A federal appeals court has determined that Texas’ redistricting plan had a deliberately discriminatory intent and effect:

Hispanic and black voters in Texas were vindicated on Tuesday when a federal three-judge panel rejected the state’s new redistricting plans for Congressional and state legislative seats. A panel of the United States District Court in the District of Columbia properly found that the maps, based on the 2010 census, had a discriminatory purpose and effect in reducing the ability of minority voters to elect candidates they favor.
The evidence of the discrimination was stark. Almost 90 percent of the 4.3 million growth in the state’s population in the last decade came from minority residents. That growth qualified Texas for four additional Congressional seats, and it required the state to create new voting districts. Yet instead of adding districts in which minority voters could elect candidates of their choice, the Republican-controlled Legislature drew the districts in a way that reduced the number represented by members of minority groups. About some districts, the panel said, the plans maintained “the semblance of Hispanic voting power,” but the mapmakers actually diluted it.
Texas is covered under Section 5 of the Voting Rights Act for its history of voting discrimination. It was in court because it had to get prior approval for any changes to its voting procedures from a federal court or the Justice Department — and it could receive permission only if it could prove that the changes would not have a discriminatory effect. The judges, sensibly, said no.

As the court’s majority opinion noted, no major surgery was performed by the lawmakers on the Congressional districts of white incumbents. But there was “unchallenged evidence” that in four minority districts, the Legislature performed surgery to cut out “economic engines” and harm the districts. In a couple of cases, the Republicans cut out the district offices of the members of Congress.

The former head of the Florida Republican party is now saying that the Republican voter ID law was specifically intended to suppress the black vote, and that this was explicitly discussed behind closed doors:

In the debate over new laws meant to curb voter fraud in places like Florida, Democrats always charge that Republicans are trying to suppress the vote of liberal voting blocs like blacks and young people, while Republicans just laugh at such ludicrous and offensive accusations. That is, every Republican except for Florida’s former Republican Party chairman Jim Greer, who, scorned by his party and in deep legal trouble, blew the lid off what he claims was a systemic effort to suppress the black vote. In a 630-page deposition recorded over two days in late May, Greer, who is on trial for corruption charges, unloaded a litany of charges against the “whack-a-do, right-wing crazies” in his party, including the effort to suppress the black vote.

In the deposition, released to the press yesterday, Greer mentioned a December 2009 meeting with party officials. “I was upset because the political consultants and staff were talking about voter suppression and keeping blacks from voting,” he said, according to the Tampa Bay Times. He also said party officials discussed how “minority outreach programs were not fit for the Republican Party,” according to the AP.

One hopes that his testimony is introduced in the suits that the DoJ is filing against Rick Scott and his merry band of racists.

This is the proverbial smoking gun.

You know, I’ve never been a fan of the zombie genre.

I’ve never sat through a whole zombie movie (though I do want to see the genre bender Shaun of the Dead), and I really don’t get the whole zombie walk thing.

However, the ziomnbie protest of Fred Phelps’ twisted bigoted family is a genius:

Counter-demonstrators dressed as zombies outnumbered protesters from the Westboro Baptist Church at a military base near DuPont, Washington over the weekend.

Melissa Neace, 27, launched a Facebook group to organize the zombies event after she learned that the radical ant-LGBT church would be picketing Joint Base Lewis-McChord near Seattle.

“We wanted to turn something negative around, into something people could laugh at and poke fun at,” Neace explained to The News Tribune. “It was the easiest way to divert attention from something so hateful.”

Over 200 people committed to attending the event on Saturday, which she called “Zombie’ing Westboro Baptist Church AWAY from Fort Lewis!”

Of course, this is completely unrealistic.

Zombies eat brains, and they’d starve if they had to depend on Westboro Baptist.

In the challenges to Arizona’s immigration law, one of the claims made is that it was motivated by bigotry.

Well, the plaintiffs now have sponsor’s, former state senate majority leader Russell Pearce’s, emails, and we have the smoking gun:

The American Civil Liberties Union of Arizona has released thousands of e-mails that it says proves Arizona’s controversial immigration law was racially motivated.

The e-mails, acquired through a public records request to the state Legislature, are to and from former senator Russell Pearce, who authored Senate Bill 1070.

The ACLU included dozens of those e-mails as part of a legal filing this week, asking U.S. District Court Judge Susan Bolton to prevent a key part of SB 1070 from going into effect.

The e-mails from Pearce in the court documents include statements like, “Can we maintain our social fabric as a nation with Spanish fighting English for dominance … It’s like importing leper colonies and hope we don’t catch leprosy. It’s like importing thousands of Islamic jihadists and hope they adapt to the American Dream.”

They include statistics such as “9,000 people killed every year by illegal aliens,” and “the illegal aliens in the United States have a crime rate that’s two-and-a-half times that of non-illegal aliens.”

Some quotes:

“Battles commence as Mexican nationalists struggle to infuse their men into American government and strengthen control over their strongholds. One look at Los Angeles with its Mexican-American mayor shows you Vincente Fox’s general Varigossa commanding an American city.”

“They create enclaves of separate groups that shall balkanize our nation into fractured nightmares of social unrest and poverty.”

I am not surprised at all that this guy is a bigoted ratf%$#, though I am surprised that he was stupid enough to reveal it on email.

Rep. Michele Bachmann’s former campaign manager has joined the bipartisan chorus criticizing the Minnesota Republican for questioning the loyalty of State Department aide Huma Abedin and alleging she has ties to the Muslim Brotherhood.

“I have been a practitioner of tough politics for many decades,” Ed Rollins wrote in an op-ed for FOX News. “There is little that amazes me and even less that shocks me. I have to say that Congresswoman Michele Bachmann’s outrageous and false charges against a top aide to Secretary of State Hillary Clinton, Huma Abedin reaches that threshold.

“Having worked for Congressman Bachman’s campaign for president, I am fully aware that she sometimes has difficulty with her facts, but this is downright vicious and reaches the late Senator Joe McCarthy level,” he wrote.

Generally, Republicans are busy saying that Joe McCarthy has been given an unfair rap by pinko historians, so this boggles the mind.

The real question is whether the Beltway gasbags  will start treating her like that crazy guy in a bath robe on the soapbox in the park.

Republican political adman Fred Davis, the man who created Carly Fiorina’s infamous “Demon Sheep” ad, is sad because he’s caught flak for the fact that he’s a contemptible human being:

He’s not a witch.

Nor, Fred Davis wants the world to know, is he a racist.

Humbled, humiliated, saddened and chagrined, the Republican ad maker recently sagged into a chair in a noisy Las Vegas restaurant and for more than an hour talked about May 17, a date that will forever be ringed in red as one of personal infamy.

That day the New York Times published on its front page details of a proposed Davis-run campaign against President Obama, focusing on the incendiary Rev. Jeremiah A. Wright Jr., the president’s former pastor, “in a big, attention-arresting way.”

The intent, a do-over of sorts, was to “inflame … questions” about Obama’s character and competence. A 54-page outline, leaked to the newspaper by someone apprehensive of the plan, was very much like Davis himself: jokey, irreverent and a bit out there.

Obama was described, and demeaned, as a “metrosexual black Abraham Lincoln.” Arizona Sen. John McCain, the 2008 Republican presidential nominee for whom Davis worked, was derided as “a crusty old politician who often seemed confused” and failed to exploit the target-rich opportunity presented by the venomous Wright.

Two of his commercials were among the most widely noticed of the 2010 campaign: the infamous “demon sheep” ad for California’s Carly Fiorina and his meet-the-candidate spot for Delaware’s Christine O’Donnell, with its indelible opening, “I’m not a witch.” Both U.S. Senate hopefuls lost their elections, though Fiorina made it through a combative primary and, hey, Davis made you look, didn’t he?

But when it comes to the proposed super PAC campaign, Davis insisted, it was never his intention to use race as an incitement. “I am maybe the only person in America who didn’t see that as racist,” he said of juxtaposing the president with the fiery rants of his longtime pastor, who Obama disavowed in the heat of the 2008 primary. “I saw it as an interesting fact in a guy’s upbringing and the way he’s formed his opinions.”

No, you’re not a racist, and you’re not an asshole, because your previous oeuvre has been so uniformly positive and nice.

Listen while I say this slowly: If you did not see that as racist, it is because you are not only racist, but because you are a stupid racist.

Why I’m Voting in November

Because the bigots in Maryland have turned in sufficient signatures to put a repeal of same sex marriage on the ballot:

Activists working to repeal Maryland’s same-sex marriage law have collected more than twice the signatures needed for a referendum — likely ensuring that the measure will be on the ballot for voters to decide in November.

The law’s opponents submitted 122,481 signatures in favor of a referendum; 55,736 are required. If enough are verified as legitimate, as expected, Maryland will be in the center of a national debate on same-sex marriage, with groups on both sides preparing to spend millions.

I’m still debating between writing in Stewart/Colbert or Colbert/Stewart, but I’m voting against the hate amendment.

Nope, No Racism Here

Justin Combs excelled at football, and got a 3.75 GPA, and so he got a $54K mertit and athletic scholarship to UCLA.

It appears that the good folks at CNN find this controversial, because it was Shawn “P-Diddy” Combs kid, (no direct link, they don’t deserve it) and they want him to give the money back.

There are plenty of kids who get scholarships whose parents are filthy rich, but they aren’t black, in a profession which is stereotypically black (rap), so there is no question if they should return their scholarships.

I believe that a two word phrase was in the head of whoever whoever mad this post (no name listed) on CNN.

The first word was probably “uppity”, and the second word probably began with the 14th letter in the English alphabet.

There have been some stories about Islamaphobes, but now we know that these whack jobs were calling for a genocide against Muslims:

The U.S. military taught its future leaders that a “total war” against the world’s 1.4 billion Muslims would be necessary to protect America from Islamic terrorists, according to documents obtained by Danger Room. Among the options considered for that conflict: using the lessons of “Hiroshima” to wipe out whole cities at once, targeting the “civilian population wherever necessary.”

The course, first reported by Danger Room last month and held at the Defense Department’s Joint Forces Staff College, has since been canceled by the Pentagon brass. It’s only now, however, that the details of the class have come to light. Danger Room received hundreds of pages of course material and reference documents from a source familiar with the contents of the class.

The chairman of the Joint Chiefs of Staff recently ordered the entire U.S. military to scour its training material to make sure it doesn’t contain similarly hateful material, a process that is still ongoing. But the officer who delivered the lectures, Army Lt. Col. Matthew A. Dooley, still maintains his position at the Norfolk, Virginia college, pending an investigation. The commanders, lieutenant colonels, captains and colonels who sat in Dooley’s classroom, listening to the inflammatory material week after week, have now moved into higher-level assignments throughout the U.S. military.

For the better part of the last decade, a small cabal of self-anointed counterterrorism experts has been working its way through the U.S. military, intelligence and law enforcement communities, trying to convince whoever it could that America’s real terrorist enemy wasn’t al-Qaida — but the Islamic faith itself. In his course, Dooley brought in these anti-Muslim demagogues as guest lecturers. And he took their argument to its final, ugly conclusion.

International laws protecting civilians in wartime are “no longer relevant,” Dooley continues. And that opens the possibility of applying “the historical precedents of Dresden, Tokyo, Hiroshima, Nagasaki” to Islam’s holiest cities, and bringing about “Mecca and Medina[‘s] destruction.”

Dooley’s ideological allies have repeatedly stated that “mainstream” Muslims are dangerous, because they’re “violent” by nature. Yet only a few of al-Qaida’s most twisted fanatics were ever caught musing about wiping out entire cities.

Let’s be clear here, this is not some guy ranting on a street corner, this is a lecturer at the Defense Department’s Joint Forces Staff College, and he called for genocide, and he still has a position there.

Of more concern is that these people are taken seriously.

It’s All About the Racism

I tend to see a lot more racism in American politics than most other white* people, and here we have a a case where it manifests as a primary motivation for anti gay bigotry:

Nance said he recorded a conversation with the woman, whose name is Jodie Brunstetter, on video, and that she confirmed that she used the term “Caucasian” in a discussion about the marriage amendment, but insisted that otherwise her comments had been taken out of context by other poll workers.

…Nance paraphrased the remarks, as told to him by those who were present: “During the conversation, Ms. Brunstetter said her husband was the architect of Amendment 1, and one of the reasons he wrote it was to protect the Caucasian race. She said Caucasians or whites created this country. We wrote the Constitution. This is about protecting the Constitution. There already is a law on the books against same-sex marriage, but this protects the Constitution from activist judges.”

Nance said he recruited a friend, who works for the Coalition to Protect All North Carolina Families, to witness his interview with Jodie Brunstetter. He said Brunstetter reluctantly acknowledged that she had used the term “Caucasian” and then repeated the statement previously attributed to her, but substituted the pronoun “we” for “Caucasian. Nance said Brunstetter insisted there was nothing racial about her remarks, but could not explain why she used the term “Caucasian.”

When you look at many of the motivations on many of the hot button issues of “social conservative”,† you find either racial animus or racial paranoia at its core.

First, we amp up gun regulations in order to take guns from the Black Panthers, and then the NRA goes insane because they want to have guns to protect themselves from black people.

It’s like 6 degrees of Kevin Bacon, only instead of Kevin Bacon, it’s racism.

So, Nicolas Sarkozy is going thoroughly right wing and anti-Muslim:

Nicolas Sarkozy has stepped up his appeal to France’s far-right by lauding national identity, borders and French Christian heritage at a vast open-air rally in the shadow of the Eiffel tower.

Sarkozy’s alternative May day Labour rally, which he initially said was a defiant celebration of “real” work versus the traditional trade union marches, had caused a political slanging match in France.

A Communist newspaper and various commentators likened the president to Marshal Pétain, the leader of France’s Nazi collaborationist Vichy regime in the 1940s, for trying to appropriate the “values of work” for the right. His party slammed the parallels as shameful and disgusting.

You have to understand: The French Republics (all of them) have had a tradition of militantly secular, as in, “If you get married in a church, it doesn’t count, do it again at the town hall.”

He doesn’t get why National Front Leader Marine Le Pen got so many votes.  While part of it is the fact that she puts a softer and more sophisticated edge on the right wing xenophobic message, the rest is because both Sarkozy and Hollande were perceived as being too EU friendly, and in particular, they are not fond of German hegemony in the EU.

Sorkozy does not get it:  He won’t get their votes in sufficient quality because he is Merkel’s toady, and Merkel’s frantic attempts to bolster his reelection efforts just makes it more obvious.

I write your organization to request that the Law Office of Bruce Godfrey be placed on the boycott list for corporate and business advocates for the recognition of lawful civil same-sex marriage. I would be most grateful for recognition of my small law office as an opponent of your cause in Maryland as you have recognized companies such as Starbucks. While Maryland attorney ethics rules place strict prohibitions on attorney solicitations of prospective clients for hire, no ethics rules prohibit an attorney from asking to join a boycott – as a target.

Bruce Godfrey has been a loud and notorious advocate of lawful civil same-sex marriage recognition in his home state of Maryland for many years. His unapologetic advocacy of equal protection principles and of the equal rights amendment of the Maryland Declaration of Rights advocacy has cost him friendships and business relationships. Once again, the stupidest journalist in America, Juan Williams is doing what he is bought and paid for, being a tool who alibis for racism, and is claiming, in response to the Trayvon Martin killing, that the black community is ignoring black on black violence.

Ta-Nehisi Coates notes that if Williams knew how to use the Google, he would have found multiple mass actions against violence within the community.

I’m not surprised that Juan Williams did not mention these folks. After all, he’s probably afraid to go into those neighborhoods.

Well Here’s Some Interesting Information

In the matter of the killing of Trayvon Martin by George Zimmerman, we have a new development.

It appears that the detective originaly assigned to the case wanted to arrest him for manslaughter:

The lead homicide investigator in the shooting of unarmed teenager Trayvon Martin recommended that neighborhood watch captain George Zimmerman be charged with manslaughter the night of the shooting, multiple sources told ABC News.

But Sanford, Fla., Investigator Chris Serino was instructed to not press charges against Zimmerman because the state attorney’s office headed by Norman Wolfinger determined there wasn’t enough evidence to lead to a conviction, the sources told ABC News.

Police brought Zimmerman into the station for questioning for a few hours on the night of the shooting, said Zimmerman’s attorney, despite his request for medical attention first. Ultimately they had to accept Zimmerman’s claim of self defense. He was never charged with a crime.

Serino filed an affidavit on Feb. 26, the night that Martin was shot and killed by Zimmerman, that stated he was unconvinced Zimmerman’s version of events.

The fact that Zimmerman’s dad is a retired judge makes this decision even more suspect.

Then there is the fact that Martin’s body remained listed as a John Doe in the coroner’s office for 3 days, while repeated calls to his cell phone went unanswered. (Maybe that would have allowed them to identify the body)

Whatever else happened, given the Sandford, Florida PD’s long and notorious record of corruption and racism, it’s tough to conclude that their handling of the case was racially tinged.

BTW, Lawrence O’Donnell was going to interview Zimmerman’s lawyer, but when he realized that it wasn’t going to be softball questions he fled the studio.

O’Donnell then asked the questions of the empty chair, and they were very basic questions:

  • Who is paying you? Who hired You? When, exactly, did they hire you?
  • Does George Zimmerman have a job? Does he have any property? Does he own anything?
  • Did you represent him when he was arrested for assault on a police officer in 2005? Did you represent him in a domestic violence case in 2007 when his girlfriend accused him of assault?
  • You said Zimmerman got a broken nose, can you show us photos of him that night with the broken nose, or even the next day?
  • You said Zimmerman’s clothes had grass stains and other evidentiary material … do you have that garment, can you show us what happened to it?”

These are not unexpectedly hard hitting question.  Certainly they are a bit hostile, but if you are doing the media rounds as his lawyer (to my mind always a bad decision) you have to be able to answer these questions.

One of the interesting things here is just how hard the right is trying to smear this teenager.

It’s an article of faith among them that there is no longer any racism in the United States, and the obvious racism here kind of gets in the way of that.

The good folks at Westover “G-d Hates F*gs” Baptist are now looking to support Rush Limbaugh by purchasing ads on his show:

There’s something so deliciously ironic, so perfectly just in this. The Southern Poverty Law Center reports that Rush Limbaugh has a new sponsor anxious to buy up lots of ad space on his show: Westboro Baptist Church. Is there anything more delicious than the idea of the haters advertising on the hater’s show?

Premiere Networks has released a statement saying they will not accept any ads from the group. Who knew they had standards of what Limbaugh maligns as “political correctness.”

I don’t understand why they won’t take the ads, it’s a match made in heathen heaven.

Broken Window Theory of Financial Crimes

Bill Black has a very interesting look at the “Broken Window” theory of law enforcement and how, and whether, it might be applied to financial wrongdoing.

For those of who are unfamiliar with the “Broken Window” theory of law enforcement:

James Q. Wilson was a political scientist who often studied the government response to blue collar crime. The public knows him best for his theory called “broken windows.” The metaphor was what happens to a vacant building when broken windows are not promptly repaired. Soon, most of the windows in the abandoned building are broken. The criminals feel little compunction against petty destruction because the building’s owners evince no concern for the integrity of their building. Wilson took social norms, community, and ethics seriously. He argued that as community broke down fewer honest citizens were active in monitoring and policing behavior. The breakdown in community was criminogenic – it led to widespread serious blue collar crime. He urged us to take even minor blue collar crimes and breaches of civility seriously and to demand that they be contained through social pressure and policing.

Wilson got a lot of credit for cleaning up New York City, where crime levels did drop, but they did elsewhere, so perhaps the theory is a bit overrated.

And it should be noted that Mr. Wilson specifically excluded white collar crimes.

I think that the operative word here is “white”.

As in pigmentation, and Wilson found “white crime” just fine:

In a book entitled, Thinking About Crime, Wilson argued that criminology should focus overwhelmingly on low-status blue collar criminals.

This book [does not deal] with “white collar crimes”…. Partly this reflects the limits of my own knowledge, but it also reflects my conviction, which I believe is the conviction of most citizens, that predatory street crime is a far more serious matter than consumer fraud [or] antitrust violations … because predatory crime … makes difficult or impossible maintenance of meaningful human communities (1975: xx).

I am rather tolerant of some forms of civic corruption (if a good mayor can stay in office and govern effectively only by making a few deals with highway contractors and insurance agents, I do not get overly alarmed)…. (1975: xix).

Wilson won’t say it, and cannot now, because he’s dead, and may not admit it to himself, but he’s tolerant of white collar, because “Broken Window” enforcement should only be used when it involves cops harassing poor people and/or minorities.

That’s why Wilson created a “get out of jail free” for the crimes of the upper class.

I’m inclined to believe that small crimes beget bigger crimes, and that this problem is worse among the privileged than it is among the poor and minorities.

As Prof. Black illustrates in his article, when the little things are let slide, you end up with things like liars loans, and blacklists of honest home appraisers, with executives engaging in wholesale looting of their own firms.

OK, Rubio Won’t be the VP Pick

I had thought that he was the likely pick, as his selection would serve to mend some bridges with the Hispanic community, but, if Mitt Romney is the nominee, he won’t select Rubio, because he is sort of a Mormon:

In the compelling personal narrative that has helped propel Florida Senator Marco Rubio to national political stardom, one chapter has gone completely untold: Rubio spent his childhood as a faithful Mormon.

Rubio was baptized into the Church of Jesus Christ of Latter-day Saints with his family at around the age of eight, and remained active in the faith for a number of years during his early youth, family members told BuzzFeed.

Rubio spokesman Alex Conant confirmed the story to BuzzFeed, and said Rubio returned to the Catholic church a few years later with his family, receiving his first communion on Christmas day in 1984 at the age of 13.

The revelation adds a new dimension to Rubio’s already-nuanced religious history—and could complicate his political future at a time when many Republicans see him as the odds-on favorite for the 2012 vice presidential nod. Vice presidential candidates are traditionally chosen to provide ethnic and religious balance to a ticket. Mitt Romney’s Mormonism and Rubio’s Catholic faith would already mean the first two members of minority traditions on a Republican ticket in American history. Rubio’s Mormon roots could further complicate that calculation.

Yes, having a Mormon on the ticket should not be an issue in this day and age, but having 1½ Mormons on the ticket will have every bigoted whack job’s head exploding.

Seeing as how the, “my parents are first cousins, X-Files wannabe, black helicopter, tinfoil hat wearing, stupid, dim-witted, thinks pro wrestling is real, lunatics,” are also known as “The Republican Base,” this is highly problematic.

Del. Sam Arora Needs be Drummed Out of Politics

For those who are not up on Maryland politics, Sam Arora was considered to be a politico with a great future, but he campaigned on a promise to support, and co-sponsor, a bill supporting gay marriage, and then he opposed it.

The bill passed the House of Delegates by virtue of a Republican vote delivered by the lobbying of Dick Cheney.

For once, it appears that there will be consequences of his action.

I’m sure he’s feeling courageous, but he’s a coward. If he had any guts, he would not have pretended to support marriage equality when he thought that there was no chance of it passing.

He campaigned on gay marriage, and when it looked like it would pass, he voted against it.

This is why members of the Democratic establishment in both Maryland and nationwide are currently determining the best way to ensure that he won’t work in Democratic Party politics ever again.

I would note that it’s likely that he’s going to have some staffing problems in the immediate future, as his his legislative director quit once he knew that he was going to vote against HB 348.

My guess is that this is the first of many departures, because if anyone on his a staff wants to have a future in politics, having Sam Arora on your resume after January 2012 will be toxic.
