Subprime hedge fund manager forced to put yacht up for sale – Jul. 30, 2007

John Devaney, the CEO of United Capital Markets, a fund that specializes in buying and selling bonds that are backed by the mortgage payments, particularly adjustable rate subprime mortgages, has put his 142-foot yacht “Positive Carry” up for sale, according to a yacht broker’s Web site.

Devaney’s fund has run into trouble lately. A spokesman for the firm told Reuters on July 3 that it had stopped honoring request from some of its investors for redemptions, or withdrawal, of investments.

Devaney told Money magazine this spring that despite problems that the loans cause for borrowers, the assets backed by them provided a good return for his fund.

“The consumer has to be an idiot to take on those loans,” he said. “But it has been one of our best-performing investments.”

I hope he gets cancer.

According to the yacht broker’s listing, the yacht has accommodations for 10 passengers in its five staterooms, along with space for a crew of seven. Its amenities include his and her baths in the master suite, and four guest bathrooms with Jacuzzi tubs and showers and cherry wood interior throughout.

It has two 2,250-horsepower engines and a range of 3,500 nautical miles.

The New York Post reported Monday that Devaney is also seeking to sell a home in Aspen for $16.5 million.

The Aspen Times reported in November that he bought that house, for $16.25 million, and that property includes a 16,000-square-foot main house and carriage house which include 16 bedrooms, 18 full bathrooms, two fireplaces, three kitchens and two caretaker bedrooms with bathrooms.

Unfortunately, this #$@&ing vulture is still rich.

This Is Not Funny, It’s Repulsive

It appears that Municipal Judge Michael Cicconetti, of Painesville, Ohio, is a power drunk jerk, which is all the more remarkable since a municipal court judge does not have much in the way of power.

In any case, ordered three men charged with soliciting sex to take turns dressing in a bright yellow chicken costume while carrying a sign that reads “No Chicken Ranch in Painesville.”

I’d call him a schmuck, but a schmuck has a head.

This might be a cute movie, or a funny Simpsons episode, but in real life it’s an example of abuse of power, and this is not the first time:

It’s not the first time Cicconetti has used barnyard animals in his sentences. He ordered a man who called a policeman a pig to stand next to a live pig in a pen and hold a sign that read “This Is Not a Police Officer.” A couple who stole a baby Jesus statue from a manger were sentenced to dress as Mary and Joseph and walk with a donkey.

I’m upset at the tone of the story too, that says we are all supposed to laugh about it.

Professional misconduct is nothing to laugh about.

The US Government Wants to Record Religion, Sex Habits, and Politics

The Grauniad has a the scoop on what the US Government wants for Britons coming to the US.

Highly sensitive information about the religious beliefs, political opinions and even the sex life of Europeans traveling to the United States is to be made available to US authorities when the European Commission agrees to a new system of checking passengers.

It appears that the EU is upset about this agreement. So am I.

Eventually, Karl Rove is going to want to get his hands on this sort of information for political micro targeting, and considering that we know that DHS has been compromised politically, he will get this information too.

Europe to RIAA: Eat My Shorts

According to The Register, Advocate General Juliane Kokott, adviser to the European Court, reckons European internet service providers are not obliged to hand over subscriber information when approached by record labels pursuing civil cases. The information should be handed over in a criminal case.

This is not a court ruling, but it is likely to be the opinion adopted by the European court.

It turns out that the Bush administration forbade the Surgeon General from going to the special Olympics.

The reason given?

Why couldn’t he attend? Because of the games’ association with a certain “prominent family.”

Take a breath and contemplate this. The nation’s top health officer wanted to go to a completely non-political event and pin a few medals on the proud chests of disabled kids. And he was barred from doing so because showing up would have constituted lending aid and comfort to the Kennedys.

GIG HARBOR, Wash. — A girl caught kissing her girlfriend on a school security camera says the videotape should have never been shown to her friend’s parents.

Seventeen-year-old Jenna Johnson and her mother say Gig Harbor High School invaded Jenna’s privacy.

“I think it was really misinterpreted because it was just a little kiss, and they brought religion into it and it shouldn’t have happened this way,” Jenna said.

Her mother, Deborah Johnson, said she thinks it never would have happened if it was a video of a boy and a girl.

An unemployed single mom with health problems has renewed her legal challenge of the Recording Industry Ass. of America (RIAA) with unseemly new details. They include accusations that the cartel’s goons tried to contact the woman’s 10-year-old daughter at school by impersonating the girl’s grandmother on the phone.

RIAA agents pursuing bogus copyright violations also called the apartment of Tanya Andersen looking for her daughter Kylee and demanded they take the girl’s deposition, according to a complaint filed last week in federal court in Portland, Oregon.

Later, during settlement discussions, the RIAA told Andersen she had to abandon all legal rights she may have in a countersuit or the association would once again demand to “interrogate and confront her little girl at the offices of the RIAA lawyers,” according to the suit.

This crosses so many lines, both ethically and legally.

“Defendants’ lawyer threatened persecution of Kylee in an effort to force Ms. Andersen to abandon her counterclaims against the defendant record companies,” Andersen’s complaint claims. “Their demand for face-to-face confrontation with Ms. Andersen’s then 10 year-old child in a deposition at the offices of RIAA lawyers were also intended to coerce and threaten her.”

She going RICO on all this. I hope that some goes Abu Ghraib on these bastards.

Careful readers will remember Andersen, now 44 years old, countersued the RIAA (http://www.theregister.com/2005/10/04/riaa_sued/) in late 2005 after being accused of illegally downloading gangster rap tunes such as “Shake that Ass Bitch,” “Bullet in the Head,” “I Stab People” and several with titles that even we cannot publish.

Her counterclaims equated the RIAA to thugs that knowingly employed illegal investigative methods and pursued factually flawed charges. Suing under state and federal Racketeer Influenced and Corrupt Organization laws designed to target organized crime rings, Andersen became something of a folk hero for her refusal to submit to the 800-pound gorilla.

Democratic presidential candidate John Edwards on Wednesday encouraged his supporters to donate to his campaign in response to “hateful” comments from conservative author Ann Coulter.

Edwards made his first comments to The Associated Press in response to Coulter’s suggestion that she wished he would be “killed in a terrorist assassination plot.” His campaign cited her remarks in two e-mails and a telephone text message to supporters for donations, with the fundraising deadline on Saturday.

It’s not the first time Coulter has given the Edwards campaign a financial boost. In March, she called Edwards a “faggot” and the campaign used video of the comment to help raise $300,000 before the end of the first quarter.

In the e-mails, the campaign asked supporters to send donations to defy her remarks and help Edwards meet his goal of raising $9 million in the second quarter. The first e-mail from campaign adviser Joe Trippi showed a clip of Coulter on ABC’s “Good Morning America,” where she made the comments on Monday.

An Australian government plan to ban alcohol and pornography in Aboriginal communities to try to curb rampant child sexual abuse was labelled racist and knee-jerk by indigenous groups Friday.

Prime Minister John Howard announced the unprecedented measures on Thursday following a government report detailing paedophilia and juvenile prostitution in Aboriginal communities across Australia’s vast Northern Territory.

As government ministers appealed on national television for health professionals to help solve what Howard described as a “national emergency”, critics said Canberra’s plan had been hastily prepared and poorly thought out.

Indigenous activist Michael Mansell accused Howard of trying to stir hysteria against Aborigines ahead of national elections later this year, where the prime minister’s conservative government will seek a fifth term in office.

Mansell said the government’s plans singled out Aborigines.

“It would be different if his social behaviour strategy applied to everyone in Australia, but it doesn’t, making his policies racist,” said Mansell, the director of the Tasmanian Aboriginal Centre.

“This is a racist attack on the weak and an immoral abuse of power, amounting to nothing more than political vote scoring.”

WASHINGTON — For months, the Justice Department and Atty. Gen. Alberto R. Gonzales have taken political heat for the purge of eight U.S. attorneys last year.

Now the fallout is starting to hit the department in federal courtrooms around the country.

Defense lawyers in a growing number of cases are raising questions about the motives of government lawyers who have brought charges against their clients. In court papers, they are citing the furor over the U.S. attorney dismissals as evidence that their cases may have been infected by politics.

Justice officials say those concerns are unfounded and constitute desperate measures by desperate defendants. But the affair has given defendants and their lawyers some new energy, which is complicating life for the prosecutors.

Missouri lawyers have invoked the controversy in challenging last year’s indictment of a company owned by a prominent Democrat, on suspicion of violating federal wage and hour laws. The indictment, which came two months after the owner announced that she was running for political office, was obtained by a Republican U.S. attorney who also has been criticized because he charged workers for a left-leaning political group on the eve of the 2006 midterm election.

A lawyer in a child pornography case recently defended his client at a federal trial in Minnesota in part by questioning the motives of the Republican U.S. attorney, who has come under scrutiny in the congressional investigation into the prosecutor purge.

Lawyers for a former county official in Delaware who has been accused of corruption asked a judge in early May to allow them to subpoena the Justice Department and White House for documents to see whether political motives factored into charges being brought against the official. They cited the brewing controversy inside the Beltway.

“Those revelations dramatically reinforce the reasons to believe that considerations beyond mere law enforcement are behind this prosecution,” the lawyers wrote.

The defendant, a once up-and-coming Democrat, was being prosecuted by the U.S. attorney in Wilmington, a Republican appointee.

But Democrats say there is evidence that the dismissals were part of a Bush administration effort to affect investigations in public corruption and voting cases that would assist Republicans. The probe has also shown that politics may have played a role in the hiring of some career Justice employees, in possible violation of federal law.

The controversy has drained morale from U.S. attorney offices around the country. And now, legal experts and former Justice Department officials say, it is casting a shadow over the integrity of the department and its corps of career prosecutors in court.

There has long been a presumption that, because they represented the Justice Department, prosecutors had no political agenda and their word could be trusted. But some legal experts say the controversy threatens to undermine their credibility.

“It provides defendants an opportunity to make an argument that would not have been made two years ago,” said Daniel J. French, a former U.S. attorney in Albany, N.Y. “It has a tremendously corrosive effect.”

Defense lawyers in political corruption cases often argue to juries that the prosecution was motivated by politics, especially when the prosecutor happens to be of a different political party than the defendant.

“I think we’ve got to be prepared to take aggressive military action against the Iranians to stop them from killing Americans in Iraq,” Mr. Lieberman said in an interview on the CBS News program “Face the Nation.”
