Earmning a Capitalism Merit Badge

An enterprising Girl Scout set up shop selling cookies outside a marijuana dispensary:

It’s that time of year again. Time when your local market entrances are flooded with Girl Scouts selling boxes of Samoas, Tagalongs and Thin Mints. But one 13-year-old Girl Scout in San Francisco and her mother made a rather business-savvy decision to sell cookies outside of a medical marijuana dispensary.

On Monday, Danielle Lei and her mother set up shop outside the Green Cross store with the cookies. With the store’s blessing, Lei sold 117 boxes in two hours.

Holli Bert, a spokeswoman for the Green Cross, said that after just 45 minutes, Lei had to call for backup cookies to replenish her stock.

Future venture capitalist, I guess.

This is Insanely Sensible

The Virginia AG has set up an task force specifically to go after patent trolls:

Suing a company for patent infringement just got a lot tougher in the state of Virginia.

The state (technically a commonwealth) has created a new legal office focused entirely on patent litigation. Specifically, the state’s Patent Troll Unit will look to extract penalties and legal fees from companies who make unjust patent infringement claims against businesses operating in the state.

The task force will seek out companies who file infringement claims on dubious or vague patents, seeking a quick payout. The legal team, reporting to the Attorney General, will file for injunctions against companies it deems acting in “bad faith” with infringement claims.

“Virginia businesses of all sizes can be targets, from a small, local business up to a large, high-tech firm,” Virginia Attorney General Mark Herring told the local Augusta Free Press.

“Under the bipartisan legislation we were able to help craft last year, my office has strong new enforcement powers and we’re going to use them to protect Virginia businesses from these bad actors.”

Those who believe they are being targeted by a patent troll are being advised to contact the Attorney General’s office with details including the demands of the patent troll, contact information and patent details.

This is an excellent idea.

Defending against a patent troll is frequently expensive, and so companies frequently settle. 

Having the Attorney General’s office on your makes it far less ruinous to fight patent extortion.

Hillary Clinton is Scared, and Debbie Wasserman-Schultz Loses

It appears that the DNC is reversing itself, and there will be more debates:

After days of jostling over whether to meet for more debates, and how many, aides to Hillary Clinton and Senator Bernie Sanders have reached an agreement, of sorts, they said Saturday: The two will meet next week in New Hampshire and will hold three more debates thereafter.

A Clinton aide, speaking on the condition of anonymity to discuss continuing negotiations, confirmed the tentative agreement for four additional debates, which was first reported by BuzzFeed.

The two campaigns have engaged in a measure of brinkmanship in recent days, with Mr. Sanders’s team one-upping Mrs. Clinton’s by saying it would agree to an additional debate in New Hampshire if her team agreed to more beyond that.

Michael Briggs, a Sanders spokesman, said the agreement was still being discussed. “I’m optimistic,” he said, but he added, “The details are still being worked out.”

The Democratic National Committee has yet to weigh in on whether it would sanction the added debates.

The New Hampshire debate next week was originally scheduled as an unsanctioned one, sponsored by MSNBC and the New Hampshire Union Leader newspaper. But a Democratic National Committee official said The Union Leader would not be a sponsor.

Still, it would mean a highly watched showdown between Mrs. Clinton and Mr. Sanders before the Feb. 9 primary in New Hampshire.

After working in 2015 to restrict the number of debates, Mrs. Clinton’s team has since expressed regret about that as Mr. Sanders surged in the polls, especially because she has generally delivered strong performances in the debates.

I don’t know who wins in this arrangement.

Clinton is clearly more comfortable debating, but the more that people see of Sanders, the more that they like him. (OK, this is a win for O’Malley, because he has nothing to lose in the debates, and everything to gain)

I can tell you who loses, however, Debbie Wasserman-Schultz, the incompetent and widely loathed head of the DNC, who had been steadfast in resisting debates after scheduling a pittance on weekends up against things like NFL playoff games.

Taking a Prank That Necessary Extra Step

As you are no doubt aware, the terrorists occupying the Malheur sanctuary offices in Oregon have been asking for people to send them stuff so that they can maintain their presence.

They’ve asked for things like food and warm clothing, what they have been getting is dildos and other sex toys.

Well, Max Temkin, co-creator of the game Cards Against Humanity, saw this as problematic, so he sent the protesters a 55 gallon drum of Passion Natural Water Based Lubricant.

Ripper Patent Rulling In Oz

The Australian Supreme Court just completely slapped down gene patents, which, with a bit of common sense, should be an end to that particular abomination in IP land:

Australia’s highest court has ruled unanimously that a version of a gene that is linked to an increased risk for breast cancer cannot be patented. The case was brought by 69-year-old pensioner from Queensland, Yvonne D’Arcy, who had taken the US company Myriad Genetics to court over its patent for mutations in the BRCA1 gene that increase the probability of breast and ovarian cancer developing, as The Sydney Morning Herald reports. Although she lost twice in the lower courts, the High Court of Australia allowed her appeal, ruling that a gene was not a “patentable invention.”

The court based its reasoning (PDF) on the fact that, although an isolated gene such as BRCA1 was “a product of human action, it was the existence of the information stored in the relevant sequences that was an essential element of the invention as claimed.” Since the information stored in the DNA as a sequence of nucleotides was a product of nature, it did not require human action to bring it into existence, and therefore could not be patented.

Although that seems a sensible ruling, the pharmaceutical and biotechnology industry has been fighting against this self-evident logic for years. The view that genes could be patented suffered a major defeat in 2013, when the US Supreme Court struck down Myriad Genetics’ patents on the genes BRCA1 and the similar BRCA2. The industry was hoping that a win in Australia could keep alive the idea that genes could be owned by a company in the form of a patent monopoly. The victory by D’Arcy now makes it highly likely that other judges around the world will take the view that genes cannot be patented.

Striking down gene patents in Australia, as in the US, clears the path for new entrants to the gene testing market, which is likely to drive down prices. It could also spur more biomedical innovation by allowing researchers freedom to investigate previously patented genes and develop new therapies, without fearing potential lawsuits.

If the judgement is followed by courts in other jurisdictions, and the whole idea of gene patents is rejected, the number of people whose lives could be saved will be correspondingly greater.

It has been patently* clear for decades that isolating genes is a process of discovery, and not invention, and hence they should not be covered by patents.

The biotech industry’s counter-argument has always been, “But we want our money!:

In a statement, Myriad also expresses its disappointment with the ruling. “The High Court’s decision comes at a critical time when we’re entering the golden era of personalized medicine,” it says, as GenomeWeb reports. “In order for personalized medicine to become a reality, strong patent protection is essential because it provides the research-based companies like Myriad with an incentive to continue to invest in R&D.”

Basically, they are arguing that if we won’t allow them to patent their discoveries, they will take their marbles and go home.

There are two things wrong with this:

  • Patents are for inventions, not discoveries.
  • Allowing for rent seeking through patents makes it more likely that genetic products will will be released without adequate testing, because the potential profits are so huge.

And that is ignoring the fact that it is taxpayer funded research that have led to these discoveries.

In Addition to Being a True Patriot, Edward Snowden Is Wicked Cool

He just showed up in robot form on Neil Degrasse Tyson’s podcast to explain why we have not been contacted by aliens:

Whistle-blower Edward Snowden has some strong opinions on communications — even when those communications are coming from aliens.

The former intelligence-agency contractor turned fugitive was an unexpected guest on famous astrophysicist Neil deGrasse Tyson’s StarTalk podcast on September 18. And, inevitably, the two got to talking about extraterrestrials.

But Tyson scored an interview with him in New York City. How? Snowden rigged a robot that he can control from Russia, and rolled right into Tyson’s office at the Hayden Planetarium in New York with his face displayed on the screen.

The conversation turned to encryption and cybersecurity, but here’s where an astrophysicist differs from a journalist: Tyson’s line of questioning quickly turned to how encryption relates to communication with … aliens.

Tyson asked Snowden if a highly intelligent alien civilization might be communicating with encrypted messages. And Snowden had an unsettling answer.
First, Snowden said, let’s assume that most advanced societies eventually realize that they need to encrypt their communication in order to protect it. This could also be the reason why we’ve never heard from other civilizations — their messages may have just been melding into the background static of the universe.
Here’s Snowden’s full answer, from the StarTalk podcast:

So if you have an alien civilization trying to listen for other civilizations, or our civilization trying to listen for aliens, there’s only one small period in the development of their society when all of their communication will be sent via the most primitive and most unprotected means.
So when we think about everything that we’re hearing through our satellites or everything that they’re hearing from our civilization (if there are indeed aliens out there), all of their communications are encrypted by default.
So what we are hearing, that’s actually an alien television show or, you know, a phone call … is indistinguishable to us from cosmic microwave background radiation.

So it could be possible there are alien messages constantly hitting our satellites, and we just don’t recognize them because they’re so heavily encrypted. (The cosmic microwave background radiation that Snowden mentions is thermal radiation throughout the universe left over from the Big Bang. It basically looks and sounds like static to us puny humans.)

It has now been revealed that before he decided to really run for President, he and Bill Clinton discussed this, and Clinton gave him some advice.

Somehow I think that the current situation, where the the bigotry, xenophobia, and ……… well ……… batsh%$ insanity of the Republican base has been revealed as “The Donald’s” poll numbers continue to skyrocket:

You do not have to love Bill Clinton, or even like him just barely, to agree that this right here is amazesauce awesomeballs THE BEST:

Four Trump allies and one Clinton associate familiar with the exchange said that Clinton encouraged Trump’s efforts to play a larger role in the Republican Party and offered his own views of the political landscape.

Do we think that The Big Dog himself sincerely believes America would benefit from Donald Trump hogging all the Republican primary limelight to proclaim which someones are doing the raping, and how he will make Mexico pay for his fence, by kicking its ass, right in the butt? Or do we imagine the former president making that jerking motion with his hand while he tries not to crack up on the phone as he fondles Trump’s YOOOGE ego right into the race, to the detriment of the GOP, say hello to Madam President? (It’s the second one, we think, what do YOU think?)

I am not a fan of Bill Clinton’s Eisenhower Republican policies, but I do have to admit that he is a master of politics and of people.

I believe that Clinton knew that Trump would be the turd in the Republican punch bowl, and he encouraged Trump to run, even while convincing Trump that it was his idea.

Whether intentional or not, this is an Epic troll.

2 Words: Laser Bacon:

A team of Harvard scientists has paved the way for a deadly laser pig weapon by demonstrating that, with a little encouragement, pig fat cells can be made to lase.

According to MIT Technology Review, Seok Hyun Yun and Matjaž Humar stimulated spheres of fat inside porcine cells with an optical fibre, causing them to emit laser light.

Handily, pig cells contain “nearly perfectly spherical” fat balls, which are conducive to lasing by resonance when supplied with a suitable light source. The team has also cheated the effect by injecting oil droplets into other cells.

Since the bacon laser technique also involves the use of injecting fluorescent dye into the fat cells, the Harvard team could surely have saved themselves some work by using a glow-in-the-dark pig as a test subject. Better still, they could knock up a transgenic shark with fluorescent pig fat cells in its skin, and turn that into one almighty frikkin’ laser.

This is just so chock full of awesome.

The whole family went to the 2015 Artscape, billed as “America’s largest free arts festival!” (Yes they use the exclamation point).

It’s one part an arts festival, one part local music, one part classic Baltimore weirdness, one part corporate PR, one part an enormous concentration of stall food, and one part block party.

A great time was had by all, and on the way home, the Queen song, Bohemian Rhapsody, and, at my prodding, we all sang along.

It was a truly brilliant moment.

BTW, no one caught it on a cell phone video, and if we did, we wouldn’t share it with you.

It’s a family thing.

The Tears of the Cuban Emigre Dead Enders Will Flavor My Cocktail

The US and Cuba are opening up embassies in their respective capitals:

President Barack Obama announced Wednesday that the U.S. and Cuba have struck a deal to open embassies in each other’s capitals and re-establish diplomatic relations for the first time in half a century.

“The progress we make today is another demonstration we don’t have to be imprisoned by the past,” Obama said.

Obama emphasized that the U.S. and Cuba have some shared interests, such as strong anti-terrorism policies and disaster response. But he acknowledged that the two nations still have “very serious differences” on issues like free speech.

“We won’t hesitate to speak out when we see contradiction to those values,” the president said.

According to a statement from the Cuban government, officials are aiming to reopen their embassy on or after July 20. White House deputy national security adviser Ben Rhodes told MSNBC that the U.S. will open its embassy in Cuba “shortly after” July 20.

55 years of mean spirited and counter-productive (the Castros still run the place after 55 years of isolation) foreign policy has ended.

The real pity is that it took so long.

Your Feel Good Story of the Day (With Cats)

Someone has found a way to “re-task” feral cats in animal shelters that would otherwise have to be euthanized have been fixed, and deployed to areas for rodent patrol:

Like the characters played by the actor who inspired his name, Pacino was no scaredy cat. The brown tabby had prowled the streets of Los Angeles, a drifter scraping for his next meal.

After the cat was turned in at an L.A. County animal services shelter, there was little hope that Pacino would be adopted. He was too distrustful, too fierce, too mean.

Then Melya Kaplan came along, looking for a cat with grit, street smarts and attitude.

The 10-pound, 6-ounce cat would become the nighttime warden at the Original L.A. Flower Market, making sure rodents and other vermin didn’t get out of hand. He’s part of a group of tough cats recruited by an animal rights nonprofit to find homes in places that could use their hard-scrabble qualities. Along with another cat named DeNiro, Pacino would prowl the Italian side of the flower market. Of course.

“Mother Nature doesn’t make mistakes,” said Kaplan, executive director of Voice for the Animals. “We probably just haven’t found a purpose for it yet.”
As part of the Working Cats program, street cats like Pacino are rescued from animal shelters and sent to locations ranging from police stations, like the LAPD’s Wilshire and Foothill divisions, to private homes, businesses and schools. Over the years, the program has placed about 500 cats in nearly 50 locations.

Kaplan, a frequent customer of the market, developed the program in 1999 when Carl Jones, a market employee, told her about the rats in the workplace. Exterminators would spray the warehouse with poison, but the vermin remained. Every so often, a customer would spot a pair of beady eyes hidden in the row of flowers.

About 15 years ago, Kaplan made a proposition to Yamabe. She would deliver three cats to the flower market to get rid of the rats. And if they could not take care of the rodents, she would take them back.

The market currently has 15 cats, and Jones and Yamabe said they do not see any rats.

Kaplan attributes the program’s success to the simple fact that adding a predator to an environment will scare away its prey. Once rodents smell a cat on the prowl, they go somewhere else, she said.

“It’s not anything new. People used to have barn cats or church cats to keep out rodents,” Kaplan said. “We just brought [it] to the city, and it seems to be really working.”

Yamabe remembered one gray cat that died after several years of service patrolling the second-floor parking lot. Within days, the rats returned and Yamabe needed to call for another cat.

For a cat like Pacino, living in a warehouse almost certainly adds years to his life. Living on the streets is tough on any sentient being, including a cat. Kaplan said cats that might have lived fewer than five years on the streets can live more than 14 years in a home, business or police station. They’re given meals and the buildings give them protection from bad weather, dogs and cars.

Kaplan said that in time, some of her more veteran cats got used to being around people and became house cats. That, in turn, created space for other cats to be rescued by the program.

“We’re saving cats and helping people. And it’s always great when the two grow closer together and we can place another cat,” she said. “It’s what I call a win-win-win.”

One Map Shows Every State in the US Where You Can Have a Same-Sex Marriage

The Supreme Court has declared gay marriage bans unconstitutional:

Putting itself back in the forefront of the gay rights revolution, the Supreme Court ruled by the narrowest margin on Friday that same-sex couples across the nation have an equal right to marry. The five-to-four decision was based firmly on the Constitution, and thus could be undone only by a formal amendment to the basic document, or a change of mind by a future Supreme Court. Neither is predictable.

Explicitly refusing to hold off deciding the issue to see how other parts of society may deal with the rising demand for gay acceptance and legitimacy, the Court declared that two clauses in the Fourteenth Amendment mean that a “fundamental right to marry” can no longer be denied because the partners are of the same sex. It did not create a new right, but opened a long-existing one to those partners.

The ruling was the most important victory in a cultural revolution that began almost exactly forty-six years ago, when patrons of a gay bar — the Stonewall Inn in New York City’s Greenwich Village — fought back against a police raid. The events that began on the night of June 28, 1969, are widely known as the beginning of “gay pride” and an unapologetic campaign for equality.

The decision in Obergefell v. Hodges expressly overruled the Court’s only prior ruling directly on same-sex marriage — a one-line decision in the 1972 case of Baker v. Nelson, declaring that a claim to such marriage did not raise “a substantial question” for the Court to resolve.

As The Onion puts it, “Scalia, Thomas, Roberts, Alito Suddenly Realize They Will Be Villains In Oscar-Winning Movie One Day“.

I think that you also need to read the last paragraph of the decision, which is really quite beautiful:

No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. In forming a marital union, two people become something greater than once they were. As some of the petitioners in these cases demonstrate, marriage embodies a love that may endure even past death. It would misunderstand these men and women to say they disrespect the idea of marriage. Their plea is that they do respect it, respect it so deeply that they seek to find its fulfillment for themselves. Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. The Constitution grants them that right.
