Not Enough Bullets, AIG Yet Again

This time it appears that AIG is paying either $165 million, or $450 million to senior employees of their financial products division, the one which bankrupted the firm through their credit default swap (CDS) business.

It appears that the treasury, who, you know, manages AIG on behalf or the taxpayers, who now own of 80% of the bankrupt in everything but name only firm, were told by AIG president Edward Liddy that these were contracts, and so they had to honor them:

[Obama economic guru Larry] Summers said the government would examine its options, but he acknowledged it might not be able to terminate prior bonus agreements.

“We are a country of law. There are contracts. The government cannot just abrogate contracts,” he said in an interview Sunday on ABC’s “This Week.”

AIG is already scheduled to pay $121.5 million in incentive payments for 2008 to senior executives and 6,400 of its employees. And AIG is laying out another $619 million for 2009 in retention payments to more than 4,000 employees.
Total expected payments amount to almost $1.2 billion.

Somehow, the contracts signed with auto workers must be renegotiated, but those signed with failed and incompetent financial executives must be supported.

Seriously, the US government claim of impotence in the face of a contract is a reflection of the fact that Mssrs. Summers and Geithner are creatures of the corrupt financial industry on Wall Street, and cannot see beyond this.

If I had to choose between Vladimir Lenin and Timothy Geithner at Treasury, I would be very hard pressed to choose.

Obama Health Care Plan: No Single Payer

So, Obama sets up a summit on health care reform, and invites everyone but advocates for single payer, and finally, when the screaming gets too loud, relents, and invites a hand full of them.

This does not bode will for his plan.

First, if he is not more ambitious in his initial proposal than his basic desires, it will be cut down to nothing in Congress, and second, the insurance companies are evil, and any plan that makes supporting their business model a central tenet is doomed to fail.

Some of Bush’s executive power legal opinions have been released.

They are so extreme that started walking it back in October of 2008, and they effectively repealed them on January 15, 2009.

The short version of the opinions is that, “All your constitution are belong to us.”

We are talking about suspension of the 4th amendment and 1st amendment completely.

Why John Yoo still has a law license, much less a teaching position at UC Berkeley, is astonishing.

The essence of this document was to declare that George Bush had the authority (a) to deploy the U.S. military inside the U.S., (b) directed at foreign nationals and U.S. citizens alike; (c) unconstrained by any Constitutional limits, including those of the First, Fourth and Fifth Amendments. It was nothing less than an explicit decree that, when it comes to Presidential power, the Bill of Rights was suspended, even on U.S. soil and as applied to U.S. citizens. And it wasn’t only a decree that existed in theory; this secret proclamation that the Fourth Amendment was inapplicable to what the document calls “domestic military operations” was, among other things, the basis on which Bush ordered the NSA, an arm of the U.S. military, to turn inwards and begin spying — in secret and with no oversight — on the electronic communications (telephone calls and emails) of U.S. citizens on U.S. soil.

And the villagers inside the Beltway still see no need for an investigation.

And Now Republicans Come Out in Favor of Giving AIDS to Children

If you ever wondered just how immoral the Talibaptist wing of the Republican party is, look no further than state Senator Dave Schultheis (R-Colorado Springs), who is opposed to testing pregnant women for AIDS, because it would lead to treatments to reduce the chance of their children catching the disease, and their children having AIDS is appropriate punishment for their promiscuity.

The frightening thing is that coming from Colorado Springs, home of James Dobson’s Focus on the Family, a significant portion of his constituents likely agree:

  • What he said during the debate: “This stems from sexual promiscuity for the most part and I just can’t go there. We do things continually to remove the consequences of poor behavior, unacceptable behavior, quite frankly. I’m not convinced that part of the role of government should be to protect individuals from the negative consequences of their actions.”
  • What he said afterward: “What I’m hoping is that yes, that person may have AIDS, have it seriously as a baby and when they grow up, but the mother will begin to feel guilt as a result of that. The family will see the negative consequences of that promiscuity and it may make a number of people over the coming years … begin to realize that there are negative consequences and maybe they should adjust their behavior. We can’t keep people from being raped. We can’t keep people from shooting each other. We can’t keep people from jumping off bridges. People drink and drive, and they crash and kill people. Poor behavior has its consequences.”

For all those wankers (that’s you Lord Saletan) who think that we can engage in meaningful negotiations with the abortion criminalization crowd, understand that they want to eliminate all forms of birth control, and re-institute criminal penalties for “fornication”.

In fact, they want to give children AIDS to punish their parents.

You can no more find common ground with them than you can with al Qaeda.

I’m Speechless (Scummy Bank Edition)

It appears that a number of states have moved to debit cards for unemployment applications, and the banks that have been contracted the service are nickel and diming the recipients with fees (see also here).

Even better, the banks in question are TARP recipients.

I will note that the banks are already making millions in interest on the “float” on the accounts sitting there, and if you call to complain, they charge you for that too.

This is a Natural Result of Private Prisons

We now know that hundreds, perhaps thousands of children were sent to private juvenile detention facilities because the judges got kickbacks, more than 2.6 million dollars, from the operator of two private facilities.

The judges in question, Mark A. Ciavarella Jr. and Michael T. Conahan have pled guilty, with a recommendation from the prosecutors for a term of 87 months.

It should be 87 years.

The particulars are an indictment of our culture of privatization of government services:

With Judge Conahan serving as president judge in control of the budget and Judge Ciavarella overseeing the juvenile courts, they set the kickback scheme in motion in December 2002, the authorities said.

They shut down the county-run juvenile detention center, arguing that it was in poor condition, the authorities said, and maintained that the county had no choice but to send detained juveniles to the newly built private detention centers.

So, private players get into the system, pay off the right people, and these people shut down the government run facilities, and take kick-backs.

It’s worth noting that these kick-backs are called “consultancy fees” when the IMF and the World Bank do this in 3rd world nations, and have frequently involved basic human needs like a municipal water supply.

It should be noted that Robert J. Powell, the owner of the two facilities involved, PA Child Care and Western PA Child Care, is claiming that he did not bribe anyone, but rather that he was shaken down by the judges:

Robert J. Powell co-owned PA Child Care and Western PA Child Care until June. His attorney, Mark Sheppard, said his client was the victim of an extortion scheme.

“Bob Powell never solicited a nickel from these judges and really was a victim of their demands,” he said. “These judges made it very plain to Mr. Powell that he was going to be required to pay certain monies.”

Let’s see, you build jails for kids, and then suddenly they shut down the existing facility, because they think that you might bribe them?

I don’t think so.

BTW, these folks might never have been caught, but for the fact that they were doling out favors to friends in arbitration awards, and the insurance companies cried “foul,” and got an investigation.

In any case, they are now reviewing thousands of cases, and the federal prosecutors have petitioned the court to expedite notification to the victims.

Interestingly enough, the thing that seems to be bothering me the most involves a person who is not going to jail:

At worst, Hillary Transue thought she might get a stern lecture when she appeared before a judge for building a spoof MySpace page mocking the assistant principal at her high school in Wilkes-Barre, Pa. She was a stellar student who had never been in trouble, and the page stated clearly at the bottom that it was just a joke.

Instead, the judge sentenced her to three months at a juvenile detention center on a charge of harassment.

Why is anyone who would criminalize a satirical MySpace page allowed anywhere near children?

Why is this person still employed? Why are the police officers and prosecutors who did not laugh him off, or better still throw him in jail for harassment?

There is so much wrong here, that I’m beyond ranting.

It appears that big pharma and medical device manufacturers are gearing up to fight a provision in the stimulus bill which would compare outcomes for different treatments, so that healthcare professionals would know how they compare to each other, they are claiming that it’s, ” the first step to government rationing.”

The real reason that they are opposed to this is because selling people expensive s#@$ that does not work better than the cheap stuff is their business model.

Chinese Premier Wen Jiabao, who after having a shoe thrown at him by Martin Jahnke, has, “requested British authorities dismiss charges against Jahnke and pardon him for his act of protest.”

Yes, the Chinese have the moral high ground over George W. Bush, who appears to think that the arrest, continued detention, torture, and threat of a long prison sentence against his shoe thrower, Muntazer al-Zaidi does not merit comment.

This is what is alleged to have happened to Binyam Mohamed, and the British courts expunged the reports, because of threats from US intelligence that they would stop cooperating with UK intelligence if the information were released, and the is arguing to continue the complete and absolute privilege that Bush and His Evil Minions™ insisted upon:

“Is there anything material that has happened” that might have caused the Justice Department to shift its views, asked Judge Mary M. Schroeder, an appointee of President Jimmy Carter, coyly referring to the recent election.

“No, your honor,” Mr. Letter replied.

Judge Schroeder asked, “The change in administration has no bearing?”

Once more, he said, “No, Your Honor.” The position he was taking in court on behalf of the government had been “thoroughly vetted with the appropriate officials within the new administration,” and “these are the authorized positions,” he said.

Mr. Mohamed claimed that during his detention in Morocco, “he was routinely beaten, suffering broken bones and, on occasion, loss of consciousness. His clothes were cut off with a scalpel and the same scalpel was then used to make incisions on his body, including his penis. A hot stinging liquid was then poured into open wounds on his penis where he had been cut. He was frequently threatened with rape, electrocution and death.”

Note that the precedent here, US v. Reynolds, is in fact based on a lie. There were no state secrets involved, the B-29 which crashed was not, as was claimed, on a secret mission or testing secret equipment.

They claimed privilege because the report indicated that the aircraft was in poor condition because of inadequate maintenance, and the USAF wanted it covered up. It was all a lie.

Not Enough Bullets: The Ever Reliable AIG

AIG is looking getting more US government aid to unload its dodgy assets because at this point it has only been able to unload about $1b in assets, and that money had to go to retention payments:

So far, AIG has announced sales of only a few smaller businesses that, at least based on deals where a sale price was announced, will earn it a little over $1 billion. That is about what AIG is paying employees in retention payments to keep them from leaving for rivals, which could further erode the value of its units.

They need to pay money to the the very people who ran the company into the ground, in an employment scenario where no one on Wall Street is hiring, because they are worried they might go somewhere else.

I’m not just referring to the people who actually sold insurance here, I’m referring to the people who actually set up the CDS catastrophe that took the company down:

American International Group Inc., the insurer saved from collapse by government money after losses on credit-default swaps, offered about $450 million in retention pay to employees of the unit that sold the derivatives, according to two people familiar with the situation.

About 400 workers at the financial products unit may get the money in two installments, said the people, who declined to be named because details of the payments were confidential. The business was responsible for about $34 billion in writedowns since 2007 as the market value of swaps AIG sold to banks plunged amid the subprime mortgage market collapse.

They are not just paying people who were passengers at some car wreck in another division, they are paying the driver of the car that crashed.

What’s more, the driver was drunk, sending a text message, getting a blow job, and speeding at about 150 mph when they plowed into an orphanage.

Again, heads I win, tails you lose remuneration, bonuses to the tune of over a million dollars per employee to the folks who bankrupted the company.

The presiding judge at Gitmo, Army Colonel James Pohl, is refusing to suspend one of the trials, and has scheduled the arraignment for February 9:

Hours after taking office last week, Obama ordered Guantanamo prosecutors to seek 120-day delays in all pending cases to give his administration time to decide whether to scrap the widely criticized tribunals created by the Bush administration to try suspected terrorists outside the regular U.S. court system.

But the judge, Army Colonel James Pohl, said the law underpinning the tribunals gives the presiding judges sole authority to delay cases. He ruled that postponing proceedings against Abd al Rahim al Nashiri would harm the public interest in a speedy trial.

Note that al Nashiri appears to be one of the “high value” defendants who was water boarded, and he has been held for over 5 years…so much for speedy trials.

Seriously, Bush and His Evil Minions™ did their level best to politicize every level of government, including the military.

This will be poisoning the military and the civilian bureaucracy for decades to come.

Jeebus! Ben Stein is a Loser

You know, as much as I hate Thomas Friedman’s fictitious cab drivers who says what he wants, Ben Stein’s use of real people close to him in order to make a point is worse.

He uses them to depict the “real America”, much as Friedman does, only they are at least as Stein depicts them, are simply malevolent human beings, and he does not understand that this.

Case in point is his high school friend, who seems to be engaging in a form of arms length prostitution:

NOT long ago, a woman in California called me for advice. She is divorced, with two children, and has a series of interlocking financial problems.

She lives in a lovely home in a stylish inland enclave. It has an interest-only mortgage of about $2.2 million that requires a payment of $12,000 a month, very roughly. It was last appraised at $2.7 million, but who knows if it’s now worth anything remotely close to that price.

The woman, whom I’ve known since she was a teenager, has no job or other remunerative employment. She has a former husband, an entrepreneur whose business has suffered recently. He pays her $20,000 a month, of which roughly half is alimony and half child support. The alimony is scheduled to stop this summer.

She has a wealthy beau who pays her credit card bills and other incidentals, but she is thinking of telling him she is through with him. She has no savings and has refinanced her home repeatedly, always adding to indebtedness and then putting the money into a shop she owns that has never come close to earning a dime. Now she is up all night worrying about money. “Terrified,” as she put it. She wanted me to tell her what to do.

He calls her a “sweet woman,” but she is anything but this.

She is a user of other people, and a stupid one, because, while she has achieved success with her use of other people, she has not planned in any way for her future.

She is a parasite, and a particularly nasty one.

So, Mr. Stein thinks that she is the “real America”, and is thus indicative of how we all have gone wrong….When she was getting nearly $¼ of a million a year for having had sex with, and born children for, a wealthy “entrepreneur.”

It’s a toxic mix of entitlement and evil, and he thinks that she is a sweet woman.

Of course, then he brings up his son:

…… And all of this is compounded again because my handsome son, age 21, a student, has just married a lovely young woman, 20. You may have seen on television the pudgy, aging face of their sole means of support.

…

To not be able to eat at any restaurant he feels like eating at is just not on his wavelength. Of course, that’s my fault. (I have learned that everything bad that happens anywhere is my fault.) And I hope to be able to leave him well enough provided for to ease his eventual transition into some form of self-sufficiency.

So first, he knows a, “sweet woman,” who thinks nothing of relying on alimony to maintain an inflated lifestyle, and now he admits that he has raised a son with no concept of limits in terms of money because it is, “just not on his wavelength”.

The rich feel that they are entitled because for the past 28 years, America has said that wealth is an artifact of virtue, and these is the people that Ben Stein thinks is America.

National Archives to Get Boxes of Poo from Dick Cheney

Judge Colleen Kollar-Kotelly has ruled that Dick Cheney has the power to decide which of his papers are transferred to the national archives:

The Justice Department provided what U.S. District Judge Colleen Kollar-Kotelly called “constantly shifting arguments” in the case, but, she said, “That confusion is not evidence” that would undermine the sworn deposition of Claire M. O’Donnell, a Cheney aide who handles record-keeping and other administrative tasks.

“The Court expects,” she said, that White House officials “will, in good faith, comply with the representations that their officials have made, by way of testimony, in this case.” As a result, she granted summary judgment on the White House’s behalf and lifted a five-month-old injunction mandating the preservation of Cheney’s records.

One of the plaintiffs, Stanley I. Kutler, an emeritus professor of history and law at the University of Wisconsin Law School, said he remains worried that “when the Archives goes to open Cheney’s papers, they are going to find empty boxes.”

Nope, they want some weight there, and an empty box is not his style. My guess is that Cheney threw out his back squatting over his document boxes and taking a dump in them.

Because Cheney is not leaving without a hearty f#@k you to everyone.

They Tried to Declare an 11 Year Old an Enemy Combatant?

Seriously, it’s nice that the judge ordered the release of Mohammed El Gharani, who is now 21, because there was no credible evidence to hold him, but among their accusations was this gem.

The government also accused Gharani of belonging to a London-based al-Qaeda cell in 1998, an accusation that Leon questioned. Gharani was 11 at the time, living with immigrant parents in Saudi Arabia, his attorneys said.

So they discovered that they had no evidence, and so they accused him of being a terrorist at age 11???

He was picked up in Pakistan in 2002, when he was apparently 14.

So, he has been at Gitmo for something like 6 years, and doubtlessly tortured “subjected to enhanced interrogation techniques”…For a 14 year old boy, who was accused of being an 11 year old terrorist.

I can’t see this as anything but monstrous, and everyone involved in this process needs to go to jail for a very long time.

I don’t see how you describe anyone involved in the process without invoking Eichmann and the banality of evil.

Senior Bush DoJ Official Called Perjurer by IG

The Department of Justice’s report on Bradley Schlozman is absolutely scathing, saying that he:

  • Illegally applied political standards to career attorney hirings.
  • Lied about it to the Senate Judiciary Committee.

But 2 weeks before the new administration, no charges will be filed.

So, we have a flat out statement that he committed perjury, you know the things that the Republicans went Jihad over with Bill Clinton when it was: (a) Arguable, depending on your definition of sex, and (b) Not related to his official duties.

Even so, because Bush and His Evil Minions™ have thoroughly polluted the Justice Department, so the U.S. Attorney’s Office for the District of Columbia has declined to prosecute him.

If anyone out there lives in Kansas, how about filing a complaint with the disciplinary authorities there, because that is where he is practicing law. (more contact information at the link)

It turns out that it was a lie. There was no one booked to stay there, and they hurriedly invited John Howard, Australia’s former Prime Minister for one night so that Bush could bestow upon him that final mark of shame, a Medal of Freedom.

Note that Blair house has 119 rooms and 35 bathrooms, so they might never have even seen each other.

Paul Krugman is looking for a word that describes a person who, “considers his mild discomfort the equivalent of torture, crippling injury, or death for other people.”

He was referring to Alberto Gonzalez’s suggestion that he’s a “one of the many casualties of the war on terror.”

The first word that popped into my mind is the title.

I’m sure that the Germans have a word for it though, since they invented the word Schadenfreude.
