered the group to pay $2.5 million in damages. “This is very similar. If we do nothing, we can be ensured these groups will continue to spread and grow in their boldness. We must curb the spread of white supremacy.”

The short version of the 1871 Klu Klux Klan act is that an individual can be held liable both criminally and civilly for depriving a citizen of their Constitutional rights.

Preventing a member of Congress from approving the Electoral Vote count seems to be messing with the Constitution.

I am Both Horrified and Impressed

When Donald Trump said that he would make Mexico pay for a border wall between the two countries.

I figure that he was engaging in classical Trump bullsh%$, but he has now said how this. Specifically, he has said that will hold remittances to Mexico hostage to get concessions:

New Delhi, Beijing, Manila and Paris may want to sit up and take notice. Republican Presidential candidate Donald Trump plans to make Mexico pay for the wall:he intends to build on the United States’ southern border by cutting off remittances – transfer of money by a foreign worker to his home country – till it coughs up the lolly.

This unprecedented threat – detailed in a two-page memo Donald Trump+ has drawn up – could decimate the Mexican economy, which receives around $24 billion annually in remittances, and is the fifth largest remittance-receiving country in the world. The top four (for whom this should serve as a warning about the methods Trump would consider to settle accounts): India ($ 72 billion in remittances in 2015), China ($ 64 billion), Philippines ($ 30 billion), and France ($25 billion).

The memo, with the subject line “Compelling Mexico to Pay for the Wall,” offers an insight into the kind of bare-knuckle tactics Trump will employ to offset what he sees as economic injustice against the United States, including withholding of visas and trade tariffs.

”Our approvals of hundreds of thousands of visas every year is one of our greatest leverage points,” Trump writes. ”We also have leverage through business and tourist visas for important people in the Mexican economy.”

These remittances would account for about 2½% of Mexican GDP, so it would have a significant impact on the economy, particularly in rural and poor.

Note that I find this course of action, particularly with regard to the secondary effects, money transfer to Mexico would almost certainly go underground, creating a new profit center for various gangs, to be ill advised, but Trump actually does have a plan to accomplish this.  (And that’s ignoring the rather dire human consequences of this policy.)

That being said, there is a certain perverse elegance in the plan.

I have mentioned that this election season has me wanting to live in a cave until it is all over.

It appears that Vladimir Putin has found the current election insanity unsettling as well:

We have the two must unelectable candidates engaging in truly awful campaigns.

No matter who wins, the American people lose.

The anarchist group INDECLINE decided that they need to show that the emperor had no clothes, with said emperor being Donald J. Trump.

To do this, they erected 5 naked sculptures of him all across the nation: (This is amusing, but not truly great snark)

For much of the past year, Donald Trump proved uniquely untouchable, a political force of such mind-boggling invulnerability that he even bragged about attracting voters after hypothetically shooting someone on Fifth Avenue.

Hoping to strip away the Teflon Don’s legendary confidence to reveal the fleshy mortal beneath the expensive suits and long ties, members of the anarchist collective INDECLINE decided they would showcase the aspirant president in the most humiliating way they could imagine: without his clothes.

The group unveiled life-size statues of Trump in the nude Thursday morning in public spaces in New York, San Francisco, Los Angeles, Cleveland and Seattle.

“The Emperor Has No B—s,” [Balls because WaPo is too chickensh%$ to say it] as the project is called, arrives several months after the group covered stars on the Hollywood Walk of Fame with the names of African Americans who have been killed by police. In the past, the collective has also claimed responsibility for an anti-Trump “Rape” mural on the U.S.-Mexico border and a massive piece of graffiti art in California’s Mojave Desert.

Yes, this is amusing, but it still isn’t great nark.

The great snark was from the New York City Parks Department, which promptly removed the statue, and a spokesman explained their reasoning as follows:

NYC Parks stands firmly against any unpermitted erection in city parks, no matter how small.

Billy West Should Get a Nobel Prize

The voice actor, known for Doug and Ren and Stimpy, as well as the voice of Fry, among others, in Fututama.

One of the voices that he did on the latter show was that of Zapp Branigan, the egotistical, incompetent, and misogynist ship commander who once had a fling with Turanga Leela, much to Leela’s chagrin.

At a press conference, Donald Trump just called for Russia to hack Hillary’s emails:

Donald Trump appeared to incite Russia to hack into and publish Hillary Clinton’s private emails, as her campaign sounded “alarm” at growing evidence of a foreign power “interfering in an American election”.

Trump, meanwhile, speaking at a press conference in Florida, raised the stakes again, as he urged Russia to hack into and release Clinton’s emails from the personal server she used while she was secretary of state.

“Russia, if you’re listening, I hope you’re able to find the 30,000 emails that are missing,” he said.

“I think you you will probably be rewarded mightily by our press. Let’s see if that happens. That will be next.”

The Republican nominee added: “They probably have her 33,000 emails that she lost and deleted … I hope they do … because you’d see some beauties there.”

Trump has since stated that he was being sarcastic, which is no surprise.

Over the past week, we’ve seen what can only be described as a campaign of Red baiting by the Clinton campaign (seriously, Whiskey Tango Foxtrot?), I would be inclined to be sarcastic as well:

Donald Trump says he was “being sarcastic” when he suggested Wednesday that Russia should find Hillary Clinton’s missing emails.

“Of course I’m being sarcastic. And they don’t even know frankly if it’s Russia,” Trump said in an interview with Fox News’ Brian Kilmeade set to air in full Thursday morning.

Even by the standards of the the crazy season that is a Presidential campaign, this season is completely batsh%$ insane.

Republican National Convention organizers are scrambling to replace signs labeling a bank of elevators the “white elevators.”

Byron Tau, a Wall Street Journal reporter who first spotted the signs, said RNC staffers were replacing them “for obvious reasons.”

It’s unclear who vetted the signs or why they were hung in the first place. Neither RNC organizers nor Trump’s campaign immediately responded to the Daily News’ request for further comment.

I understand how the Teabagger wing of Republican Party gave us Donald Trump.

I also understand how Trump has done the nearly impossible, which is to make what is arguably the least electable candidate for President since Michael Dukakis the front runner, which must seriously roast Teabagger chestnuts:

The rest of use are going to have to live with the consequences of this:  More war, more sucking up to Wall Street, more neoliberal economics, more privatization of essential government services, and more job destroying trade deals.
