When an athlete is caught doping, generally I blame the athlete first and foremost.

I make an exception in the case of Kentucky Derby winner Medina Spirit, because sane people to do not assign the same level of agency that they would to a human athlete.

On the other hand, I do ascribe a level of agency to Bob Baffert, Medina Spirit’s trainer, and when he claims that Churchill Downs’ decision to revoke his horses win, and to suspend him is, “Cancel Culture.” 

So says a guy who for Medina Spirit is the, “fifth horse in 13 months to test positive,” and before that his, “Horses have failed 29 drug tests.”

And he’s blaming, “Cancel culture,” for his juicing horses.

He’s a complete tool, but I am grateful to have the opportunity to adopt one of John Mulaney’s best known lines.

There were by-elections in the UK yesterday, and labour completely screwed the pooch, loosing a seat that they have held since its founding 62 years ago.

Jeremy Corbyn is being blamed, because ……… Blairite Labour is sees Boris Johnson and the Tories as the opposition, and people who actually support progressive policies as the enemy.

It is not 1995.  It’s not even 2008.

The great recession changed things, and you are going to get more Boris Johnsons and more Donald Trumps until they stop sucking up to predatory capital as a campaign strategy:

Keir Starmer is facing immediate pressure from the left of Labour to change course after losing the Hartlepool byelection and a string of council seats to the Conservatives.

It came as Boris Johnson, visiting Hartlepool after the Conservatives took the seat for the first time in its 47-year history, said the result – which turned a Labour majority of 3,600 into a Tory win by nearly 7,000 votes, a 16-point swing – was “a mandate” for the government to press on.

While Labour had accepted the early results were likely to be among the worst of the series of votes across England, Scotland and Wales, the immediate message from Starmer and his allies was to push for a more rapid move away from the Jeremy Corbyn era.

Corbyn out-performed expectations in 3 of 4 elections with the party infrastructure actively sabotaging him.

You followed that up with party purges against him and his supporters.

If you think that the problem is that you are not moving fast enough away from Corbyn, you are delusional.

Diane Abbott, who was shadow home secretary under Corbyn, tweeted: “Keir Starmer must think again about his strategy.” She added: “Crushing defeat for Labour in Hartlepool. Not possible to blame Jeremy Corbyn for this result. Labour won the seat twice under his leadership.”

Richard Burgon, the Leeds East MP who was shadow justice secretary under Corbyn, said Starmer’s team “needs to urgently change direction”. He tweeted: “It should start by championing the popular policies in our recent manifestos – backed by a large majority of voters.”

A spokesman for Momentum, the Corbyn-allied Labour group, said: “The leadership are reacting to this disaster by promising ‘more change’ – but over the last year we’ve gone backwards. It’s time to change direction, not double down on a failed strategy.”

They are going to double down on a failed strategy, because playing to win means that they lose power within the party. 

One of Tony Blair’s “innovations” for Labour was the imposition of a top-down process in selecting MPs in many seats, and if the left takes power, and has the guts to deal with members more interested in power IN the party than the power OF the party, their positions will be far less secure.

Context on the Dental Floss

Montana Governor Greg Gianforte is ending his state’s participation in the federal program increasing unemployment payments, because he thinks that it makes people too lazy.

Instead, he’s offering a one time limited offer of an “Employment Bonus.”

This is unbelievably and deeply stupid policy, as well as being stupid politically, particularly in a state so lily white (88.54%) that there are virtually no Black people (0.50%) to blame everything on.

I think that his brain has been poisoned by agricultural chemicals used on those famous Montana dental floss farms:

The coronavirus pandemic – heard of it? It’s famously still going on! Though national case numbers are finally starting to drop and recent regional outbreaks in the midwest have begun to subside, there were still about 50,000 new Covid-19 infections recorded in the US on Tuesday and just over 700 new virus-related deaths.

But Greg Gianforte, Montana’s governor, has other priorities: he’s been talking about a “labor shortage” in a cynical attempt to cut public assistance. The Republican governor released a statement on Tuesday announcing his state will stop participating in the federal program that has given unemployed workers additional unemployment payments since the start of the pandemic – in an apparent attempt to get Montanans back to work, and he plans to give those who choose to do so something he calls a “return-to-work bonus”.

Although Montana’s unemployment rate fell to 3.8% in April, which is about at pre-pandemic levels, the state’s labor commissioner, Laurie Esau, says its labor force is approximately 10,000 workers smaller than it was pre-lockdown, a drop that Gianforte assumes is to do with lazy people who, given their new found pandemic benefits, don’t want to work any more. And according to Montana department of labor estimates, nearly 25,000 people are currently filing unemployment claims, a good chunk of whom the governor is eager to push into the state’s 14,000 or so job openings.

But this means there aren’t enough job openings for the number of people unemployed; even if the governor’s plan succeeds in filling those vacant positions as intended, there will still be over 10,000 people without jobs to apply for, forced to subsist on less. It is also wildly reductive to assume that because there are fewer people working, it must be the result of a lack of will. People had jobs, and those jobs were taken away, either through mass layoffs or government shutdowns of businesses. That kind of disruption takes time to recover from. People could now be working out childcare arrangements again; finding out where they fit in a new jobs market; or worried about returning to work until the coast is clear.

The headline of this story should be, “Montana Governor has tragically small penis, inflicts pain on whole state to compensate.”

Also, boycott Montana grown dental floss until this policy is reversed.

Frau Merkel (Horses Whinny) Is at It Again

The day after the Biden Administration said that it supported suspending IP rights on the Covid Vaccine, Angela Merkel comes out against this.

I think that her motivation is pretty simple:  Covid response is going pear-shaped in Germany, with Covid cases spiking, and by ginning up a controversy, she can avoid scrutiny of her handling of the pandemic.

This is not the first time that she has done this, it’s behind the whole policy of “othering” southern Europeans and spreading misery throughout the EU during and after the financial crisis.

She knows that if she’s seen as doing something, anything, with the argument that she is protecting Germans from the undeserving “other” she, and her CDU Party, can benefit, even if it provides no benefit to Germans, and may kill hundreds of thousands of people around the world.

Merkel is despicable:

The US and Germany are at odds on the issue of waivers for patents on Covid-19 vaccines, as Berlin argued that a waiver would not increase production and would inhibit future private sector research.

The disagreement is the first major rift between the two economic powers since Joe Biden took office, and threatens to deadlock discussions at the World Trade Organization (WTO) and sour relations within the G7 group of major industrialised democracies.

Any WTO decision on a waiver would have to be by consensus, so Germany opposition is a major obstacle to intellectual property rights on vaccines being suspended.

The Biden government’s announcement on Wednesday that it would back a waiver on vaccine patents was welcomed by the World Health Organization (WHO) as a step towards greater global equity at a time when poor countries have little access to vaccines and south Asia has been hit by a devastating outbreak. India accounted for 46% of the new Covid-19 cases recorded around the world over the past week, and there are signs the wave is spreading to Nepal, Sri Lanka and other neighbouring states.

But Angela Merkel’s government came out against a waiver on Thursday.

“The US suggestion for the lifting of patent protection for Covid-19 vaccines has significant implications for vaccine production as a whole,” a government spokeswoman said.

“The limiting factors in the production of vaccines are the production capacities and the high-quality standards and not patents,” she added, arguing that the companies were already working with partners to boost manufacturing capacity.

This argument about the difficulty of vaccines is patently false, as I noted yesterday. 

You can mass produce mRNA viruses in a space smaller than the file room necessary to store the quality control documents, and Angela Merkel knows this; she got her PhD in Quantum Chemistry.

Unfortunately, there is no one in politics in Germany who is willing to call her out on her lies.

But in a good way.

In a moved that surprised me the Biden administration has announced that it favors waiving Covie vaccine patents. 

I had hoped that they would eventually do this, but I expected that there would be 6 months of denials and alibis until the moral outrage forced them to take this move.

Happy to be wrong:

The Biden administration on Wednesday threw its support behind a controversial proposal to waive intellectual property protections for coronavirus vaccines, with liberals framing it as a necessary bid to speed the shots to billions in the developing world, while the drug industry warned of devastating effects to vaccine production.

U.S. Trade Representative Katherine Tai said the United States will now move forward with international discussions to waive the protections for the duration of the pandemic. U.S. officials helped block a World Trade Organization proposal that was introduced last year to stop enforcing patents for coronavirus-related medical products. Dozens of developing countries have pushed for the proposal, arguing that it would allow them to rapidly produce their own generic vaccines, rather than wait months or years for sufficient doses.

The decision to go forward with the waiver after weeks of internal deliberations was finalized at a White House meeting on Tuesday with President Biden, said senior administration officials who spoke on the condition of anonymity to describe the deliberations. Staff at the meeting included Tai, national security adviser Jake Sullivan, coronavirus coordinator Jeff Zients, and Bruce Reed, deputy chief of staff for policy, all of whom supported the decision. But Commerce Secretary Gina Raimondo, who had concerns about the waiver, was not included in the meeting, the people said. The Commerce Department declined to comment.

Of course Gina Raimondo wasn’t involved.  She’s a complete corporate stooge, and she would always take the side of whoever is closest to Wall Street, much as she self-dealt to herself and her Wall Street buddies as Governor of Rhode Island.

Administration officials have acknowledged their uncertainty about whether the waiver will actually speed up production of coronavirus vaccines across the world. The mRNA vaccines, made by Pfizer-BioNTech and Moderna, require special technology that most countries do not have access to, raising questions about which countries will actually have the technological capacity to manufacture the complicated vaccines.

The reporter clearly doesn’t know the technology, as Cory Docterow observes, mRNA vaccines can pack most a whole vaccine factory in the space of a closet: 

So, is it a lie? MRNA vaccines are super-new tech. Maybe their manufacture is so esoteric that only the richest, most powerful countries can make them?

Nope.

Its co-authors are an interdisciplinary team of chemical engineers, infectious disease specialists and vaccine specialists from Imperial College London and the International AIDS Vaccine Initiative.

The authors aren’t specifically addressing themselves to the question of global development of mRNA vaccine production, but are instead concerned with any kind of generic rampup in production — either in response to a new virus, or because of an mRNA-based vaccine breakthrough for an existing virus. They reason that any kind of annual covid shot will occupy the majority of existing mRNA vaccine production facilities, so any new global vaccination project will require that new production sites be built.

I know, I just blockquoted all of that, so it would be redundant to bullet it below, but JESUS F%$#ING HOLY GODDAMNED SH%$BALLS, does this ever bear repeating:

  • New facilities will be 99–99.9% smaller than conventional vaccine facilities
  • They will be 95–99.7% cheaper than conventional vaccine facilities
  • You could use a single room in a conventional vaccine factory to make more vaccine doses of mRNA vaccines than the entire output of the rest of the factory
  • New vaccines can be made 1,000% faster than previous vaccines

There’s more, like the fact that you only need part of the facility to be a high-spec clean-room, and the rest can be built on more conventional lines.

For $20m, they say they can build a facility where, for $100m/year, they can turn out 1b doses/year, using a single 5L bioreactor.

Run the numbers there.  That’s a cost of $0.12/dose. 

Add in the cost of regulatory compliance, packaging, maintaining a cold chain while shipping it a few hundred (as opposed to a few thousand) miles, and tracking lots, and you are still below $10/dose.

The Pharma powers that be are opposed to any sort of relaxation of IP regulations not because duplicating their instrumentality is hard, but because it is trivially easy, and said technology is publicly developed and publicly funded.

They want to continue to extract their rents and keep their ill-gotten gains, because they want another yacht to water-ski behind.

Oregon state Representative Mike Nearman, who allowed right wing terrorists into the state house, has been charged with first-degree official misconduct and second-degree criminal trespass.

I’m surprised that he got charged at all:

An Oregon lawmaker who let violent far-right demonstrators into the state Capitol during a Dec. 21 special session was criminally charged on Friday with first-degree official misconduct and second-degree criminal trespass.

Rep. Mike Nearman, R-Independence, was caught on security videos opening a door and allowing demonstrators to enter the building. He had been under investigation since at least January for enabling the breach.

He was caught on tape, and it took them 4 months to charge this mook?

What is up with that?

The first-degree official misconduct charge is for allegedly knowingly taking action that constituted an unauthorized exercise of his official duties to benefit someone else, according to court filings. The second charge is for allegedly abetting another person to enter and remain in the Capitol.

Oregon’s Capitol has been closed to the public for the last year due to the pandemic. On Dec. 21, lawmakers were in the building for the third special session of 2020, which Gov. Kate Brown called to extend the state’s eviction moratorium, create a relief fund for landlords and pass wildfire and COVID-19 related funding.

As House lawmakers debated rules for the one-day proceeding around 8:30 a.m., Nearman left the chamber and exited a door near where right-wing demonstrators had gathered to protest the state’s coronavirus restrictions. Demonstrators, including some carrying rifles, were circulating outside the north face of the Capitol and one man carrying a large flag waited just outside the door that Nearman opened, according to security footage obtained by The Oregonian/OregonLive through a public records request. Nearman exited and walked around the man with the flag, making no effort to keep him from entering the Capitol.

Surveillance video showed that once Nearman allowed demonstrators into the northwest Capitol vestibule, the group clashed with Oregon State Police and Salem police who tried to keep them out of the building. Demonstrators attempted to push past police, who rushed to eject the initial insurgents and physically block the doorway Nearman had just opened.

They have him on at least 4 cameras.  He’s been cut way too much slack by law enforcement.

He should have been frog marched out of his office in handcuffs months ago.

And Yet He Remains a Respected Part of the DC Establishment

A federal judge just called former Attorney General William Barr a liar.

Judge Amy Berman Jackson just accused him of deliberately misleading her, Congress and the public about his characterization of the results of the Mueller investigation.

Furthermore, she notes that his description of the memos that avoid public disclosure through the FOIA process.

Why this man has a law license is beyond me:

A federal judge in Washington accused the Justice Department under Attorney General William P. Barr of misleading her and Congress about advice he had received from top department officials on whether President Donald J. Trump should have been charged with obstructing the Russia investigation and ordered that a related memo be released.

Judge Amy Berman Jackson of the United States District Court in Washington said in a ruling late Monday that the Justice Department’s obfuscation appeared to be part of a pattern in which top officials like Mr. Barr were untruthful to Congress and the public about the investigation.

The department had argued that the memo was exempt from public records laws because it consisted of private advice from lawyers whom Mr. Barr had relied on to make the call on prosecuting Mr. Trump. But Judge Jackson, who was appointed by President Barack Obama in 2011, ruled that the memo contained strategic advice, and that Mr. Barr and his aides already understood what his decision would be.

Her rebuke shed new light on Mr. Barr’s decision not to prosecute Mr. Trump. She also wrote that although the department portrayed the advice memo as a legal document protected by attorney-client privilege, it was done in concert with Mr. Barr’s publicly released summary, “written by the very same people at the very same time.”

The ruling came in a lawsuit by a government watchdog group, Citizens for Responsibility and Ethics in Washington, asking that the Justice Department be ordered to turn over a range of documents related to how top law enforcement officials cleared Mr. Trump of wrongdoing.

At issue is how Mr. Barr handled the end of the Mueller investigation and the release of its findings to the public. In March 2019, the office of the special counsel overseeing the inquiry, Robert S. Mueller III, delivered its report to the Justice Department. In a highly unusual decision, Mr. Mueller declined to make a determination about whether Mr. Trump had illegally obstructed justice.

But instead, Judge Jackson wrote, Mr. Barr and his aides had already decided not to bring charges against Mr. Trump. She reprimanded the department for portraying the memo as part of deliberations over whether to prosecute the president. She noted that she had been allowed to read the full memo before making her decision, over the objections of the Justice Department, and that it revealed that “excised portions belie the notion that it fell to the attorney general to make a prosecution decision or that any such decision was on the table at any time.”

The Justice Department argued that the emails were exempt from disclosure and filed sworn affidavits about their contents by lawyers for the Office of Management and Budget during the Trump administration. But Judge Jackson insisted on reading the emails for herself and wrote that “the court discovered that there were obvious differences between the affiants’ description of the nature and subject matter of the documents, and the documents themselves.”

More so than Donald Trump, Roger Stone, or Rudolph Giuliani, William Barr needs to be in the dock.

First, he was US Attorney General, and should be subject to a higher standard of behavior than your standard political hack, and second, he is a fixture of the Washington, DC establishment, and someone needs to poke a hole in their own innate sense of impunity for the whole corrupt edifice.

That he can still practice law is an abomination.

The  Executive Office for United States Trustees, a division of the Department of Justice tasked with overseeing bankruptcy proceedings in the United States, just unleashed a huge can of whup-ass on Wayne LaPierre and the NRA.

It isn’t often that you hear terms like, “Failed to provide the proper oversight,” “Personal expenses were made to look like business expenses,” and that their regulatory issues with the New York AG are, “Not a legitimate reason for filing bankruptcy.”

It’s extremely rare for the trustee to say things like this, or to call for a bankruptcy to be halted, or to call for appointing a trustee.

The NRA is in a world of hurt, and if there is any justice in this world, Wayne LaPierre will end up sharing a cell with Matt Gaetz and Roger Stone.

The National Rifle Association’s hopes of end-running a legal challenge in New York were dealt a serious blow on Monday when a Justice Department official rebuked its leadership and called for the dismissal of its bankruptcy filing or the appointment of an outside monitor to oversee its finances.

Lisa L. Lambert, a lawyer in the United States Trustee’s office, which is part of the Justice Department, said the “evidentiary record clearly and convincingly establishes” that Wayne LaPierre, the longtime N.R.A. chief executive, “has failed to provide the proper oversight.” For a number of years, she added, “the record is unrefuted that Wayne LaPierre’s personal expenses were made to look like business expenses.”

Mr. LaPierre and the N.R.A. had filed for bankruptcy not because of any financial distress, but as a strategy to avoid litigation in New York, where the attorney general, Letitia James, is seeking to shut down the organization and claw back millions of dollars in allegedly misspent funds from Mr. LaPierre and three other current or former executives.

“The N.R.A. is in real trouble,” said Adam J. Levitin, a professor specializing in bankruptcy at Georgetown University. “The U.S. Trustee rarely gets involved in this sort of motion, much less urges dismissal, a trustee or an examiner. I cannot see an outcome where the N.R.A. comes out unscathed. I think the real issue is what remedy the judge grants.” 

John Pottow, who teaches bankruptcy at the University of Michigan Law School, called the trustee’s intervention “a glaring signal of profound dysfunction” at the N.R.A., adding that such an intervention by the trustee “doesn’t happen very often.”

“The N.R.A. has stated that it is seeking refuge from the New York attorney general’s actions and wishes to change its state of incorporation,” she added. “That can be done outside of bankruptcy. It is not a legitimate reason for filing bankruptcy.”

Shut them down, take their domain names, and take their mailing and donor lists.

Don’t allow LaPierre to resurrect his scam under a different name.

The ammosexuals community will doubtless find another outlet for their political priorities, after all, they have won the war against common sense gun laws for a generation, but at least that new organization won’t rob them blind.

It seems that many of these folks, who were born on 3rd base and thought that they had hit a triple, are so personally offended to be made pay their fair share.

They are losing their sh%$ over the lower tax rate for capital gains going away.

They keep saying things like, “Over-taxing success is un-American.”

Oh, you poor delicate snowflake.  Your subsidy is going away, and your feelings are hurt.

Yale academics have written a study showing that Democratic Party anti-racism messaging harmed the party politically.

Obviously, some of the this can be ascribed to the racism of a portion of the electorate, but there is also the issue that anti-racism messaging has been offered as an alternative to basic issues of social justice, labor rights, and inequality.

That’s why Hillary Clinton’s, “Basket of Deplorables,” quote was so damaging.

The subtext was, “If you did not have the talent and initiative to get a post-graduate degree at an elite institution, screw you.”

The Democratic Party establishment (There is no Democratic Party establishment) has completely eschewed issues of socioeconomic class, because they are creatures of the top 1%, and racial reductionist statements allow them to check the various “social justice” text box while continue to serve the agenda of the economic elites.

The is the exact opposite of the answer that Jesse Jackson gave during his 1988 Presidential campaign when he was asked, “How you are going to get the support of the white steelworker?” and he replied, “By making him aware he has more in common with the black steel workers by being a worker, than with the boss by being white.”

Bernie Sanders message in 2016 and 2020 was very similar, and (thankfully) Biden appears to be governing more toward the Jackson end of the Democratic Party ideological spectrum than he is toward the Clinton/Obama side of the spectrum, even if he did not campaign that way:

Beginning about a decade ago, the Democratic Party went through two important changes related to racism. The first is that the backlash against Barack Obama made far more white liberals aware of how deeply racial resentment inspired American conservatism. (Black people had by and large realized this all along.)

The second is that the party, which in previous years had painstakingly avoided the impression its agenda was mainly designed to help minorities, began emphasizing this very point. That change occurred in 2016, when Hillary Clinton started infusing her rhetoric with conscious appeals to racial equity. And it continued in 2020 — even though Joe Biden employed less race-conscious rhetoric than his more progressive rivals, he still cast some of his plans as explicitly anti-racist.

But is it working? Yale political scientists Micah English and Josh Kalla have found that adding explicitly race-conscious ideas to Democratic messages reduces their support. English and Kalla’s experiment borrows real-world messages from Democratic politicians and tests them with both a race-conscious component and a mix of race and class messaging. In either instance, telling subjects that a proposal would reduce racial inequity makes them less likely to support it:

 

Bigotry is evil, and it needs to be fought on every level, but using anti-racist virtue signaling as an alternative to meaningful change in a profoundly dysfunctional society, ends up harming both the progressive project and the ability to fight racism, because it reduces every government action to a zero sum game where the only determinant is ethnicity.

Nevada Governor Backs Off Really Bad Cyberpunk Idea

If you’ve read any Cyberpunk, you are probably familiar with the idea of corporate controlled arcologies, which people are packed in like sardines and subject to the whims of psychopathic corporate drones.

Well the (hopefully soon to be former) governor of Nevada, Steve Sisolak, looked at this, and decided that allowing corporations to incorporate their own municipalities was just the balm that the state economy needed.

It was not well received, so the he’s downgraded to a study, which hopefully means that this idea is well and truly dead:

Nevada Governor Steve Sisolak is retreating from his plan to introduce legislation that would have allowed tech companies to form local governments within the state. Per The Nevada Independent, the governor now instead plans to create a bipartisan committee made up of state Senate and Assembly members to study the idea. At the end of 2021, the group will present recommendations to Sisolak, with one possible outcome being that they suggest he abandon the proposal.

“Innovation Zones is a bold proposal for our State that deserves additional attention and discussion — and not under the pressure of less than 40 remaining days in the current legislative session,” Governor Sisolak said in a statement. “I know that legislators, stakeholders and Nevadans still have questions, and I want those questions to be discussed and answered. I want people to be enthusiastic about this opportunity, not skeptical about a fast-tracked bill.”

Governor Sisolak first floated the idea during one of his State of the State addresses earlier in the year. He positioned Innovation Zones as a way for Nevada to attract tech businesses without the need for measures like corporate tax breaks. Draft legislation obtained by the Las Vegas Review-Journal laid out a system where companies in verticals like cryptocurrency, artificial intelligence and renewables would have had the option to form local governments with the same powers and responsibilities as counties. That means those companies would have had to do things like collect taxes and operate school systems.

This what forced Virginia Republicans to hold their nominating convention on Shabbat, with no provision for observant Jews to vote at an alternate time.

The Virginia Republican Party, already under fire for a process for picking a gubernatorial candidate that critics say excludes some voters, just disenfranchised another constituency: Shabbat-observant Jews.

A majority of the State Central Committee voted Thursday for a religious exemption to voting at the convention taking place on May 8, a Saturday, but did not meet the 75% threshold to pass. Elections Daily, an elections news site, reported that 38 officials voted for an exemption, 28 voted against and three abstained.

An official at the state GOP confirmed the vote and told the Jewish Telegraphic Agency to submit a question in writing about the vote.

The Republican Jewish Coalition said on Twitter that it was disappointed in the decision.

Republicans in recent years have veered between primaries and conventions. Rank-and-file party members have often complained that conventions are a means for the leadership to make sure the candidates it favors get the vote.

This is not a surprise.

Republicans these days are determined to prevent the “Wrong People” from voting, and it comes as no surprise that Jews are the wrong people for them too.

If they had their way, they would repeal the 15th and 19th amendments as well, and limit the franchise to white Christian property owners.

Only 90 Years Late

President Biden has formally declared the Armenian Genocide by Turkey a genocide, the first US President to do so.

The fact that this has taken over 100 years is an mark of shame and cowardice:

President Biden on Saturday recognized the mass killings of Armenians more than a century ago as genocide, signaling a willingness to test an increasingly frayed relationship with Turkey, long a key regional ally and an important partner within NATO.

“Each year on this day, we remember the lives of all those who died in the Ottoman-era Armenian genocide and recommit ourselves to preventing such an atrocity from ever again occurring,” Mr. Biden said in a statement issued on the 106th anniversary of the beginning of a brutal campaign by the former Ottoman Empire that killed 1.5 million people. “And we remember so that we remain ever vigilant against the corrosive influence of hate in all its forms.”

The declaration by Mr. Biden reflected his administration’s commitment to human rights, a pillar of its foreign policy. It is also a break from Mr. Biden’s predecessors, who were reluctant to anger a country of strategic importance and were wary of driving its leadership toward American adversaries like Russia or Iran.

But in a call on Friday, Mr. Biden told Mr. Erdogan directly that he would be declaring the massacre an act of genocide, according to a person familiar with the discussion who spoke on the condition of anonymity to disclose details of the conversation.

As to the feelings of the Turks in general, and of Erdogan in particular, those delicate snowflakes can go f%$# themselves.

Their ancestors committed genocide, and have denied it for a century, and there needs to be an accounting for that.

One of the problems with privacy is that law-enforcement uses private actors to collect personal information to collect data which it would otherwise be constitutionally forbidden from doing.

Senator Ron Widen has introduced the 4th Amendment is not for Sale Act to forbid this.

It’s nice, but the bill should be expanded to the point where Peter Thiel’s Palantir is driven out of business:

Federal agencies have taken advantage of legal loopholes to collect massive amounts of personal information from cell phone and internet users without congressional or judicial authorization for years, but that practice is being challenged by a bipartisan and bicameral group of lawmakers who introduced legislation on Wednesday that would prevent the U.S. government from buying individuals’ information from data brokers without a court order.

Led by Sen. Ron Wyden (D-Ore.), a group of 20 senators introduced the Fourth Amendment Is Not For Sale Act (pdf) in the upper chamber of Congress. Reps. Jerry Nadler (D-N.Y.) and Zoe Lofgren (D-Calif.) also unveiled an equivalent bill in the House.

By closing major loopholes in federal privacy laws—including the Electronic Communications Privacy Act and the Foreign Intelligence Surveillance Act—the newly proposed legislation seeks to protect everyone in the U.S. from unlawful searches and seizures, one of the key civil liberties spelled out in the Bill of Rights.

In a press release (pdf), the lawmakers said that “while there are strict rules for consumer-facing companies—phone companies like AT&T and Verizon and tech companies like Google and Facebook—loopholes in the law currently permit data brokers and other firms without a direct relationship to consumers to sell Americans’ private information to the government without a court order.”

The Fourth Amendment Is Not For Sale Act would require law enforcement agencies to obtain a court order before accessing data about people through third-party brokers that “aggregate and sell information like detailed user location data, surreptitiously gathered from smartphone apps or other sources,” The Verge reported Wednesday.

As Free Press Action explained, the bill would also prevent “police and intelligence agencies from buying data on people if the information was obtained from a user’s account or device, or via deception, hacking, violations of a contract, privacy policy, or terms of service.”

In addition, the bill would close loopholes that enable the national security state to buy metadata about U.S. residents’ international calls, texts, and emails, and to collect records about their web browsing of foreign websites. While this is information that would typically require a warrant to access, the intelligence community has found ways to circumvent the Fourth Amendment, routinely violating individuals’ constitutional rights in the process.

Call your Congress Critters and tell them to support the bill.

Not only will it force elements of the state security apparatus to behave more ethically, but it will also take money out of the pickets of the data brokers.

I introduced the link with the following, “Speaking of paychopaths, I love this take-down of Pelosi’s thank you to Floyd.”

Clearly, my finger slipped and hit an “A” instead of a “S” in “Psychoath.”

It seems completely apropos to describe the dysfunctional and corrupt, “Anything for a campaign donation,” ruling elites to be described as a “Paychopath.”

Surprised in a Good Way

Joe Biden has announced that he intends to raise the capital gains tax rate on the wildly communist idea* that people who work for a living should be taxed at a higher rate than people who sit on their ass waiting for their properties to appreciate.

I did not expect Biden to do something like this, but it is the right thing to do.  Capital has been under-taxed, and labor has been over-taxed for decades:

President Biden will seek new taxes on the rich, including a near doubling of the capital gains tax for people earning more than $1 million a year, to pay for the next phase in his $4 trillion plan to reshape the American economy.

Mr. Biden will also propose raising the top marginal income tax rate to 39.6 percent from 37 percent, the level it was cut to by President Donald J. Trump’s tax overhaul in 2017. The proposals are in line with Mr. Biden’s campaign promises to raise taxes on the wealthy but not on households earning less than $400,000.

$400,000 is still rich.  It’s about 7 times the median family income.

The president will lay out the full proposal, which he calls the American Family Plan, next week. It will include about $1.5 trillion in new spending and tax credits meant to fight poverty, reduce child care costs for families, make prekindergarten and community college free to all, and establish a national paid leave program, according to people familiar with the proposal. It is not yet final and could change before next week.

To offset that cost, Mr. Biden will propose several tax increases he included in his campaign platform. That starts with raising the top marginal income tax and the tax on capital gains — the proceeds of selling an asset like a stock or a boat — for people earning more than $1 million. The plan would effectively increase the rate they pay on that income to 39.6 percent from 20 percent.

Capital gains income would also still be subject to a 3.8 percent surtax that helps fund the Affordable Care Act. It was unclear if the tax increase would also apply to income earned from dividends.

Hopefully, it will.  The rich, which means capital gains and dividends, have increasingly sucking more and more out of our society while contributing less and less.

Ted Nugent has Covid.

Musician Ted Nugent has tested positive for coronavirus months after he said that the virus was “not a real pandemic”.

In his Christmas message shared on social media in December, Nugent called the worldwide crisis a “scammy pandemic” and said that people who wore masks were “sheep”.

On Monday (19 April), Nugent revealed on Facebook Live that he had caught Covid-19, admitting that “everybody” told him that he shouldn’t announce his diagnosis.

“I have had flu symptoms for the last 10 days and I thought I was dying, just a clusterf***,” he said.

“Today is the 19th of April 2021 during clusterf*** pandemic… I was tested positive today. I got the Chinese s***.”

Dumbass.

I have not been commenting on the Derek Chauvin trial, because I found it too depressing.

I figured that in Minneapolis a city legendary both for antisemitism and for its completely dysfunctional police force, that at most Chauvin would get was a conviction for 2nd degree manslaughter, be sentenced to less than 5 years, and be out in less than 2 years, particularly after the jury deliberated about 10 hours.

I was completely wrong, and I am elated to be wrong.  The now-convicted murderer was convicted on all three counts, and, assuming that the judge is not completely in the tank for the malefactors in Minneapolis law enforcement, is facing decades in prison:

Derek Chauvin has been convicted of murder for killing George Floyd by kneeling on his neck for more than nine minutes, a crime that prompted waves of protests in support of racial justice in the US and across the world.

The jury swiftly and unanimously convicted Chauvin of all the charges he faced – second- and third-degree murder, and manslaughter – after concluding that the white former Minneapolis police officer killed the 46-year-old Black man in May through a criminal assault, by pinning him to the ground so he could not breathe.

Huge cheers immediately went up among a crowd of several hundred people outside the heavily fortified courthouse with people chanting “All three counts” and “Whose victory? Our victory!”

And then things went back to normal, when a cop in Columbus pumped 4 rounds into the chest of a 15 year old girl.

However, a fatal police shooting in Ohio of a 15-year-old girl, which took place just moments before the verdict was read, unleashed a sense of fury and frustration among protesters who gathered at the scene.

“We don’t get to celebrate nothing,” said one protester, KC Taynor, according to the Columbus Dispatch. “In the end, you know what, you can’t be Black.”

Chauvin, who showed little emotion as the verdicts were read, was immediately taken into custody to await sentencing. He faces up to 40 years in prison but is likely to receive a shorter sentence, according to legal guidelines.

Police lie confirmed on Snopes

It should be noted that if not for a teenage girl capturing the video of George Floyd’s murder, the police department lies about this incident would have meant that Chauvin would still be out on the streets, free to kill again.

In a related note, Nancy Pelosi needs to resign, because she is suffering from what can only be described as senile wokeness.

When she literally said that she thanked George Floyd for his sacrifice in the cause of civil rights, she was so clueless and so offensive that she needs to be removed from her position as speaker of the house.

This is even more racist and more clueless than Trent Lott’s endorsement of Strom Thurmond’s segregationist 1948 Presidential campaign in 2002.

It’s even worse because she did this at a Congressional Black Caucus press conference.

Sorry Madam Speaker, but as much as you love the limelight, this was a time for members of the CBC to take center stage, not you.

Also, Floyd was not a civil rights activist, he was a victim of a murder by a corrupt and evil police officer:
