An Update on Ferguson

First, when they say that a prosecutor can indict a ham sandwich, they ain’t kidding. For example, “According to the Bureau of Justice Statistics, U.S. attorneys prosecuted 162,000 federal cases in 2010, the most recent year for which we have data. Grand juries declined to return an indictment in 11 of them.”

Even with pre-indictment plea bargains, a grand jury no-billing is a very rare thing.

I was wrong about the DA not releasing the evidence from the grand jury proceedings, and it makes it even clearer that the fix was in.

During his testimony, Darren Wilson was allowed to blythly state the clearly racist trope that “Michael Brown looked like a demon:

St. Louis Public Radio published the full transcript of Wilson’s testimony Monday. The St. Louis County Prosecutor’s office released evidence from the grand jury proceedings after it was announced that no charges would be filed against Wilson.

Wilson explained to jurors that in order to keep shielding his face from Brown’s punches, the only option available for him to defend himself was to pull out his gun. The officer struggled with Brown before he was able to fire the weapon, shattering glass from the police cruiser’s door panel.

After that first shot went off, Wilson testified that Brown stepped back and “looked up at me and had the most intense aggressive face. The only way I can describe it, it looks like a demon, that’s how angry he looked.”

It appears that this is a variant of the “Magic Negro” trope that I was previously unaware of.

Then there was the evidence from “Witness #40”, in the form of a journal entry, which exactly verified Officer Wilson’s testimony, and dropped the N-word repeatedly.

The prosecution allowed this into evidence without any vetting or challenge from Prosecutor Robert McCulloch.

Also note that the ER report on Officer Wilson noted was in no distress when examined by doctors, that Wilson and Brown were the same size, and the medical examiner took no pictures because his camera battery was dead.

One final note: the behavior of prosecutor McCulloch was sufficiently odd, that both CNN and the New York Times noted that he behaved more like defense counsel than he did a prosecutor.

Furthermore, at the press conference announcing the grand jury decision, he appeared to have deliberately gone out of his way to sabotage any potential effort by the Department of Justice or a civil action by by publicly labeling witnesses who claimed that the shootings were not justified to be liars.

When juxtaposed with the fact that he appeared to have deliberately delayed the public release of the grand jury decision until a time calculated to maximize the possibility of civil unrest.

It might have been as a distraction from his document dump.

It might have been a way to dog-whistle his willingness to appease the racist sentiments of white voters in the county.

It might have been a fit of pique over having to convene a grand jury when he clearly did not want to do so.

In any case, I believe that a close investigation of the Saint Louis County Prosecutor’s office would reveal a pattern of ethically questionable actions, but it is clear that, with Eric Holder heading out the door and Barack Obama once again trying not to remind people that he is black, there will be no meaningful investigation of the prosecutor’s office.

Needless to say, I am appalled, though I am not surprised.

The Cops will Riot, Not the Protesters. That’s What Happened the Last Time

Craven Politician,* and Missouri Governor Jay Nixon has decided to declare a state of emergency and call out the National Guard:

Governor Jay Nixon activated the Missouri National Guard in anticipation of unrest when a grand jury decides whether to indict a white police officer who shot and killed an unarmed black teenager.

Nixon declared a state of emergency and created a “unified command” of police agencies in preparation for the decision, due this month in the slaying of 18-year-old Michael Brown of Ferguson, a St. Louis suburb.

“As part of our ongoing efforts to plan and be prepared for any contingency, it is necessary to have these resources in place in advance of any announcement,” Nixon, a 58-year-old Democrat, said yesterday in a statement. “Public safety demands that we are fully prepared.”

The violence in Ferguson last time did not come from the protesters. It came from the cops.

The Ferguson, and the other local and county police forces participating, rioted.

If Nixon wants to do the right thing, he needs to take those Guard troops, and use them to keep the local police in their barracks.

If he is not willing to do so, then Obama should federalize the guard, and lock down the cops.

A lot of meaningless violence would be prevented.

*But I repeat myself.

I Want My Howard Dean!!!

What Atrios says:

One thing that I think people tend to forget is that Howard Dean’s 50 state strategy wasn’t simply about fighting everywhere, it was about shoveling money out of DC before the vultures there could get their hands on it. It was about the idea that people who run campaigns out of Washington don’t know what the hell they’re doing, but that as long as the money was sitting there, candidates didn’t have much choice but to deal with them.

In case you doubt the wisdom of his words, note what some anonymous Democratic Party functionary asshat said about all this:

“This is a tsunami. Heads will roll at 1600. And if they don’t, shame,” the insider said, adding: “The president has 60 days to clean house, regrow his spine, and lay out an aggressive, centrist agenda. If he fails at any of those, he might as well just start writing his memoir.”

Note that in the same article, there is someone who gets it:

“Democratic operatives who refuse to acknowledge this is the White House’s fault are out of their f—— minds,” the operative said. “These operatives who don’t understand that the White House fucked up are the same hacks who overcharge House and Senate candidates for shitty consulting work and help lose elections year after year.”

The operative also said Obama and Senate Majority Leader Harry Reid hurt the party by delaying ambitious action on immigration and other hot-button issues to protect incumbent senators in southern states.

“It also doesn’t help that Dems completely broke their promise to enact immigration reform. Reid’s strategy of ‘no big bills’ this year that could protect [Arkansas Sen. Mark] Pryor, [North Carolina Sen. Kay] Hagan, and [Louisiana Sen. Mary] Landrieu obviously backfired,” the operative said. “They lost anyway, and we pissed off our base at the same time.”

Let me make a note here:  Were the Democratic Party to adopt a “F%#@ the South strategy”, much in the same way that Republicans have adopted a “F%$# New York City & Hollywood & San Francisco & Boston & non white Americans”, there really wound not be a down side.

Over the past 40 years, the Democratic Party has devoted increasing resources to keep its foothold in the white South, and that is simply not going to happen.

The dynamic that LBJ said over 50 years ago, “I’ll tell you what’s at the bottom of it. If you can convince the lowest white man he’s better than the best colored man, he won’t notice you’re picking his pocket. Hell, give him somebody to look down on, and he’ll empty his pockets for you. I’ll tell you what’s at the bottom of it. We as a nation are not going to change this dynamic until we as a nation stop pandering to it.

The Least Likely Democrat to Tell the Truth and to not Backtrack About it Is………

That would be Mary Landrieu, who said that part of the hostility against Obama in the South had its roots in racism, that’s the truth bit, and now she has refused to apologize for speaking the truth:

Louisiana Senator Mary Landrieu made conservative heads explode by stating a truth, that the South has not always been the friendliest place go African-Americans and to women. Landrieu’s campaign put out a press release standing by her comments.

This is a level of guts and honesty that I would never have expected of her.

The New York Times Calls Out Erdogan on ISIS

Not only do they criticize his inaction, the editorial board specifically calls out Turkey’s actions to support Jihadists and Islamic extremists which eventually led to the formation of ISIS:

This is an indictment of Mr. Erdogan and his cynical political calculations. By keeping his forces on the sidelines and refusing to help in other ways — like allowing Kurdish fighters to pass through Turkey — he seeks not only to weaken the Kurds, but also, in a test of will with President Obama, to force the United States to help him oust President Bashar al-Assad of Syria, whom he detests.

But all sides — the Americans, Mr. Erdogan and the Kurds — agree that ground forces are necessary to capitalize on the air power. No dice, says Mr. Erdogan, unless the United States provides more support to rebels trying to overthrow Mr. Assad and creates a no-fly zone to deter the Syrian Air Force as well as a buffer zone along the Turkish border to shelter thousands of Syrian refugees who have fled the fighting.

Mr. Erdogan’s behavior is hardly worthy of a NATO ally. He was so eager to oust Mr. Assad that he enabled ISIS and other militants by allowing fighters, weapons and revenues to flow through Turkey. If Mr. Erdogan refuses to defend Kobani and seriously join the fight against the Islamic State, he will further enable a savage terrorist group and ensure a poisonous long-term instability on his border.

This is not the sort of truth telling that I expect from the “Paper of Record,” and I hope that they extend it to the House of Saud (specifically Prince Bandar, who was aggressively supporting ISIS until they were well into invading Iraq).

That won’t happen though.

As an aside, Erdogan actions in the matter have set back Turkey’s bid to join the EU by many years, because the Europeans already looked at intervening in Syria, and wanted no part of the Erdogan and the Gulf princes’ efforts to replace yet another secular Arab regime with a Sunni government.

Not not even the French, who still think of Syria as a colony in some ways, were unwilling to go on that adventure.

Given that there is no meaningful opposition to Erdogan and his AKP party for the foreseeable future, I’m pretty sure that any number of EU functionaries, as well as many governments, are now feeling a sense of relief that they have been slow walking Turkey’s application.

Joe Biden Speaks the Truth

So of course, he had to apologize for it:

A diplomatic rift between Turkey and the United States was patched over late Saturday after the American vice president, Joseph R. Biden Jr., officially apologized to Turkey’s president, Recep Tayyip Erdogan, for remarks suggesting that Turkey helped facilitate the rise of the Islamic State terrorist group.

In remarks at Harvard University on Thursday, Mr. Biden said Mr. Erdogan had admitted erring in allowing foreign fighters to cross Turkey’s border into Syria, eventually leading to the formation of the group, also known as ISIS and ISIL.

Mr. Biden’s spokeswoman, Kendra Barkoff, said in an emailed statement that the two leaders spoke by phone on Saturday. “The vice president apologized for any implication that Turkey or other allies and partners in the region had intentionally supplied or facilitated the growth of ISIL or other violent extremists in Syria,” Ms. Barkoff said. “The United States greatly values the commitments and sacrifices made by our allies and partners from around the world to combat the scourge of ISIL, including Turkey.”

Mr. Erdogan, despite widespread evidence to the contrary, denied that Turkey’s long, porous border had enabled thousands of militants to cross onto the Syrian and Iraqi battlefields since the Syrian civil war began in 2011. “Foreign fighters never crossed into Syria from our country,” Mr. Erdogan said. “They would cross into Syria from Turkey on tourist passports, but nobody can claim that they have crossed with arms.”

Seriously? How f%$#ing stupid do we think we are?

BTW, this is what Biden said:

Speaking at the John F. Kennedy School of Government, Mr. Biden said allies including Turkey, Qatar and the United Arab Emirates had extended unconditional financial and logistical support to Sunni fighters trying to oust the Syrian government of President Bashar al-Assad.

“President Erdogan told me,” he said, according to the Turkish newspaper Hurriyet, “ ‘You were right. We let too many people through. Now we are trying to seal the border.’

“Our allies poured hundreds of millions of dollars and tens of thousands of tons of weapons into anyone who would fight against al-Assad,” he said, including jihadists planning to join the Nusra Front and Al Qaeda.

I think that the appropriate response to Erdogan’s hissy fit is to tell him to go pound sand, which is why I would make a lousy diplomat.

He, and rest of the Sunni hegemonists were hip deep in supporting Al Qaedal linked militants, and Saudi Arabia directly supported what would become ISIS in their bid to overthrow the Assad regime.

The fact that this is not a part of the dialog about the US intervention in Iraq and Syria is a sign of just how completely the House of Saud owns our foreign policy apparatus.

Silly Rabbit, Religious Freedom is Just for Christians

In their 41-14 drubbing of the New England Patriots, Kansas City Chiefs safety Husain Abdullah intercepted Tom Brady and ran it back for a touchdown, and then gave thanks to God.

Unfortunately, this was a Muslim prayers, so he was given an unsportsmanlike conduct penalty.

I don’t ever recall that ever happening to Tim Tebow.

Today, the NFL actually called out the Zebras, and apologized:

The N.F.L. said Tuesday that Kansas City Chiefs safety Husain Abdullah was mistakenly penalized by a game official when he knelt to pray after scoring a touchdown Monday night.

In the fourth quarter of the Chiefs’ 41-14 victory over the New England Patriots, Abdullah, who is Muslim, intercepted a pass by Tom Brady and returned it 39 yards for a touchdown. After he entered the end zone, he slid on his knees and bowed forward in prayer, with his head touching the turf.

He was given a 15-yard penalty for unsportsmanlike conduct.

An N.F.L. spokesman said Tuesday that Abdullah should not have been penalized. “Officiating mechanic is not to flag player who goes to ground for religious reasons,” Michael Signora, the spokesman, said on Twitter.

Players routinely gesticulate and thank God after scoring touchdowns. Most prominently, Tim Tebow, the former Denver Broncos quarterback, knelt on one knee after scoring. Tebowing became an Internet meme.

If Abdullah had Tebowed, he would not have gotten a penalty.

You know it, I know it, and even the generally clueless National Football League knows this.

Nope, no Racism Here

A Wisconsin militia group is planning send armed representatives to target black voters on election day:

A visit to the group’s Facebook page features makes it clear exactly who they are targeting. All of the pictures on the page feature African-Americans. The group is trying to get African-Americans who may have outstanding warrants arrested in order to keep them from voting. The group wants people to report those they suspect of having warrants out on them to the police on election day, “Do the community a favor and keep an eye out for people wanted on warrants and report them to the police on election day.”

The “poll watchers” also plan on harassing and following people who they suspect of being wanted on warrants to their homes. The plan seems to be to use the police to intimidate African-Americans into not voting in November’s election.

The group admits that they are targeting Democrats. They aren’t exactly subtle in making it clear that they are targeting African-American voters. The scheme is an attempt to intimidate African-American voters while getting around the Voting Rights Act. The point of this campaign isn’t to get felons off the streets. The “poll watchers” are trying to keep African-Americans away from the polls.

The party of Abraham Lincoln is now the party of Jefferson Davis and Nathan Bedford Forrest.

My first thought was that there ought to be a law against this.

My second thought was Google it and see if there is a law against this.

It turns out that there is, 18 U.S. Code § 594:

Whoever intimidates, threatens, coerces, or attempts to intimidate, threaten, or coerce, any other person for the purpose of interfering with the right of such other person to vote or to vote as he may choose, or of causing such other person to vote for, or not to vote for, any candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, at any election held solely or in part for the purpose of electing such candidate, shall be fined under this title or imprisoned not more than one year, or both.

 I might suggest that these guys might need some scrutiny from Federal authorities.

I’m just saying.

And I Would Have Gotten Away With it Too, If it Weren’t For Your Meddling N***ers!

First we have Georgia State Senator Fran Millar objecting to get out the vote efforts in black ares then following this up by saying explicitly that he it is the black voter voter bit:

The Georgia state senator who ranted about excessive black voting and vowed to fight a move to expand early voting in DeKalb County defended his remarks on Facebook, saying that he would rather have more educated voters than an increase in the total number of voters.

The Republican state senator, Fran Millar (pictured), wrote that in a comment responding to others on his post where he vowed to end Sunday balloting in DeKalb County because that area is “dominated by African American shoppers” and has “large African American mega churches.”

“I do agree with Galloway and I never claimed to be nonpartisan,” Millar wrote. “I would prefer more educated voters than a greater increase in the number of voters. If you don’t believe this is an efort [sic] to maximize Democratic votes pure and simple, then you are not a realist. This is a partisan stunt and I hope it can be stopped. Furthermore I don’t control where people are allowed to vote but am glad Brookhaven has been added for the last week.”

This is followed up by the Georgia Secretary of State, whose job is to protect the franchise, starts a bogus investigation of a GOTV group, and then is caught on tape calling increased black votes a problem:

In closing I just wanted to tell you real quick, after we get through this runoff, you know the Democrats are working hard, and all these stories about them, you know, registering all these minority voters that are out there and others that are sitting on the sidelines, if they can do that, they can win these elections in November. But we’ve got to do the exact same thing. I would encourage all of you, if you have an Android or an Apple device, to download that app, and maybe your goal is to register one new Republican voter.

Clearly the Supreme Court was either smoking some very good weed, or were a bunch of contemptible corrupt partisans, when they gutted the Voting Rights Act.

My money is on the latter.

Yes, We Must Support all Disruptive Business Models, Regulations be Damned

These are only a few of the allegations brought against Uber drivers in recent months, and today the company adds another black eye to its record: allegedly denying service to the blind.

According to the San Francisco Examiner, the National Federation of the Blind filed a lawsuit in a federal court against Uber yesterday, claiming that Uber drivers have refused service to blind people with service dogs on more than thirty occasions. In one instance, a driver allegedly shoved a woman’s guide dog into the trunk of his car and refused to stop the vehicle after the passenger realized what had happened. To add insult to injury, the lawsuit also states that some customers were charged cancellation fees after being refused a ride.

This behavior, along with being appallingly unfair, appears to be a pretty clear violation of the Americans with Disabilities Act, which bans discrimination against the blind by taxi companies, even if the car is operated by a private independent contractor.

But the Federation also claims that it tried to resolve the issue with Uber without filing a lawsuit, but the company rejected its negotiation proposal. Furthermore, the lawsuit alleges that Uber told customers that its independent drivers were out of the company’s control, and the best advice it could give was to mention the animal before the driver arrives. That may not be the soundest advice, considering that if drivers are willing to reject disabled riders in person, then they’re probably even more likely to do so over the phone or through the app.

But if what the lawsuit alleges is true, and Uber refused to negotiate with victims of discrimination while doing little to stop this discrimination from happening in the first place, then it sounds like Uber’s back to its old tricks — stonewalling and shirking responsibility whenever its drivers breaks the law.

This is not a bug, it’s a feature.

Discrimination, price gouging, sketch driver background checks, it’s all a part of Uber’s Ayn Rand driven ethos.

If you get cheated, discriminated, hurt, or dead, it’s your fault, because you aren’t being selfish enough.

In A Choice Between the Two Religions of Texas, the Christian Right Goes with Bigotry

It is said that that there are two religions in Texas: Jesus and football.

The Dallas Cowboys, whose defense was pathetic last year, decided to add openly gay defensive end Michael Sam to their practice squad, and all hell breaks loose:

Right-wing Christians plan to protest the Dallas Cowboys signing of Michael Sam, the first openly gay NFL player.

The outside linebacker was cut last week by the St. Louis Rams, which had drafted him in the seventh round out of the University of Missouri, and picked up by the defense-starved Cowboys.

He will join the team’s practice squad if he passes a physical exam.

The move angered anti-LGBT Christians, who had threatened to boycott the Rams before Sam was released.

“We cannot just stand idly by as Christian values and morals are trampled,” said Jack Burkman, the GOP lobbyist working to keep Sam out of the NFL. “We will do whatever we can to preserve family values in this country.”

Burkman has drafted legislation barring gay players from the NFL, but his brother said his efforts were a publicity stunt to draw clients to his lobbying firm.

“I think the idea that he is pushing legislation that is just hurtful and ridiculous is just plain stupid,” said Jim Burkman, an anesthesiologist who is openly gay. “He is not a legislator and he can’t really push legislation. I don’t think there are any cosponsors for a bill. It is just an attention grab and a media grab to pander to those folks who pay him to lobby on their behalf.”

I’m about to say something that I never believed that I would ever say: Thank you Jerry Jones for doing the right thing.

I feel dirty now.

Talibaptists Do Not Get Irony

On Hannity (of course) J. Crewe clothes horse turned Duck Dynasty ZZ Top impersonator Phil Robertson declared that we must convert ISIS to Christianity or murder them:

Then, Robertson arrived at the most controversial part of the interview, saying of the Islamic State: “You either have to convert them, which I think will be next to impossible. I’m not giving up on them but I’m just saying, either convert them or kill them.”

As near as I can figure out, the only difference between Mr. Robertson and ISIS is that the ISIS militants are better dressed.

The Most Transparent Coverup Ever

So, the Ferguson police department, aka the gang that cannot shoot straight, but will do so with fully automatic weapons mounted on top of an MRAP, decided to both release the shooting officer’s name and begin a policy of character assassination against Michael Brown:

Police on Friday said that Darren Wilson, the officer who shot and killed Michael Brown last weekend, confronted Brown after the teenager was identified as the main suspect in a convenience store robbery that occurred Saturday morning.

However, hours later, authorities said that the robbery was not the reason for the encounter that ended with Brown shot to death on a suburban St. Louis street, suggesting that it was unrelated to the confrontation.

As Ezra Klein notes, “The police are the issue in Ferguson, not Michael Brown’s character.”

I am tempted to go all Samuel L. Jackson in Pulp fiction, and asking if Ferguson Police Chief Thomas Jackson thinks that we look like a bitch, because he is certainly trying to f%$# us like one.

If there are not multiple of indictments of the police involved in this, both for the town of Ferguson and for St. Louis county, I will be suggest that it will be because of collusion between the police and the prosecutors.

Thoughts on Ferguson: Part 1: the Shooting

This first bit is arguably the least important detail in the whole affair.

What we know at this point is that two black men of roughly college age, Michael Brown and Dorian Johnson, were walking down the street, that a police officer confronted them over this and it ended with Michael Brown dead from multiple gunshot wounds.

The video you see is Dorian Johnson describing the confrontation.

The police claim that Mr. Johnson went for the gun, and Mr. Johnson claims that the (as still unnamed) police officer went after Mr. Brown, and that Brown was trying to get away, and his death was the result of the police officer being shot while holding his hands up.

So, what really happened?

I don’t know, but what I do know is that what happened in the immediate aftermath is very strange.

What surprises me is that Dorian Johnson has not yet been questioned by police.  Heck, it surprises me that he wasn’t taken into custody, as he wasn’t just a witness, but he was a part of the incident, as he was walking down the street with the victim.

The only reason that I can imagine that the police are studiously avoiding questioning witnesses in this matter is because the police already knew what happened, that the officer was at fault, and they are trying to cover it up.

Note that I am not talking about the law enforcement reaction to the protests, that will be part 2, I am simply describing the profound irregularities in the investigation that I cannot explain except by deliberate wrongdoing.

Well, Waddya Know? Facebook has a Redeeming Social Function

It turns out that it’s a giving an opportunity for ignorant bigots to out themselves:

There are plenty of reasons to loathe Facebook. There’s the new messenger app that they’re making users install if they want to chat on their mobile devices. There’s the way they screwed around with users’ feeds, just as a little experiment. There’s the overall way it makes people unhappy. If you see it as a community, it’s pretty terrible. But if you instead choose to view it as the world’s most effective bozo-disclosing app, it’s rather brilliant.

On Wednesday alone, two outspoken Facebook users found themselves facing abrupt ends to their jobs after realizing too late that other people can actually see what you post in public. First, Virginia state Republican Party treasurer Bob FitzSimmonds resigned after controversy erupted when he declared on Facebook that Barack Obama’s recent comments on the achievements of Muslim Americans were “pure nonsense,” and asked, “Exactly what part of our nation’s fabric was woven by Muslims? What about Sikhs, Animists, and Jainists? Should we be thanking them too?” FitzSimmonds also drew ire earlier this year when he referred to Fairfax County Delegate Barbara Comstock as a “twat.” And in 2012, he raised eyebrows for speculating about when Obama “dies and goes to hell.” In a resignation letter he submitted to the State Central Committee this week, he said, “After discussion with several party leaders it seems clear that I will either need to stop posting on social media or step down from my party office.” While another, brighter individual might have chosen the former – to simply ease off on saying idiotic and offensive things in public — fortunately for FitzSimmonds’ colleagues, he chose the latter.

Also on Wednesday, a Texas police detective was fired after posting a Facebook tirade about the local “useless lazy turdbags” with “thousands of dollars of ink have adorning their unclean bodies” on government assistance. In his recent post, Detective Rob Douglas vowed, “I promise, if I ever snap and go on a killing spree, it will be in a supermarket on the first.” When announcing the decision to terminate Douglas, Marlin Police Chief Darrell Allen called the comments “inappropriate and troubling.” And yet, they did help take an resentful, angry cop off the streets, so they’ve got to be at least a little good for something.

In its relatively short lifespan, Facebook has proven itself the downfall of countless racists, sexists, homophobes and straight-up dopes. Turns out there’s always somebody willing to log on and do something regrettable. Earlier this summer, an Illinois woman was arrested for shoplifting – after posting selfies of her new merchandise on her page. And last month, after bragging on Facebook that “Y’all will never catch me,” Baltimore police did just that to Roger Ray Ireland after he violated his probation. And on Aug. 5, a Swedish politician abruptly ended his campaign shortly after referring on Facebook to “the Jewish pigs.” Reminder: This is all just in the past few weeks.

These days, Facebook is the “Maccaca Moment” Generator of choice.

A Couple of Interesting Perspectives on the War in Gaza

First comes the Yorkshire Ranter, who looks at the conflict, and draws some conclusions and their effects.

First is the explanation of why Hamas is using such an ineffective weapon system in their rockets, which cause damage only by happenstance.

The Ranter (IMNSHO correctly) explains that the rocket fire is suppressive fire, not firing for effect:

You could imagine that this is the physical expression of a sort of generalised venting of rage – randomly tossing ineffective bangs over the wall. But you’d be wrong both in the sense that it trivialises the rocketry’s effect on Israelis, and that it denies Palestinians’ agency and competence.

It’s too easy to point to the fact that they very, very rarely kill anyone and argue that in fact they are a bit puny and the Israelis should just man up and show some stiff upper lip rather than calling in artillery on the nearest school for the disabled. I have myself given in to the temptation before. The point isn’t destruction so much as suppression, the effect created by the fact of being under fire. And what they want to suppress is essentially the Israeli economy.

Remember that GDP is a flow concept – loaves out of a bakery, cars off a production line – not a stock concept like Scrooge McDuck’s treasure. Israeli GDP in 2013 was $286.8bn at purchasing power parity. We can usefully think of this as $32.6 million GDP per hour. While an air warning RED is in force, it is a good guess that economic activity is basically zero. Not quite, of course, the electricity is on, the phone network is up, and the government sector is more than busy. But as a rule, if you’re in an air raid shelter you’re not at work or doing much else than worrying. The Iron Dome close-in weapons system is a major commitment of complicated technology, a diversion of social resources, so the cost of air defence has to be offset against that. And the warning system, which MIT’s Ted Postol credits with protecting the population much more than Iron Dome, does so at the cost of putting more people under warning for longer.

So, you can see why they would go for range first. During this wave of conflict, the percentage of Israeli territory under warning has been as high as 75%, or $24.6m of foregone GDP per hour. A tiny commitment of additional materials per rocket provides a much bigger effect. Also, range requires “bigger” but not “better”, at least until the structural integrity constraints of the rocket are reached. A rocket is a container of propellant, so increasing its volume doesn’t require a proportionately greater quantity of materials. Another important reason to go bigger first is that it makes it possible to launch from anywhere in the Gaza Strip.

It should be noted in war, much of the weapons firing is suppressive fire, and as a suppressive weapon, the rockets are very effective, particularly since they are so cheap.

Rather than being an incoherent expression of rage, it is actually a relatively sophisticated, and rather effective, tactic.

His second, and far more troubling observation has to do with the rather non controversial conclusion that conflict and violence has the effect of radicalizing both societies.

My concern primarily has to do with the effect on Israeli society:

Here’s the point on the Israeli side. Palestinian rocket range and the vote for the Israeli extreme-right are strongly correlated; each ward to come under threat reports an increase of between 2 and 6 percentage points in the extreme-right vote (being the 95% confidence intervals). 

Something that has occurred during this conflict, which I have not observed before, is the hightened level of violence by Israeli Jews against Israeli Arab violence, including the lynching of Mohammed Abu Khdeir (burnt alive) simply for being Arab.

There is an element in Palestinian society that believes that they can eventually make the Israelis break, and I fear than they can eventually make the Israelis snap, and they go the route of Slobodan Milošević.

This worry leads directly to a commentary by noted Atheist Sam Harris, who maintains that Israel has the moral high ground in this conflict, even while he objects both to a religious based state, and religion in general, as an absurdity.

Basically, he engages in a thought experiment, where he tries to imagine what each side would do should they have the such overwhelming power that there would be no limits to their actions, and then he realizes that Israel is already in this position:

The truth is that there is an obvious, undeniable, and hugely consequential moral difference between Israel and her enemies. The Israelis are surrounded by people who have explicitly genocidal intentions towards them. The charter of Hamas is explicitly genocidal. It looks forward to a time, based on Koranic prophesy, when the earth itself will cry out for Jewish blood, where the trees and the stones will say “O Muslim, there’s a Jew hiding behind me. Come and kill him.” This is a political document. We are talking about a government that was voted into power by a majority of the Palestinians. [Note: Yes, I know that not every Palestinian supports Hamas, but enough do to have brought them to power. Hamas is not a fringe group.]

The discourse in the Muslim world about Jews is utterly shocking. Not only is there Holocaust denial—there’s Holocaust denial that then asserts that we will do it for real if given the chance. The only thing more obnoxious than denying the Holocaust is to say that it should have happened; it didn’t happen, but if we get the chance, we will accomplish it. There are children’s shows that teach five-year-olds about the glories of martyrdom and about the necessity of killing Jews. 

And this gets to the heart of the moral difference between Israel and her enemies. And this is something I discussed in The End of Faith. To see this moral difference, you have to ask what each side would do if they had the power to do it. 

What would the Jews do to the Palestinians if they could do anything they wanted? Well, we know the answer to that question, because they can do more or less anything they want. The Israeli army could kill everyone in Gaza tomorrow. So what does that mean? Well, it means that, when they drop a bomb on a beach and kill four Palestinian children, as happened last week, this is almost certainly an accident. They’re not targeting children. They could target as many children as they want. Every time a Palestinian child dies, Israel edges ever closer to becoming an international pariah. So the Israelis take great pains not to kill children and other noncombatants.  [Note: The word “so” in the previous sentence was regrettable and misleading. I didn’t mean to suggest that safeguarding its reputation abroad would be the only (or even primary) reason for Israel to avoid killing children. However, the point stands: Even if you want to attribute the basest motives to Israel, it is clearly in her self-interest not to kill Palestinian children.]

Now, is it possible that some Israeli soldiers go berserk under pressure and wind up shooting into crowds of rock-throwing children? Of course. You will always find some soldiers acting this way in the middle of a war. But we know that this isn’t the general intent of Israel. We know the Israelis do not want to kill non-combatants, because they could kill as many as they want, and they’re not doing it. 

What do we know of the Palestinians? What would the Palestinians do to the Jews in Israel if the power imbalance were reversed? Well, they have told us what they would do. For some reason, Israel’s critics just don’t want to believe the worst about a group like Hamas, even when it declares the worst of itself. We’ve already had a Holocaust and several other genocides in the 20th century. People are capable of committing genocide. When they tell us they intend to commit genocide, we should listen. There is every reason to believe that the Palestinians would kill all the Jews in Israel if they could. Would every Palestinian support genocide? Of course not. But vast numbers of them—and of Muslims throughout the world—would. Needless to say, the Palestinians in general, not just Hamas, have a history of targeting innocent noncombatants in the most shocking ways possible. They’ve blown themselves up on buses and in restaurants. They’ve massacred teenagers. They’ve murdered Olympic athletes. They now shoot rockets indiscriminately into civilian areas. And again, the charter of their government in Gaza explicitly tells us that they want to annihilate the Jews—not just in Israel but everywhere. [Note: Again, I realize that not all Palestinians support Hamas. Nor am I discounting the degree to which the occupation, along with collateral damage suffered in war, has fueled Palestinian rage. But Palestinian terrorism (and Muslim anti-Semitism) is what has made peaceful coexistence thus far impossible.]

This from a guy who, “I don’t think Israel should exist as a Jewish state. I think it is obscene, irrational and unjustifiable to have a state organized around a religion.”

I do differ with Mr. Harris a bit.

Specifically,. I do not think that it is self evident that the Palestinian leadership sees a Middle East without Jews as their perfect outcome.  Populist movements frequently having its leaders paying lip service to ideologies as a matter of convenience. (See Nelson Mandela and his affiliation with the South African Communist Party, and compare it to his behavior when he actually became President of South Africa)

So, the future proclivities of a Palestinian state are to my mind far more unknown than Sam Harris, though I am not hugely optimistic:  I believe that under the current environment, the chance that any Palestinian peace maker would suffer the same fate as Michael Collins is pretty high.

For Once, Obama Declines to Split the Baby (Fabulous!)

After the failure of Congress to pass any LGBT civil rights legislation, Obama has signed an executive order banning it for government contractors.

The surprising bit is that despite entreaties from the religion-as-an-excuse-to-be-a-bigot crowd, the executive order does not grant a religious exemption:

President Obama, resisting calls from several prominent faith leaders, will not include a new exemption for religiously affiliated government contractors when he issues an executive order Monday barring discrimination on the basis of sexual orientation and gender identity, the White House said Friday.

Obama announced last month that he would sign such an order after concluding that Congress was not going to act on a broader measure prohibiting discrimination based on sexual discrimination or gender identity by companies.

Since then, faith leaders have urged him to include an exemption for government contractors with a religious affiliation, such as some social service agencies.

White House officials said Friday that the new executive order would not include such an exception. But Obama will preserve an exemption put in place by former president George W. Bush that allows religiously affiliated contractors to favor employees of a certain religion in making hiring decisions.

Gay rights organizations have criticized that earlier exemption, and they celebrated news Friday that Obama would not be broadening it.

“With the strokes of a pen, the president will have a very real and immediate impact on the lives of millions of LGBT people across the country,” said Chad Griffin, president of the Human Rights Campaign, a gay rights group.

I think that one of the consequences of the Hobby Lobby decision is the understanding that accommodation of the Talibaptist crowd is a losing proposition.

I’ve thought this for a while.

People who use religion as a, “Veil under which anger can be legitimatized,” to are a part of the problem, not a part of the solution.

And the Hobby Lobby Decision Has Already Started to Bear Bitter Fruit

We now have the usual group of rat-f%$#s, including Rick “Invited by Obama to giva a benediction at his first inaugeration” Warren, are demanding the right to discriminate against LGBT employees:

This week, in the Hobby Lobby case, the Supreme Court ruled that a religious employer could not be required to provide employees with certain types of contraception. That decision is beginning to reverberate: A group of faith leaders is urging the Obama administration to include a religious exemption in a forthcoming LGBT anti-discrimination action.

Their call, in a letter sent to the White House Tuesday, attempts to capitalize on the Supreme Court case by arguing that it shows the administration must show more deference to the prerogatives of religion.

“We are asking that an extension of protection for one group not come at the expense of faith communities whose religious identity and beliefs motivate them to serve those in need,” the letter states.

I am so ready for Antonin Scalia to choke to death on his own bile and be replaced by a justice who is not an unethical hack.

Chaos is Job Won!*

What a surprise. After a decades long assault from the right wing, and an increasingly hostile judiciary, the bigots have managed to re-segregate our public schools:

For decades, federal desegregation orders were the potent tool that broke the back of Jim Crow education in the South, helping transform the region’s educational systems into the most integrated in the country.

Federal judges, often facing down death threats and violence, blanketed Southern states with hundreds of court orders that set out specific plans and timetables to ensure the elimination of racial segregation. Federal agencies then aggressively used the authority of the courts to monitor hostile school systems, wielding the power of the 1964 Civil Rights Act to strip federal dollars from districts that refused to desegregate.

The pace of the change wrought by the federal courts was breathtaking. In 1963, about 1 percent of black children in the South attended school with white children. By the early 1970s, the South had been remade — fully 90 percent of black children attended desegregated schools. Court orders proved most successful in the South, but were also used in an attempt to combat de facto segregation in schools across the country, from New York to Michigan to Arizona.

Today, this once-powerful force is in considerable disarray.

A ProPublica examination shows that officials in scores of school districts do not know the status of their desegregation orders, have never read them, or erroneously believe that orders have been ended. In many cases, orders have gone unmonitored, sometimes for decades, by the federal agencies charged with enforcing them.

At the height of the country’s integration efforts, there were some 750 school districts across the country known to be under desegregation orders.

Today, court orders remain active in more than 300 districts. In some cases, that’s because judges have determined that schools have not met their mandate to eliminate all vestiges of segregation.

But some federal courts don’t even know how many desegregation orders still exist on their dockets. With increasing frequency, federal judges are releasing districts from court oversight even where segregation prevails, at times taking the lack of action in cases as evidence that the problems have been resolved.

Since the 1990s, the Supreme Court has sharply curtailed the power of parents to challenge racial inequities in schools. Districts not under court orders are largely prohibited from considering race to balance schools. And parents in these districts must show that school officials are intentionally discriminating when they make decisions that adversely affect black and Latino students.

And so, as desegregation orders are ignored, forgotten or lifted, black parents are losing the ability to effectively challenge school inequality.

Over the course of months, ProPublica has compiled the nation’s most comprehensive and accurate data on active desegregation orders. We used legal databases, academic studies and contacted more than 160 school districts across the country.

This is not an accident.

Between the Republican Party’s embrace of segregation for political success, and the Democratic Party’s cowardly unwillingness to enforce the law to placate people who will never for then, we are back to separate and unequal.
