The controversial “lesbian-lizard” kiss in Saturday’s Doctor Who episode will not be investigated by the media regulator, which said it “did not discriminate between scenes involving opposite sex and same-sex couples”.

Six people complained to Ofcom after Saturday’s series opener, Peter Capaldi’s first full episode as the Doctor, in which lizard woman Madame Vastra kissed her human wife, Jenny Flint.

The pair, played by Neve McIntosh and Catrin Stewart, shared a kiss as they were forced to hold their breath as they hid from killer droids, prompting complaints from some viewers that it was “gratuitous” and “unnecessary”.

A spokeman for Ofcom said: “Ofcom can confirm it received six complaints about a kiss broadcast in an episode of Doctor Who on Saturday 23 August.

“Having assessed the complaints, we can confirm that they do not raise issues warranting further investigation. Our rules do not discriminate between scenes involving opposite sex and same sex couples.”

What a bunch of f%$#ing wankers.

Head bigot at the rabidly homophobic group Texas Values, Jonathan Saenz appears to have a personal reason for his animus against other people’s happiness, his wife left him for another woman:

Mere months before Jonathan Saenz became president of the anti-gay group Texas Values, his wife left him for another woman, according to Hays County district court records obtained by Lone Star Q.

The revelation could help explain Saenz’s seemingly abrupt transformation from socially conservative lobbyist to homophobic firebrand.

Saenz, a devout Catholic, has been a right-wing operative in Texas for many years — working on abortion and religious liberty cases as a staff attorney for the Plano-based Liberty Legal Institute as far back as 2005.

However, it wasn’t until recently that Saenz emerged as one of the state’s best-known — and most extreme — anti-LGBT voices.

Court records indicate that Saenz’s ex-wife, Corrine Morris Rodriguez Saenz, is a member of the LGBT community who was dating another woman when she filed for divorce from Saenz in August 2011.

In early 2012, with their divorce still pending, Saenz would take the helm of Texas Values after the organization spun off from the Liberty Legal Institute, where he’d risen to chief lobbyist.

With Saenz as president, Texas Values has led the charge against not only same-sex marriage, but also passage of LGBT-inclusive nondiscrimination ordinances in San Antonio and Houston. In fighting the ordinances, Saenz has often repeated the debunked right-wing myth that sexual predators would use the laws to prey on women and children in bathrooms.

All this while going through a “War of the Roses” style brutal divorce.

Seriously, are there any professional conservatives out there who aren’t complete nutjobs?

The Uganda constitutional court has ruled their Kill the Gays (lite) bill unconstitutional:

Gay rights campaigners in Uganda and around the world are celebrating a decision by the country’s constitutional court to strike down a widely condemned anti-gay law on a legal technicality.

Activists in the courtroom cheered after a panel of five judges ruled on Friday that the speaker of parliament acted illegally when she allowed a vote on the measure despite at least three objections that not enough MPs were in attendance.

“The speaker was obliged to ensure that there was quorum,” the court said in its ruling. “We come to the conclusion that she acted illegally.”

While celebrating the ruling, activists warned that homosexuality remained a criminal offence in the east African country under colonial-era laws.

While much of the blame for this rests on the politicians of Uganda, who are, after all, human beings with their own capability of agency, but I really do think that we should be investigating members of “The Family” in the United States for conspiracy to commit genocide.  (Click the link, the Family is a scary bunch of people)

It’s nice that Uganda cannot throw people convicted of “aggravated homosexuality” into jail for life, but it would be nicer still if they were to repeal the colonial-era laws.

For Once, Obama Declines to Split the Baby (Fabulous!)

After the failure of Congress to pass any LGBT civil rights legislation, Obama has signed an executive order banning it for government contractors.

The surprising bit is that despite entreaties from the religion-as-an-excuse-to-be-a-bigot crowd, the executive order does not grant a religious exemption:

President Obama, resisting calls from several prominent faith leaders, will not include a new exemption for religiously affiliated government contractors when he issues an executive order Monday barring discrimination on the basis of sexual orientation and gender identity, the White House said Friday.

Obama announced last month that he would sign such an order after concluding that Congress was not going to act on a broader measure prohibiting discrimination based on sexual discrimination or gender identity by companies.

Since then, faith leaders have urged him to include an exemption for government contractors with a religious affiliation, such as some social service agencies.

White House officials said Friday that the new executive order would not include such an exception. But Obama will preserve an exemption put in place by former president George W. Bush that allows religiously affiliated contractors to favor employees of a certain religion in making hiring decisions.

Gay rights organizations have criticized that earlier exemption, and they celebrated news Friday that Obama would not be broadening it.

“With the strokes of a pen, the president will have a very real and immediate impact on the lives of millions of LGBT people across the country,” said Chad Griffin, president of the Human Rights Campaign, a gay rights group.

I think that one of the consequences of the Hobby Lobby decision is the understanding that accommodation of the Talibaptist crowd is a losing proposition.

I’ve thought this for a while.

People who use religion as a, “Veil under which anger can be legitimatized,” to are a part of the problem, not a part of the solution.

This week, in the Hobby Lobby case, the Supreme Court ruled that a religious employer could not be required to provide employees with certain types of contraception. That decision is beginning to reverberate: A group of faith leaders is urging the Obama administration to include a religious exemption in a forthcoming LGBT anti-discrimination action.

 Their call, in a letter sent to the White House Tuesday, attempts to capitalize on the Supreme Court case by arguing that it shows the administration must show more deference to the prerogatives of religion.

 “We are asking that an extension of protection for one group not come at the expense of faith communities whose religious identity and beliefs motivate them to serve those in need,” the letter states.

I am so ready for Antonin Scalia to choke to death on his own bile and be replaced by a justice who is not an unethical hack.

Wisconsin Attorney General J.B. Van Hollen said Thursday that same-sex couples who have wed in recent days are not married in the eyes of the law and that county clerks issuing marriage licenses to gay and lesbian couples could be prosecuted.

Also Thursday, Republican Gov. Scott Walker backed Van Hollen’s work defending the gay marriage ban but sidestepped questions on whether clerks should be charged and what his personal views on gay marriage are now.

Three district attorneys running for attorney general — two Democrats and a Republican — said they would not issue charges against clerks and their area. A Democratic state representative running to succeed Van Hollen also criticized the idea of issuing charges.

“You do have many people in Wisconsin basically taking the law into their own hands and there can be legal repercussions for that,” Van Hollen said in an interview with the Milwaukee Journal Sentinel. “So, depending on who believes they’re married under the law and who doesn’t believe they’re married under the law may cause them to get themselves in some legal problems that I think are going to take years for them and the courts to work out.”

The Republican attorney general said he did not believe same-sex couples could be prosecuted but that county clerks risked charges.

County clerks can be jailed for up to nine months and fined up to $10,000 for issuing marriage licenses that aren’t allowed under state law. The same section of the statutes also provides penalties for judges, ministers and others who officiate over a “fictitious marriage,” but Van Hollen did not address whether they could be charged.

United States District Judge Barbara Crabb last week declared that Wisconsin’s ban on same-sex marriage violated the U.S. Constitution’s guarantee of equal protection of the law. She has not yet entered an injunction instructing public officials what to do about her finding.

After all, who has to listen to some judge anyway?

Not only did a federal judge overturn Pennsylvania’s gay marriage ban, but he cited Antonin Scalia in his opinion:

Upon striking down Pennsylvania’s gay marriage ban Tuesday, a federal judge cited Justice Antonin Scalia’s “cogen[t]” argument that the Supreme Court had essentially paved the way for nationwide marriage equality last year.
Here’s the relevant passage from George W. Bush-appointed Judge John E. Jones III in his 39-page opinion:

As Justice Scalia cogently remarked in his dissent, “if [Windsor] is meant to be an equal-protection opinion, it is a confusing one.” Windsor, 133 S. Ct. at 2706 (Scalia, J., dissenting). Although Windsor did not identify the appropriate level of scrutiny, its discussion is manifestly not representative of deferential review. See id. (Scalia, J., dissenting) (observing that “the Court certainly does not apply anything that resembles [the rational-basis] framework” (emphasis omitted)). The Court did not evaluate hypothetical justifications for the law but rather focused on the harm resulting from DOMA, which is inharmonious with deferential review.

It was a reference to Scalia’s scathing dissent against the Court’s 5-4 opinion that struck down a portion of the Defense of Marriage Act which prohibited federal recognition of same-sex marriages. The Reagan-appointed justice warned that the majority decision — despite officially staying neutral on whether gay marriage was a Constitutional right — relied upon reasoning that would lead to that conclusion.

I will note that referencing a minority opinion does not seem to me to be a common thing, (Note however, that I an engineer, not a lawyer, dammit*) but this is the 2nd or 3rd time that a judge has cited Scalia in making a decision invalidating a gay marriage ban.

I’m beginning to think that the Federal Judiciary is conspiring to offer a very well deserved f%$# you to Fat Tony Scalia.

Gay Marriage is legal in Oregon:

Today Judge Michael McShane struck down Oregon’s discriminatory state constitutional amendment that denies committed gay couples the freedom to marry, ruling that it violates the U.S. Constitution. The ruling is the 17th consecutive victory in state and federal court for the freedom to marry since the U.S. Supreme Court’s ruling in Windsor v. United States in June 2013. The ruling is the 13th win in federal court for marriage since June.

The order is effective immediately – meaning that today, same-sex couples across the state will be able to marry!

Why the Boy Scouts Leadership Need to be Fired, and it Offices Should Moved from Texas to a Civilized Place

There is was a boy scout troop in the Seattle area whose leader is openly gay, and BSA ejected him from the scouts.

When the church at which his troops were based refused to discharge him, because they oppose discrimination, and the BSA closed down those troops:

In a startling and discriminatory move, the Boy Scouts of America (BSA) revoked the charter of Seattle Troop 98 and Pack 98 for its refusal to remove gay Scoutmaster Geoffrey McGrath. The BSA revoked the charter of Rainier Beach United Methodist Church’s (RBUMC), a Seattle church whose two Scouting units serve a neighborhood with few other positive opportunities for local youth.

“The Boy Scouts’ decisions only serve to hurt a group of boys who need the values and leadership of someone like Scoutmaster McGrath,” said Zach Wahls, Executive Director of Scouts for Equality, a national organization dedicated to ending the BSA’s ban on gay members and leaders. “Unfortunately, the BSA’s decision calls into question its commitment to leadership and values by perpetuating an outmoded policy rooted in fear and discrimination. History will show that today’s announcement is a self-inflicted wound.”

The controversy surrounding Troop 98 emerged in March, when an NBC News report on the inclusive troop prompted the BSA to question the sexual orientation of Scoutmaster Geoffrey McGrath. McGrath, abiding by the Scout’s commitment to trustworthiness, acknowledged his sexual orientation to the BSA, which in turn, responded by revoking McGrath’s status as Scoutmaster.

Since then, support for McGrath has been overwhelmingly positive. The entire Seattle City Council, as well as more than 20 Washington State legislators, have expressed their support for Rainier Beach United Methodist Church’s right to determine its own leadership for McGrath’s ability to remain a Scoutmaster. Most important, RBUMC Rev. Dr. Monica Corsaro has stood by McGrath and has refused to remove him from his post. BSA is taking this action in direct contradiction to the inclusive religious beliefs and wishes of Rainer Beach Methodist Church.

It makes no sense to support the BSA until the leadership gets its head out of its collective asses.

If they are sponsored by your house of worship, or your church, you should consider finding some other organization that better represents a moral view of our society.

The lawyer who defended the H8 amendment (Prop 8) in California, has “evolved” now that his daughter has come out:

The lawyer who argued before the Supreme Court in favour of upholding California’s ban on gay marriage learned while he was handling the case that one of his children is gay and now is helping her plan her wedding with another woman.

Attorney Charles Cooper says his view of same-sex marriage is evolving after having argued in court that gay unions could undermine marriages between a man and a woman.

The revelation is an unexpected footnote in the years-long debate over Proposition 8, the California measure struck down by the Supreme Court last year. It is also offers a glimpse, through the eyes of one family, of the country’s rapidly shifting opinions of gay marriage, with most public polls now showing majorities in favour of allowing the unions.

Cooper learned that his stepdaughter Ashley was gay as the Proposition 8 case wound its way through appellate court, according to a forthcoming book about the lengthy legal battle. And with the Supreme Court ruling now behind him, Cooper cast his personal opinion on gay marriage as an evolving process.

“My views evolve on issues of this kind the same way as other people’s do, and how I view this down the road may not be the way I view it now, or how I viewed it ten years ago,” Cooper said in journalist Jo Becker’s book “Forcing the Spring: Inside the Fight for Marriage Equality.”

Seriously, how many times has this happened?

Mozilla Cuts Its Losses

Brendan Eich is out as Mozilla Corporation CEO:

Less than two weeks after drawing controversy over his appointment as CEO of the Mozilla Corporation, Brendan Eich has resigned from the position.

In a post at Mozilla’s official blog, executive chairwoman Mitchell Baker confirmed the news with an unequivocal apology on the company’s behalf. “Mozilla prides itself on being held to a different standard and, this past week, we didn’t live up to it,” Baker wrote. “We didn’t act like you’d expect Mozilla to act. We didn’t move fast enough to engage with people once the controversy started. We’re sorry. We must do better.”

The action comes days after dating site OKCupid became the most vocal opponent of Eich’s hiring. Mozilla offered repeated statements about LGBT inclusivity within the company over the past two weeks, but those never came with a specific response from Eich about his thousands of dollars of donations in support of Proposition 8, a California ballot measure that sought to ban gay marriage in the state.

Eich’s bigotry has been an issue before, and for some reason known only to the Flying Spaghetti Monster, they decided to make him the face of the organization.

It was further compounded when Eich refused to offer anything vaguely resembling a sincere apology, and instead offered platitudes about how tolerant people needed to validate his bigotry.

Don’t let this door hit your ass on the way out.

The Ukrainian parliament is rushing to pass anti-gay legislation:

Kiev is getting back to normal. Downtown streets that just one month ago looked like battlefields are now full of busy crowds and tourists. In one of the newly revitalized city squares, I met Olena Shevchenko, an LGBT-activist-turned-revolutionary. I had heard a lot of about her—an openly gay woman who managed to form a female-only military unit. Some call them the “Maidan Amazons.”

Olena joined the revolution in its very first days, but the idea to form a women-only “sotnya” (a Cossack term for a group of one hundred fighters) came a bit later, as a response to rising sexism within Maidan (Independence) Square. The women in Maidan Square were being asked to make sandwiches; meanwhile, they had been building the barricades.

At the start, Olena had only eight women in her military unit (mostly human rights activists from feminist or LGBT groups). But thanks to social media, the number rose to 500 people in Independence Square and more than 1,500 at other locations. (For comparison, the right-wing Right Sector, had around 2,500 fighters in downtown Kiev on a regular basis.) “It was amazing, because ‘feminism’ is still a dirty word in Ukraine,” she says, “the same as ‘gay.’”

First, many open homophobes are still among the country’s top-officials. Interim President Oleksandr Turchynov (also a Baptist preacher) famously said, back in 2007, “If a man has normal views, then you label him a conservative, but those who use drugs or promote sodomy—you label them a progressive person. All of these are perversions.” Several leaders from the far-right Ukrainian nationalist party, Svoboda, have been given ministerial posts in the post-revolution government, including the vice-prime minister position. In fairness, Svoboda has toned down its anti-gay rhetoric in recent months. One of the party’s MPs, Yuriy Syrotyuk, called the first gay pride parade in Kiev “an act of aggression” against Ukraine in 2012, but now presents a more moderate, if still limited, position. “We respect rights of all minorities, but LGBT legalization will blow up this country,” he stated in an interview. “If we take this discussion to the parliament, not only Crimea will secede, but Ukrainian provinces will also start to leave the country.”

The new government is also actively trying to block an anti-discrimination law that would protect LGBT people in workplaces. This piece of legislation, pushed as part of integration talks with EU is, frankly, the only progressive thing to happen for the local gay community since 1991, when Ukraine became the first post-Soviet country to decriminalize homosexuality. (Some opponents of the law argue that support for it would give Russia a cart-blanche; in the past, the Kremlin has showed amazing capabilities to organize quickly and effectively against any kind of gay movement inside Ukraine.) Now, a law similar to the Russian’s “gay propaganda” law—which criminalizes even discussion of gay rights—is pending in the Ukrainian parliament.

When Someone Defines Tolerance as Accepting His Own Bigotry, He is a Hypocrite and a Fool

Case in point, the self-immolation of Mozilla because they chose to hire an homophobic bigot as CEO:

Mozilla named a new chief executive this week to lead the non-profit Web organization as it tries to keep its Firefox browser relevant in the mobile age. The appointment has proved controversial in more ways than one.

 Three Mozilla board members resigned over the choice of Brendan Eich, a Mozilla co-founder, as the new CEO. Gary Kovacs, a former Mozilla CEO who runs online security company AVG Technologies; John Lilly, another former Mozilla CEO now a partner at venture-capital firm Greylock Partners; and Ellen Siminoff, CEO of online education startup Shmoop, left the board last week.

 The departures leave three people on the Mozilla board: co-founder Mitchell Baker; Reid Hoffman, co-founder of LinkedIn, and Katharina Borchert, chief executive of German news site Spiegel Online.

 The three board members who resigned sought a CEO from outside Mozilla with experience in the mobile industry who could help expand the organization’s Firefox OS mobile-operating system and balance the skills of co-founders Eich and Baker, the people familiar with the situation said. They did not want to be identified because they are not authorized to speak publicly about the matter.

 Mozilla spokesman Mike Manning confirmed the three remaining board members, but he declined to comment further on Friday. He did not immediately respond to a request to speak to Eich and Baker.

 The board departures are not the only source of early pressure on the new Mozilla CEO. Some employees of the organization are calling for Eich to step down because he donated $1,000 to the campaign in support of Proposition 8, a 2008 California ballot measure that banned same-sex marriage in the state.

 “I do not support the Board’s appointment of @BrendanEich as CEO,” Kat Braybrooke, a curation and co-design lead at the organization, wrote on Twitter on Thursday:

The problem is that Brendan Eich have $1000 to the H8 amendment, aka Proposition 8, the anti-gay marriage initiative in California, and when this was revealed, his response was to suggest that people should be more tolerant about this.

That is complete bullsh%$.

While I agree with 1st amendment argument  protecting his right to engage in this sort of speech, it is wrong to suggest that his opponents should accept him to, “make Mozilla a place of equality and welcome for all.”

Social, opprobrium is precisely the sort of response that comes from an open marketplace of ideas.

And NPR, they Suck Too

They put a holocaust revisionist who calls for genocide of the gays, and they neglect to mention these facts to their listeners:

National Public Radio’s Michel Martin did a segment on Uganda’s growing crackdown on its gay population, and decided to interview Holocaust-revisionist hate-group leader Scott Lively, who is truly one of the most horrific religious right extremists in America.

How did NPR’s Michel Martin describe Lively to her audience? Simply as “Evangelical leader Scott Lively.”

That’s it.

No mention of the fact that Lively was labeled a Holocaust revisionist by HateWatch for his “thoroughly-discredited” 1995 tome, “The Pink Swastika,” which tried to argue that gays were the really force behind the Holocaust.

No mention of Lively’s organization, Abiding Truth Ministries, that was officially-designated a “hate group” by the Southern Poverty Law Center.

He was extensively involved in Uganda’s proposed “Kill the Gays” bill, and the now just passed “Jail the Gays” bill.

You don’t just call him “Evangelical leader Scott Lively.” At the very least you call him a controversial anti-gay activist, unless you are so cowed by the Talibaptists that you should quit journalism and take up knitting.

The mayors of Boston and New York are boycotting their respective St. Patrick’s Day Parades because of the organizer’s homophobic policies:

Boston Mayor Martin Walsh is threatening to boycott the St. Patrick’s Day parade unless organizers allow a group of gay military veterans to march, joining New York’s mayor in protesting parade policies on gay groups.

Walsh, the son of Irish immigrants, said Thursday he’s been trying to broker a deal with the city’s parade organizers to allow a gay veterans group sponsored by MassEquality to march in this year’s parade. He said allowing gay groups to participate is long overdue.

“It’s 2014 — it’s far beyond the time where we should be even having this discussion because they’re veterans who fought for this country just like any other veteran,” Walsh said.

“I made a commitment during the campaign … that I would fight for equality and that’s what this is all about.”

But parade planners appeared unwilling to budge.

Lead parade organizer Philip Wuschke Jr. said gay people are not prohibited from marching with other groups. But he said organizers do not want the parade to turn into a demonstration for a particular group.

“The theme of the parade is St. Patrick’s Day. It is not a sexually oriented parade,” he said. “All we want to do is have a happy parade. The parade is a day of celebration, not demonstration.”

In New York, Mayor Bill de Blasio said he will skip the nation’s largest St. Patrick’s Day parade in Manhattan because participants are not allowed to carry signs or banners identifying themselves as gay.

“I will be participating in a number of other events to honor the Irish heritage of this city,” de Blasio said during a press conference earlier this month. “But I simply disagree with the organizers of that parade.”

Let the bigots stew in their own hate alone.

Jack Burkman, a long time right wing lobbyist is writing legislation to ban gays from the NFL:

“Imagine your son being forced to shower with a gay man,” Burkman said in a statement. “That’s a horrifying prospect for every mom in the country. What in the world has this nation come to?”

Of course, your son is already showering with gay men in gym class, at the health club, in the US military, in the NFL, and in the US Congress. The only difference is that in some of those places, your son is simply not aware of who the gay guy is. The NFL being more welcoming to gays won’t change the simple fact that just because you don’t know who’s gay, doesn’t mean the gay men aren’t already there.

Normally, I would say that kicker to this story is that his brother James is gay and out, and thinks that Jack is an asshole:

But this is not the kicker to this story.

The kicker to the story was that he was on the DC Madame’s phone list.

So, Jack was a ……… John. (He denies it ……… Yeah ……… Sure)

Former Bush Aide Matt Dowd Goes There

He compares the anti-gay right to Islamic Terrorists.

Of interest is his invocation of the history of religious justifications supporting slavery:

“This is one of those problems when people use religion as a way to sort of enforce discriminatory practices,” he continued. “People used religion back in the 1860s when they defended slavery. They used religion to defend slavery.”

 “We’ve used religion to go to war. People have criticized Islam because they use religion to fight people and kill people. This is the problem with that [bill].”

That first bit seems to me to be a subtle slam at the Southern Baptists, whose genesis was a schism with the American Baptists over the morality of slavery. (The Southern Baptists were on the wrong side of the argument.)

I’m not quite sure what, if anything, was his intent in saying this, but I agree with Max Blumenthal’s analysis, which is that Dowd is primarily an opportunist, so I think that there is some sort of an angle on this.

New York City Mayor Bill de Blasio (D) on Tuesday said that he will not march in the city’s annual St. Patrick’s Day parade because organizers of the event will not allow participants to carry gay pride signs.
