Firefly Ran 1 Season, and Bank of America Still Exists?

In the latest f%$#-up, Bank of America had to suspend its stock buyback and dividends because the “misfigured” its capital levels:

Bank of America Corp said on Monday that regulators had suspended its plan to buy back more shares and raise its dividend after the bank realized it had miscalculated a measure of the capital on its books.

The second-largest U.S. bank said fixing the mistake reduced a capital level by $4 billion, or about three-quarters of the extra money that the Federal Reserve had approved its returning to shareholders over the next year.

News of the gaffe sent the bank’s shares down 6.3 percent on Monday to close at $14.95, in the biggest one-day decline in the stock since November 2012.

The announcement illustrates how difficult it is to determine appropriate capital levels for the biggest banks, particularly under hypothetical stress situations that regulators consider. Bank of America now has to submit its request to return more capital to shareholders for a third time, and the Fed itself previously erred in projecting the bank’s minimum capital ratios under a stressed scenario.

The previously approved increase in the bank’s dividend would have been the first since the financial crisis, and raising it has been a focus of top executives. Banks historically paid out relatively high dividends, spurring retirees and other investors seeing income to buy their shares.

Banks failed to cut their dividends even as their earnings shrank during the financial crisis, burning up valuable capital and leaving them more vulnerable as the housing market deteriorated. In response, lawmakers have given regulators much more control over banks’ plans to return funds to shareholders.

The Fed said Bank of America has 30 days to submit a new plan that corrects the errors and ensures no further reporting problems if it would like to return more money to shareholders over the next four quarters.

Seriously.  Just how f%$#ed up does a bank have to be to have the Federal Reserve, an organization which has not just been captured by the finance industry, but which is in part owned by the by the finance industry, to reverse a decision to increase dividends?

BTW, does anyone actually believe that it “miscalculated” its capital ratio?

My guess is that there were a bunch of stock options vesting, and this accounting “error” facilitated top execs cashed in.

This bank is too corrupt, or too incompetent, to continue to exist in its current form.

The Federal Reserve Board on Monday announced it is requiring Bank of America Corporation to resubmit its capital plan and to suspend planned increases in capital distributions. The decision relates to the disclosure by Bank of America that the banking organization incorrectly reported data used in the calculation of regulatory capital ratios and submitted as inputs for the most recent stress tests conducted by the Federal Reserve.

The Federal Reserve can require a banking organization that is part of the annual Comprehensive Capital Analysis and Review (CCAR) program to resubmit its capital plan at any time if there is a material change that could potentially lead to an alteration in a firm’s capital position. Bank of America will be required to resubmit its capital plan within 30 days, unless that time is extended by the Federal Reserve. Bank of America must address the quantitative errors in its regulatory capital calculations as part of the resubmission and must undertake a review of its regulatory capital reporting to help ensure there are no further errors.

Until receiving notice that the Federal Reserve has not objected to the new capital plan, Bank of America will not be able to increase its capital distributions, including those increases approved during the 2014 CCAR exercise last month.

The Federal Reserve in CCAR evaluates the capital planning processes and capital adequacy of the largest bank holding companies, including the firms’ proposed capital actions such as dividend payments and share buybacks and issuances.

Jeb Bush on Wednesday was the most vocal he’s been about considering a run for the White House in 2016.

The Republican told a crowd of about 200 people at a Catholic Charities fundraiser in New York that he is “thinking about running for president,” according to an attendee.

The response came to one of the first questions posed to Bush at the Union League luncheon. After his answer, the room went wild, and then someone said they hoped he would take the step.

Please, God, make it stop!

If Any of General Michael Hayden’s Subordinates Have Stories About His Treatment of Women, I Would Love to Talk to You

Because, in response to the Senate Intelligence Committee’s decision to release their torture report, his response can best be summed up as, “Women be crazy,” which is a whole new level or repulsiveness by senior staff of our state security apparatus:

Former CIA and National Security Agency director Michael Hayden suggested Sunday that Senate Intelligence Committee Chairwoman Dianne Feinstein (D-Calif.) might have compromised the objectivity of a report on CIA interrogation techniques because she personally wants to change them.

On “Fox News Sunday,” Hayden cited comments Feinstein made last month in which she said declassifying the report would “ensure that an un-American, brutal program of detention and interrogation will never again be considered or permitted.”

Hayden suggested Feinstein feels too strongly about the issue on an “emotional” level.

“That sentence — that motivation for the report — may show deep, emotional feeling on the part of the senator, but I don’t think it leads you to an objective report,” Hayden said.

Bobby Jindal is the Lamest Man in Louisiana

A court just threw out his attempt to take down a MoveOn.org billboard using bogus trademark claims:

A U.S. district judge rejected Monday the Louisiana state government’s request that MoveOn.org’s billboard criticizing Gov. Bobby Jindal (R) for not expanding Medicaid under Obamacare be taken down. The billboard includes a parody of the state’s tourism slogan, which was the basis for the state’s legal action.

U.S. District Judge Shelly Dick issued the order. Lawyers for Lt. Gov. Jay Dardenne (R), who filed the suit, had “not demonstrated a substantial likelihood of prevailing on its burden of proving confusion by viewers of the billboard,” Dick wrote. She rejected the state’s request for a preliminary injunction, which asked that the billboard be taken down as the court case continues.

“The State has failed to demonstrate a compelling reason to curtail MoveOn.org.’s political speech in favor of protecting of the State’s service mark,” she continued. “There has been no showing of irreparable injury to the State.”

And Jindal wants to be President.

I would think that he is too lame to be the Republican nominee, but considering the past 2 ‘Phant presidents, Bush and Bush, I am not sure if there is enough lame in the universe to rule out anyone as a Republican nominee.

On the other hand, I do think that a significant portion of the Republican electorate, particularly in the south, might be uncomfortable voting for a non-white candidate.

Why the USAF Should Be Folded Back into the US Army, Part CLXIX

A current active duty colonel in the USAF is deploying F-22s to the Ukraine is all that is needed to protect them from a potential Russian incursion:

On March 31, U.S. Air Force Col. Robert Spalding III argued in The National Interest that a “purely defensive deployment” of Air Force F-22 stealth fighters “is just one possible solution” to the Ukraine crisis, which has seen Vladimir Putin’s Russia annex the strategic Crimean peninsula and threaten the rest of Ukraine.

Spalding is wrong—F-22s are not the answer. The colonel’s assertion is yet another example of air power hubris, which has come to define the Air Force. “Without firing a shot, such a deployment [of F-22s] would immediately change Putin’s invasion calculus,” Spalding insists.

Russian aircraft wouldn’t survive a confrontation with American stealth fighters and thus couldn’t support a Russian ground invasion, in Spalding reasoning. Ukrainians would feel more confident about their ability to defend their country, since any Russian invasion would be subject to attack by Ukrainian aircraft protected by F-22s.

This essay does not evaluate the wisdom of Washington extending a security guarantee to Ukraine, an issue that remains fundamentally political in nature. Rather, it challenges the argument that the fielding of F-22s could decisively tip the military balance in favor of the Ukrainian military.

First, F-22s could only destroy the Russian air force if the latter engaged, which of course it would not. The Russians know that the F-22 can defeat any fighter flown by their air force. The Kremlin would respond to a “purely defensive” deployment of F-22s by only operating their own aircraft in conditions of overwhelming superiority.

At best, the F-22s could deter Russia from using its air force to support advancing Russian army spearheads.

But what about using Ukrainian aircraft to attack Russian army formations? Russia’s S-400 surface-to-air missile system, pictured above, can identify, track and fire on targets at ranges of up to 250 miles.

Even if we assume that the F-22 can evade multiple, overlapping S-400 batteries—a deadly proposition we have never tested—Ukraine’s Su-25 attack aircraft cannot.

Moscow can deploy the S-400 such that it provides cover over advancing Russian troops everywhere in eastern or central Ukraine. The Russian army possesses additional, mobile SAM systems that can render any Ukrainian air attacks suicidal.

An F-22 deployment would be similarly problematic, because, as I noted a number of years ago, stealthy is not invisible, and the basic laws of physics, which dictate detection range as a factor of the 4th root of the radar cross section, which gives us this table for the S-400 (SA-21):

Note that the distance at which the targeting radar might reasonably be expected to lock on to the target, but SA-21 also has a very low frequency search radar which should be more effective in determining the general location of a stealthy target.  (To say nothing of targeting AWACS, tankers, etc., for which the limiting factor of the system would be the aerodynamic performance of the missile)

The F-22s would by no means be clay pigeons, but it is also likely that they would not be able to operate with the sort of impunity that has been the norm for recent US campaigns.

An attorney challenging first-term Rep. Ted Yoho (R-FL) moonlights as a live-action vampire role-player, according to a Florida political news site.

SaintPetersBlog on Tuesday detailed Jake Rush’s involvement in the Mind’s Eye Society, a national community of live-action role-players. Rush played a host of supernatural characters — “Chazz Darling” and “Staas van der Winst” were just two of his alter-egos — and kept up an active presence on the Camarilla Wiki Project, a Wikipedia-like website that allowed role-players to share content.

Business Insider also reported that Rush appears to have held a prominent position with a Florida-based group called the “Covenant of the Poisoned Absinthe,” which stages “an assortment of games from White Wolf’s selection, including Vampire: The Masquerade, Changeling: The Lost, and Mage: The Awakening.” White Wolf publishes live-action role-playing games for the Mind’s Eye community.

Georgia has just legalized the carriage of handguns pretty much everywhere:

Pro- and anti-gun forces do not agree on much, but they do agree on the breathtaking sweep of the Georgia legislation allowing guns in bars, schools, restaurants, churches and airports that is now awaiting the signature of Gov. Nathan Deal.

Americans for Responsible Solutions, founded by Gabrielle Giffords, the former Arizona congresswoman who was critically wounded in a mass shooting in 2011, calls it “the most extreme gun bill in America” and the “guns everywhere” legislation. The National Rifle Association, which lobbied for the bill, calls it “the most comprehensive pro-gun” bill in recent state history, and described the vote at the Capitol on Thursday as “a historic victory for the Second Amendment.”

The bill was opposed not only by gun-control groups, but also by the state’s police chiefs association and restaurant association, Episcopal and Catholic churches, and the federal Transportation Security Administration. A majority of Georgians also opposed it, according to several polls.

Well two weeks after Randa Jarrar wrote a bigoted screed on non-Arabs belly dancing, and was pilloried for this, (I called her a bigoted moron) she writes a followup where she doubles down on her repellent thesis.

Rather uncharitably, my first reaction was a bit of smug self-satisfaction when she appeared to specifically mention my blog, “Other men on racist blogs called me a moron.”

Needless to say, I stand by my analysis of her earlier post, and her most recent article further reinforces the truth behind the Denis Healey quote.

The interesting thing is that from an aesthetic perspective we generally agree on the aesthetics of Middle Eastern dance, we both agree that the westernized cartoonized version of Middle Eastern dance, what I call “Cabaret”, is crap. (Of course, 90% of everything is crap [Sturgeon’s law])

Further we would agree that many, probably most, of the public performances of Middle Eastern dance in the west are crap.

I would go a bit further, and note that the same applies to public performances in Egypt, Turkey, Lebanaon, Syria, etc.

But there is a difference between objecting to the Disneyfication of an art form and saying that some ethnic group should not be allowed to practice that art.

Furthermore in she goes there, and explicitly states that, “It’s not possible,” for her to be a racist, one would assume because she is an Arab.

Bigotry much?

It appears with the implosion of Chris Christie over Bridgegate, Ted Cruz being loathed by every mainstream candidate in the nation, Jim DeMint being the architect of their disastrous government shutdown, Bobby Jindal being too creepy for words, Rick Perry being too stupid (too inarticulate, and ……… oops), Paul Ryan is too creepy, and Rand Paul being too ……… Rand Paul, the Republican Presidential bench is rather lacking for 2016.

It appears that the Republicans are casting about for a viable candidate, and Joe Scarborough’s name has been mooted:

The congressman-turned-pundit has been talking about that stuff for years, of course, but it reached a fever pitch last November with the release of his book, “The Right Path.”

“The buzz among GOP insiders is that ‘The Right Path’ has the potential to galvanize conservatives in the way Barry Goldwater’s ‘Conscience of a Conservative’ did half a century ago — especially conservatives ready to return to the winning ways of Ronald Reagan, who is on the cover, shown striding down the White House colonnade,” gushed Politico’s buzz arbiter Mike Allen.

Scarborough talked to TPM about the book, casually suggesting that “Joe Scarborough’s worldview” was in sync with “Ronald Reagan’s worldview and Bill Buckley’s worldview and Margaret Thatcher’s worldview.”

You knew where this was going.

Inevitably, Joe Scarborough’s book tour was viewed as a springboard for Joe Scarborough’s 2016 presidential campaign. A few months after the book’s release, The Daily Caller’s Alex Pappas reported that it’s “widely believed” at MSNBC that Scarborough has presidential aspirations.

Two days after that story ran, Scarborough told conservative radio host Hugh Hewitt that he “won’t rule anything out.”

I know that somehow or other the Republicans will find a nominee in 2016, but this is beginning to look like the life cycle of a drummer for Spın̈al Tap.

By now, and by god, it should have settled permanently in the consciousness of the nation what a huge and untoward gamble with the country John McCain and his campaign took in 2008 when they elevated Sarah Palin from her rightful place on the tundra to the political celebrity she currently enjoys. McCain should pay a heavy price for unleashing this ignorant, two-wheeled bilewagon on the country’s politics. If you think she’s a legitimate political leader, you’re an idiot and a sucker and I feel sorry for you.

Yesterday she gave a wildly received speech to ring down the curtain at CPAC. The applause, as far as I know, may still be going on. It was as singularly embarrassing a public address as any allegedly sentient primate ever has delivered. It was a disgrace to politics, to rhetoric, to the English language, and to seventh-grade slam books everywhere.

A friend bailed on the speech, making the very plausible case that Palin is simply another political celebrity freakshow, like Donald Trump. I can see the point there but, with Palin, and watching the hysterical reception her puerile screed received, there is something more serious going on. She is the living representation of the infantilization of American politics, a poisonous Grimm Sister telling toxic fairy tales to audiences drunk on fear, and hate and nonsense. She respects no standards but her own. She is in perpetual tantrum, railing against her betters, which is practically everyone, and volunteering for the job of avatar to the country’s reckless vandal of a political Id. It was the address of a malignant child delivered to an audience of malignant children. If you applauded, you’re an idiot and I feel sorry for you.

Last year, my car got totaled by a tour bus while CPAC was going on, and it’s clear that Mr. Pierce had a WAY worse time this year at CPAC than I did last year getting hit by a bus.

Art is supposed to be universal, and cross cultural art can produce some amazing things.

Hillary Clinton likened aspects of Russia’s involvement in Crimean Ukraine to Nazi Germany during a fundraising event, according to two people present.

Buzzfeed, citing two sources, reported that the former secretary of State said at a fundraiser on Tuesday that Russia’s move to start issuing passports in Crimean Ukraine was akin to “population transfers” that happened in Nazi Germany during World War II.

“Now if this sounds familiar, it’s what Hitler did back in the 30s,” Clinton said according to the Long Beach Press-Telegram. “All the Germans that were … the ethnic Germans, the Germans by ancestry who were in places like Czechoslovakia and Romania and other places, Hitler kept saying they’re not being treated right. I must go and protect my people and that’s what’s gotten everybody so nervous.”

Seriously, her need to go to war at the drop of a hat was why she did not get the nomination in 2008, and here she is making John McCain look like Timothy Leary.

She is not going to be the President-Elect in November of 2016. Hillary Clinton just flushed that down the toilet.

Politics Trumps Good Policy

Congress just voted to continue subsidizing morons who choose to build in flood plains:

The House of Representatives, in a bipartisan vote of 306-91 Tuesday night, agreed to limit premium rate increases under the National Flood Insurance Program.

The bill must still pass the Senate or be reconciled with a version of flood insurance legislation that the chamber approved in January.

If the House version becomes law, with President Barack Obama’s signature, the measure would eliminate some of the changes made in a 2012 law that required the Federal Emergency Management Agency to raise rates to reflect flood risk. The law was intended to reduce losses to the insurance program, which is $24 billion in debt.

Conservative, libertarian, environmental and taxpayer watchdog groups opposed the bill, arguing that rates should be based on risk. Some said subsidies should be targeted only to people who couldn’t afford higher rates.

Rep. Jeb Hensarling, R-Texas, said during the debate that he would oppose the bill because the flood insurance program was “one reason America is going broke.”

“It forces 96 percent of Americans to subsidize the remaining 4 percent, regardless of income or need,” Hensarling said.

You know, when Jeb F%$#ing Hensarling is one of the smarter people in the room, you are at a level of stupid that buggers the mind.

Of course, if I were in Congress, I would tell Mr. Hensarling that  the additional costs for the insurance program are a direct result of anthropogenic climate change, just to f%$# with him.

Your Daily Dose of Ukraine Related Incompetence and Hypocrisy

It turns out that one of the first acts of the new parliament in the “no-bigotry, ethnocentrism, or fascist parties here” Ukraine was to rescind the status of the Russian language one of the official languages of the Ukraine: (and note how this was buried at paragraph 5 of the story)

Officials in Moscow continued Tuesday to express displeasure with events in Ukraine, if not as harshly as the day before. One bill that flew through the Rada on Monday downgraded the status of Russian as an official language, which struck critics as an unnecessary and incendiary move and which opened Ukraine’s new authorities to stinging criticism from their larger neighbor.

Sergei Lavrov, Russia’s foreign minister, tweeted Tuesday, “We want to curtail the influence of radicals and nationalists who are trying to play first fiddle in Ukraine.”

Note that this story was from February 25, 4 days before Russia sent troops.

As Ted Rall pithily observes that, “Millions of ethnic Russians in former Soviet Republics have suffered widespread discrimination and harassment since the 1991 collapse — and that their troubles began with laws eliminating Russian as an official language.”

BTW, the person who seems to be deepest in our shenanigans in the Ukraine, you know, things like funding the Neo-Nazi Svoboda party the Pravyi Sektor militia, that would be Victoria Nuland, the Assistant Secretary of State for European and Eurasian Affairs, who is literally in bed with the Neocons.

I mean it.  She is married to Robert Kagan, who is not just a Neocon, but is pretty the much the ur-Neocon, having co-founded the Project for the New American Century (PNAC) which has called for:

  • The overthrow of Saddam Hussein (1999)
  • The overthrow of Saddam Hussein, because he was behind 9/11 (2001)
  • Called for American hegemony across the world
  • Repeatedly called for preemptive military strikes
  • Permanent U.S. bases in Saudi Arabia
  • Hostilities with China

Yeah, he founded the group that more than any other organization put us in Iraq.

And his reward for this? 

Why, he is on the State Department’s Foreign Affairs Policy Board.

How do these folks, and here I am referring to both the Neocons like Kagan and Nuland, and Liberal Interventionists like the Samantha Powers, continue to maintain influence in our foreign policy?

Why is an an uninterrupted record of failure, misery, and the death of innocents considered an endorsement for greater responsibilities in Washington, DC?

It’s like promoting the guy who designed the Edsel to run the company.

Seriously, there is doing the smart thing, and doing the stupid thing, and then there is putting Mark Penn in charge of your strategic planning:

In the biggest shuffling of Microsoft’s executive ranks since the company’s new chief executive, Satya Nadella, took over, Mark Penn, the former aide to the Clinton family, is becoming the company’s chief strategy officer.

The change will give Mr. Penn, who has been an executive vice president at Microsoft overseeing advertising and strategy, a bigger hand in determining which markets Microsoft should be in and where it should be making further investments, according to a person briefed on the change who spoke on the condition of anonymity because it had not been publicly announced.

Tami Reller, the company’s executive vice president for marketing, who shared leadership of advertising and marketing at Microsoft, will leave the company, as will Tony Bates, Microsoft’s executive vice president of business development, this person said.

After the way he handled the Hillary campaign in 2008, when he thought that the Democratic primaries were winner take all, when delegates were proportionately allocated , I’m surprised that anyone would employ him at anything.

This is not bad strategy, this is death throes.

Of course, your son is already showering with gay men in gym class, at the health club, in the US military, in the NFL, and in the US Congress. In a world of right wing hack judges issuing morally indefensible options, Federal District Judge William Martini has set a contemptible new standard:

The first legal challenge to the New York police department’s blanket surveillance of Muslims in the wake of the 9/11 terrorist attacks has been dismissed by a federal judge in New Jersey in a ruling that lawyers acting for the plaintiffs have described as preposterous and dangerous.

Judge William Martini, sitting in the US district court for the district of New Jersey, threw out a lawsuit brought by eight Muslim individuals and local businesses who alleged their constitutional rights were violated when the NYPD’s mass surveillance was based on religious affiliation alone. The legal action was the first of its type flowing from the secret NYPD project to map and monitor Muslim communities across the east coast that was exposed by a Pulitzer prize-winning series of articles in 2011 by the Associated Press.

In his judgment, released on Thursday, Martini dismisses the complaint made by the plaintiffs that they had been targeted for police monitoring solely because of their religion. He writes: “The more likely explanation for the surveillance was a desire to locate budding terrorist conspiracies. The most obvious reason for so concluding is that surveillance of the Muslim community began just after the attacks of September 11, 2001. The police could not have monitored New Jersey for Muslim terrorist activities without monitoring the Muslim community itself.”

The Martini decision absolves the NYPD of having caused distress or damage to Muslims caught by its mass surveillance on the unusual grounds that were it not for the Associated Press disclosure of the secret programme, those targeted by the monitoring would have been unaware that it was happening.

“The Associated Press covertly obtained the materials and published them without authorization. Thus the injury, if any existed, is not fairly traceable to the City,” Martini writes.

Later in the judgment, he adds: “Nowhere in the complaint do plaintiffs allege that they suffered harm prior to the unauthorized release of the documents by the Associated Press. This confirms that plaintiffs’ alleged injuries flow from the Associated Press’s unauthorized disclosure of the documents. The harms are not ‘fairly traceable’ to any act of surveillance.”

So, it’s OK to profile Muslims, and possibly entrap them, so long as you do not about it?

This judge seems to think that it makes sense to send spies into girls schools.

This is f%$#ing insane, and I hope that this Bush appointee’s ruling is overruled before the ink is dry.
